f ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG. -REST E TIAL ORDINANCE NO. s 5' � �� WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of LYLE H. AND BEVERLY PALMSTEEN on November 3, 1999 in the St. Croix County Govemment Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land located in part of the Fractional Northwest Quarter of the Northeast Quarter and the Southwest Quarter of the Northeast Quarter all in Section 5, Township 31 North, Range 19 West, Town of Somerset, St. Croix County, Wisconsin described as follows: Beginning at the North Quarter Comer of said Section 5; thence, on an assumed bearing along the north line of the Fractional Northeast Quarter of said Section 5, South 89 degrees 57 minutes 44 seconds East a distance of 1056.57 feet to the northwest corner of Lot 1 of a Certified Survey Map recorded in Volume 8 page 2245 in the Register of Deeds Office in said County ; thence, along the west line of said Lot 1, South 04 degrees 18 minutes 46 seconds West a distance of 552.13 feet to the southwest corner of last said Lot 1; thence, along the south line of last said Lot 1 and the easterly extension thereof, South 88 degrees 57 minutes 44 seconds East a distance of 256.31 feet to the east line of the Fractional Northwest Quarter of the Northeast Quarter of said Section 5; thence, along last said east and the east line of the Southwest Quarter of the Northeast Quarter of said Section 5, South 03 degrees 39 minutes 19 seconds East a distance of 1871.91 feet to the south line of the Southwest Quarter of the Northeast Quarter of said Section 5; thence, along last said south line, South 89 degrees 06 minutes 07 seconds West a distance of 1307.70 feet to the west line of the Southwest Quarter of the Northeast Quarter of said Section 5; thence, along last said west line and the west line of the Fractional Northwest Quarter of the Northeast Quarter of said Section 5, North 03 degrees 38 minutes 49 seconds East a distance of 2444.98 feet to the point of beginning. Containing 3,034,349 square feet (69.66 acres). Subject to right -of -way for Polk/St. Croix Road (a Town Road) along the most northerly line of the above described property, also subject to all easements, restrictions and covenants of record. From Agriculture to Ag /Residential. Based on the following findings: 1. The provisions of § 91.77 have been met with this rezoning request. 2. The proposed rezoning is consistent with the Town of Somerset Land Use Plan. 3. The Town of Somerset has recommended approval, and also found that the request is consistent with § 91.77 , and the Town Plan. 4. The Town provided a detailed narrative justifying their recommendation, the committee agrees with this detailed justification. 5. There was no opposition to the request. 6. Contiguous land to the east and west of the parcel is already zoned Ag /Residential. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag.- Residential.
