ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.-RESIDENTIAL ORDINANCE NO. 5 3 D (y'f) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of JOHN J. AND GEORGINE MOELTER on December 1, 1999 in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: An 11 acre parcel of land in the SW I A of the NE % and the SE 1 /4 of the NW 1 /4 of Section 15, T29N, R19W, Town of Troy, St. Croix County, Wisconsin, more particularly described as follows: Commencing at a point on the East -West quarter section line that is 1930.3 feet West of the East I A corner of said Section 15, said point being located in the center of a town road 365.3 feet West of the intersection of the centerlines of State Highway #35 and said town road; thence West 869.2 feet; thence North 825 feet; thence East 292.4 feet; thence south 34 °48' East and parallel with the centerline of State Highway #35, a distance of 1004.7 feet to the point of beginning. From Agriculture to Ag /Residential. Based on the following findings: 1. Meets the Town of Troy Growth Management Plan • Rezoning is consistent with the mapped Growth Management Plan. • Request clearly meets Goal 5 of the Grown Management Plan, which states "Provision of Services Adequate for the Health, Safety, and Recreational Needs of the Town, " and in Objectives 5.1, "To plan for the provision of public services in the future ". 2. The Town of Troy held public hearings and citizens fully supported the request. 3. The location on Highway 35 is a good location for the shop with easy access onto the highway. 4. The parcel is less desirable for farming due to Highway 35 expansion which has taken a portion of the property as the highway right -of -way. 5. Both town and county have considered provisions of Wis. Stat. 91.77, and have concluded that this statute has been met with this request. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag.- Residential.
