CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE A R ESIDENTIAL ORDINANCE NO. r� WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of LAWRENCE O. AND JANET M. MARTELL on June 28, 2000 at the St. Croix County Government Center in- Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: All that part of the North Half of the Southwest Quarter and the North Half of the Southwest Quarter of Section 1, Township 30 North, Range 19 West, Town of Somerset, St. Croix County, Wisconsin, described as follows: Beginning at the northwest corner of said Southwest Quarter; thence South 89 degrees 51 minutes 51 seconds East, assumed bearing, along the north line of said Southwest Quarter, a distance of 2155.69 feet to the northwest corner of Certified Survey Map, Volume 3, Page 844; thence South 04 degrees 36 minutes 34 seconds West, along the west line of said Certified Survey Map (recorded as NO3 degrees 44 minutes 42 seconds E 424.05) a distance of 424.00 feet to the southwest corner of said Certified Survey Map; thence South 87 degrees 08 minutes 04 seconds East, along the south line of said Certified Survey Map, (recorded as N88 degrees 01 minutes 07 seconds W, 515.96) a distance of 515.90 feet to the southeast corner of said Certified Survey Map; thence continuing South 87 degrees 08 minutes 04 seconds East, a distance of 24.44 feet to its intersection with the east line of said Southwest Quarter; thence South 00 degrees 09 minutes 05 seconds West, along said east line of the Southwest Quarter, a distance of 1539.22 feet to its intersection with the south line of the North Half of the South Half of said Southwest Quarter ; thence North 89 degrees 54 minutes 46 seconds West, along said south line of the North Half of the South half of the Southwest Quarter, a distance of 2648.33 feet to its intersection with the west line of said Southwest Quarter; thence North 00 degrees 15 minutes 21 seconds West, along said west line of the Southwest Quarter, a distance of 1989.97 feet to the point of beginning. This parcel contains 116 acres, more or Tess, and is subject to the right of way of the township road. Based on the following findings: 1. The Town of Somerset supports the rezoning. 2. Rezoning of the parcel would have no adverse effect on surrounding lands. 3. The Town and the County have certified that the provisions of § 91.77 have been met. 4. The rezoning conforms to the County Plan. 5. The land is in the rural planning area and is an appropriate use. 6. The land is not identified on the potentially productive agriculture map. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag- Residential.
