CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.-(2ESIDENTIAL ORDINANCE NO. .S' .3 C 66° WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of PAUL SYLLA on April 12, 2000 in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land located in part of the NW 1 /4 of the NW 1 /4, part of the SW '/4 of the NW 1 /4 and in part of the SE '/4 of the NW 1/4 of Section 21, Township 28 North, Range 19 West, Town of Troy, St. Croix County, Wisconsin; being Lot 1 of Certified Survey Map recorded in volume 4, Page 1157 at the St. Croix County Register of Deeds office; described as follows: Beginning at the Northwest comer of said Section 21; thence N88 °49'44 "E, along the north line of the NW 1 /4 of said Section 21, 495.06 feet to the west line of a Certified Survey Map recorded in volume 4, Page 1107 at said office; thence S00 °05'01 "W, along said west line, 659.11 feet to the south line of said Certified Survey Map; thence N88 °50'41 "E, along said south line, 568.76 feet; thence S21 °19'02 "E 706.31 feet; thence S01 °27'03 "E 212.02 feet; thence N89 °19'26 "E 349.27 feet to the centerline of Towns Valley Road; thence S25 °55'15 "E, along said centerline, 1210.09 feet to the east - west' /4 line of said Section ; thence S88 °48'49 "W, along said east -west '/4 line, 1636.10 feet; thence N01 °10'20 "W 1079.20 feet; thence N89 °54'42"W 546.77 feet to the west line of said NW '/4; thence N00 °05'18 "E, along said west line, 1509.10 feet to the point of beginning. Above describe parcel contains 66.814 acres (2,910,422 sq. ft.) Described parcel is subject to Town Road (Rolling Meadow Drive and Towns Valley Road) right -of -way and all other easements, restrictions and covenants of record. Based on the following findings: 1. The Town of Troy has recommended approval of the rezoning request. 2. The Town of Troy recently adopted a new subdivision ordinance. The technical requirements of the new subdivision ordinance carry out many of the goals and objectives of the Town of Troy Growth Management Plan. 3. The Town of Troy confirmed that the proposed rezoning and subsequent subdivision are substantially compliant with the technical requirements of the subdivision ordinance and most goals and policies of the Growth Management Plan. 4. The Town recognizes that the Growth Management Plan must be amended to provide total consistency between the Plan and the subdivision ordinance. This interim rezoning request and subsequent subdivision meets many of the goals (and objectives) of the Growth Management Plan. Specifically: Goal 1: Preservation of the Town's Rural Atmosphere Goal 2: Preservation of Prime Agricultural Lands for Farming Goal 3: Promotion of Orderly, Economical, and Diverse Development in Harmony with the Natural Environment. 5. The Growth Management Plan is advisory, while the new Town subdivision ordinance has the force of law. 6. Existing Ag /Residential zoned land is located to the north, southwest, west and east. 7. The Town of Troy has submitted supplemental information including a letter, resolution and other related documents, justifying their recommendation for approval. 8. The Town and the county have certified that the provisions of §91.77 have been met. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag.- Residential.
