CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AG /RESIDENTIAL TO COMME� CI L ORDINANCE NO. 5 d (cm ) WHEREAS,the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of HEHLI - VOLD CORP. on January 20, 1999 in the Baldwin Town Hall; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, voted to approve a rezoning of the following described land: A parcel of land located in the Northwest Half (NW %) of the Northwest Fractional one fourth of Section Nineteen (19) Township Twenty Nine (29) North, Range Sixteen (16) West, Town of Baldwin, St. Croix County, Wisconsin, described as follows: Commencing at the Northwest Comer of said Section Nineteen (19), Thence Due South 1314.05 feet along centerline of Highway 63; Thence South 87 °23'09" East 50.00 feet to the point of beginning of this survey. Thence South 87 °23'09" East 494.50 feet; Thence Due North 400.00 feet; Thence North 87 °23'09" West 494.50 feet; Thence Due South 400.00 feet to the point of beginning. This parcel contains 217,800.00 square feet or 5 acres more or less including road right -of -way, or 197,800.00 square feet or 4.54 acres more or less excluding the road right -of -way. From Ag /Residential to Commercial. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Ag /Residential to Commercial. CROIX COUNTY BOARD OF SUPERVISORS MEETING OF MARCH 16, 1999 SUBJECT: Report of the Planning, Zoning and Parks Committee decision recommending denial of the Dennis Emmert rezoning request from Agriculture to Commercial. BACKGROUND: Dennis Emmert requested that four acres be rezoned from Agriculture to Commercial. There is a large LP gas tank on this property and a gas company wants to lease the tank and use it as a distribution point. The gas would be used for corn drying and home heating. To do this, the property would have to be zoned commercial. Corporation Counsel gave an opinion that this type of rezonement is considered "spot zoning" and is not legal. LOCATION: The property is located in Section 27, in the Town of Erin Prairie . FINDINGS: The Committee considered all written information, verbal presentations and conducted a site visit. After careful consideration, the committee found: 1. The request for rezonement of this property appears to be a case of "spot zoning ". The Committee agrees with the opinion of Corporation Counsel that this would not be legal and has denied the rezonement of this property from Agriculture to Commercial. DECISION: The committee disapproved the proposed amendment. REQUIRED BOARD ACTION: 1. Accept the report of the Committee, or 2. The Board may refuse to deny the petition as recommended by the Committee. In such event, the Board shall refer the petition to the Committee with instructions to draft an ordinance effectuating the petition and report the ordinance back to the County Board, which may then adopt or reject the proposed ordinance.
