HomeMy WebLinkAboutOrdinance 1998 (481) ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG. -RES E kTIAL ORDINANCE NO. ' k/ q g\ WHEREAS,the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of EBBA KRAL on May 20, 1998 at the Pleasant Valley Town Hall; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land located in the Northeast Quarter (NE 1/4) of the Southwest Quarter (SW 1/4), the Northwest Quarter (NW 1/4) of the Southeast Quarter (SE 1/4) and the Northeast Quarter (NE 1/4) of the Southeast Quarter (SE 1/4) of Section 30, Township 28 North, Range 17 West, Town of Pleasant Valley, more fully described as follows: Commencing at the south 1/4 comer of said Sec. 30; thence N0 °20'26' W along the North -South 1/4 section line a distance of 1317.40 feet to the point of beginning; thence N89 ° 57'24'W along the South line of the NE 1/4 of the SW 1/4 a distance of 880.52 feet to a point on the Southerly right -of -way line of C.T.H. 'WI thence North 34.38 feet to a point on the centerline of C.T.H. 'W'; thence Easterly 211.16 feet along said centerline, also being the arc of a 644.15 foot radius curve concave Northwesterly whose long chord bears N63 ° 52'53 "E 210.22 feet; thence N54 ° 29'25 "E along said centerline a distance of 631.09 feet; thence Notheasterly 449.51 feet along said centerline, also being the arc of a 466.15 foot radius curve concave Northwesterly whose long chord bears N26 °51'53 "E 432.30 feet; thence N0 ° 45'39' W along said centerline a distance of 5.31 feet; thence . N89 ° 59'07 "E 425.96 feet; thence S65 ° 17'00 "E 799.89 feet; thence N89 "E 685.00 feet; thence S0 ° 29'42 "E 550.48 feet to a point on the South line of the NE 1/4 of the SE 1/4 of said Sec. 30; thence S89 ° 59'07"W 1859.55 feet along said line and along the south line of the NW 1/4 of the SE 1/4 to the point of beginning. CROIX COUNTY BOARD OF SUPERVISORS MEETING OF AUGUST 18, 1998 PLANNING, ZONING AND PARKS COMMITTEE REPORT SUBJECT: Report of the Planning, Zoning and Parks Committee decision recommending denial of the Jeff J. and Karen Egan rezoning request from Agriculture to Commercial. BACKGROUND: Jeff and Karen Egan wish to rezone 2.25 acres of land to Commercial to accommodate a woodworking business which currently operates under a major home occupation on the site. The applicants received a special exception for a major home occupation on the site in May 1996. The site is currently zoned Agriculture and the surrounding property is zoned Residential and Ag- Residential with platted subdivisions. Rezoning the entire site would make the house a non - conforming use. LOCATION: The property is located in Section 13 in the Town of Star Prairie. FINDINGS: The Committee considered all written information and verbal presentations. After careful consideration, the committee found: That they would recommend to the County Board to deny the rezoning of 2.25 acres of land from Agriculture to Commercial stipulating that the provisions of WI Statutes 91.77 have not been met and that the rezoning to commercial would be inappropriate in this location because of existing and proposed surrounding land uses. DECISION: The Committee disapproved the proposed application. REQUIRED BOARD ACTION: • 1. Accept the report of the Committee, or 2. The Board may refuse to deny the petition as recommended by the Committee. In such event, the Board shall refer the petition to the Committee with instructions to draft an ordinance effectuating the petition and report the ordinance back to the County Board, which may then adopt or reject the proposed ordinance.
