ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.- ESIDENTIAL ORDINANCE NO. ,5 626 66 ) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of PAUL SYLLA on January 12, 2000 in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land located in part of the SW 1 /4 of the NW 1 /4 of Section 21, Township 28 North, Range 19 West, Town of Troy, St. Croix County, Wisconsin; also being a part of Lot 1 of Certified Survey Map recorded in Volume 4, Page 1157 at the St. Croix County Register of Deeds office; further described as follows: Commencing at the West quarter corner of said Section 21; thence N00 °00'00 "E, along the west line of said SW 1 /4 of the NW 1 /4, 424.80 feet to northwest comer of Lot 2 of Certified Survey Map recorded in Volume 10, Page 2819 at the St. Croix County Register of Deeds office and the point of beginning; thence continuing N00 °00'00 "E, along said west line, 703.61 feet; thence N90 °00'00 "E 546.77 feet; thence S01 °15'38 "E 1115.96 feet to the east — west 1 /4 line of said Section 21; thence S88 °43'31 "W, along said east — west 1 /4 line, 346.45 feet to the east line of said Lot 2; thence N00 °00'41 "W, along said east line, 424.81 feet to the northeast corner of said Lot 2; thence S88 °43'20 "W, along the north line of said Lot 2, 224.93 feet to the point of beginning. Above described parcel contains 12.209 acres (531,806 sq. ft.) Described parcel is subject to Town Road (Rolling Meadow Drive) right -of -way and all other easements, restrictions and covenants of record. Based on the following findings: 1. Staff recommendation 2. Family member adding the 12 +/- acres onto an existing parcel 3. Meets the intent and requirements of Wis. Stat. 91.77 4. Soils are not suitable for farming 5. Meets the intent of the town plan(Town approved request) 6. No objections from adjacent property owners. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag.- Residential.
