ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AG /RESIDENTIAL TO COMMERCIAL ORDINANCE NO. 55 y (.1 n ©I) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of Kent Kramer (formerly Ardis Kramer property) on August 22, 2000 at the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77,voted to approve a rezoning of the following described land: Somerset Antiques Parcel: Lot 4 of Certified Survey Map, recorded in Volume 1 of Certified Survey Maps, page 199, Document No. 330375, on November 25, 1975. Except the following described parcel: Part of Lot 4 of a Certified Survey Map recorded in Vol. 1, Page 199, Document No. 330375, located in the NE 1 /4 of the NW 1 /4 of Section 4- 30-19, Town of Somerset, St. Croix County, Wisconsin, described as follows: Commencing at the NW corner of said Lot 4; thence S2 °33'35 "W 247.08' along the most Westerly line of said Lot 4 to the point of beginning of said parcel "B "; thence S0 °33'35 "W 86.76' along said Westerly line of Lot 4; thence N3 °35'E 161.91'; thence N84 °04'41 "W 141.89' to the point of beginning. This parcel contains 6,145 square feet, more or less, being 0.141 acres, more or less. Also including the following: Part of a parcel of land described in Vol. "466 ", page 165, Doc. Based on the following findings: 1) The proposal meets Town of Somerset Land Use Plan. 2) The proposal meets all requirements of the St. Croix County Zoning Ordinance. 3) These two (2) parcels have had commercial uses on them since the 1960's. 4) The Town of Somerset recommends approval of the request. 5) This rezoning request will correct an existing mapping error. 6) The size and scope of the existing businesses are defined in the attached memorandum, and made part of the rezoning record. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Ag /Residential to Commercial. St. Croix County Planning, Zoning and Parks Committee instructed staff to identify and document the existing size and scope of the existing business operations on the two parcels proposed for rezoning from Ag- Residential to Commercial. The existing size /scope and usage on the two parcels is as follows: Kustom Kars Property • Kustom Kars main building is 4138 sq. ft. (floor plan/dimensions enclosed) and 40 -ft. X 72 -ft. pole building on site. • Automotive sales (retail and wholesale — up to 200 units. Existing blacktop area 33,000 sq. ft. Proposed paved expansion not to exceed a maximum area of 48,000 — 50,000 sq. ft. of paved parking area. Storm water plans may be required for this blacktop expansion. Plans must be reviewed/approved by St. Croix County Zoning and Land and Water Conservation Office for storm water review. • Leasing and rental of cars and light trucks only. Display and consignment of cars and light trucks with a limit of 15 units at one time. • Existing automotive repair and service facility, automotive detail, clean up, car wash, automotive parts. • Car /truck/boat/RV storage in enclosed building (existing pole shed). Inside storage facility. One existing semi - trailer for storage on -site. • Hours of operation: 8:00 am to 8:00 p.m. Monday thru Saturday and occasional evenings by appointment, up to 10:00 p.m. • Signage: Primary sign is double faced and illuminated, 8 ft. X 22 ft. detached garage. This building includes the sale, storage and consignment of antiques — including furniture, clothing (inside sales only). • Bookkeeping and tax accounting offices/ real estate offices. • Hours of operation: 8:00 am to 8:00 p.m. Monday thru Saturday and occasional evenings by appointment, up to 10:00 p.m. • Signage: Primary sign is double -faced non - illuminated, 8 ft. X 12 ft. Secondary sign is double faced, non - illuminated 3 ft. X 3 ft. on an inverted "L" mount (2 signs total). • Lighting on lot and buildings: There are 4 outdoor floodlights in the south lawn area facing the front of the house. Additionally there are 2 outdoor floodlights on the east wall of the attached garage, 2 outdoor floodlights on the north (back) wall of attached garage and 1 outdoor floodlight at the north entrance to the duplex (4 lot lights and 5 building lights total). Any minor changes in size /scope or expansion of the above noted uses shall require review and approval by the St. Croix County Zoning director. Any major change and/or additions to the above noted uses will go through the special exception approval process, where applicable, as stated in the ordinance.
