V (0, cr WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of ARLEN E. AND JUDITH LUEHMANN on October 25, 2000 in the St. Croix Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land located in part of the NW 1 /4 of the NW 1 /4, Section 1, T31 N, R18W, Town of Star Prairie, St. Croix County, Wisconsin; described as follows: Commencing at the NW Corner of Section 1; thence S87 °11'49 "E, along the north line of the NW % of Section 1, 749.69 feet to the point of beginning; thence continuing S87 °11'49 "E, along said north line, 563.37 feet to the east line of the NW % of the NW 1 /4 of said Section; thence S00 °11'53 "W, along said east line, 1143.16 feet; thence N44 °03'40 "W 147.63 feet; thence N30 °47'23 "W 233.77 feet; thence N30 °35'03 "W 319.06 feet; thence N00 °11'53 "E 232.74 feet; thence N79 °27'51 "W 142.23 feet; thence N40 °49'32 "W 55.12 feet; thence N00 ° 11'53 "E 288.65 feet to the point of beginning. Parcel contains 9.21 acres (401,322 sq. ft.) and is subject to the Town Road (Polk/St. Croix Road) right -of -way. Parcel is subject to all easements, restrictions and covenants of record; AND A parcel of land located in part of the N 1/2 of the Government Lot 1, Section 2, T31N, R18W, Town of Star Prairie, St. Croix County, Wisconsin; described as follows: Commencing at the N 1/4 Corner of Section 2; thence S88 °06'08 "E, along the north line of the NE % of said Section, 302.13 feet to the northwesterly extension of the easterly line of a parcel of land recorded in Volume 876, Page 365 at the St. Croix County Register of Deeds Office; thence S18 °06'08 "E, along said northwesterly extension, 35.12 feet to the point of beginning; thence continuing S18 °06'08 "E, along said easterly line, 842.92 feet to the south line of the N 1/2 of Government Lot 1; thence S89 °24'27 "E, along said south line, 111.40 feet; thence N04 °45'11 "E 790.52 feet to the south line of a parcel of land recorded in Volume 456, Page 39 at said office; thence N88°06'08'W, along said south line, 439.05 feet to the point of beginning. Parcel contains 5.00 acres (217,800 sq. ft.). Parcel is subject to all easements, restrictions and covenants of the record; AND A parcel of land located in part of the SE' of the NE' , Section 2, T31N, R18W, Town of Star Prairie, St. Croix County, Wisconsin; described as follows: Commencing at the E 1/4 Corner of Section 2; thence S89 °34'50 "W, along the east - west 1/4 line of said Section, 215.61 feet to the point of beginning; thence continuing S89 °34'50 "W, along said east — west 1/4 line, 447.01 feet; thence N00 °12'22 "E 874.89 feet to the southwesterly line of County Trunk Highway "M" being a point on a 1190.91 foot radius curve, concave northeasterly, whose central angle measures 45 °55'35 ", whose chord bears S37 °05'11.5 "E and measures 929.24 feet; thence southeasterly, along the arc of said curve and southwesterly line, 954.59 feet to the southeasterly right -of -way of a Town Road (Huntington Drive); thence S31 °53'04 "W, along said southerly right -of -way, 61.71 feet to the point of curvature of a 218.00 foot radius curve, concave northwesterly, whose central angle measures 30°27'21", whose chord bears S47 °06'44.5 "W and measures 114.52 feet; thence southwesterly, along said arc and southerly right -of -way, 115.88 feet to the point of beginning. Parcel contains 5.00 acres (217,800 sq. ft.) and is subject to Town Road (Huntington Drive) right -of -way. Parcel is subject to all easements, restrictions and covenants of record. Based on the following findings: 1. The applicant modified the rezoning request in an attempt to preserve tillable farmland on the parcel. 2. The property is adjacent to residential development. 4 , 3. The property is located near the Village of Star Prairie. 4. The Town of Star Prairie and the Village of Star Prairie recommend approval of'the request. 5. The Town and County confirmed that the request is compliant with §91.77. 6. The request meets the guidance and intent of the County Plan. 7. There will be no impact on the rural character of the area. Due to the lay of the land, there will only be one home placed on each parcel. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag.- Residential.
