ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM
AGRICULTURE TO AG.- RESIDENTIAL
ORDINANCE NO. `T 3 j 0,7r6
WHEREAS,the Statutes of the State of Wisconsin provide for a
Planning and Development Committee to act in all matters pertaining
to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St.
Croix County Planning, Zoning and Parks Committee; and
WHEREAS, at the request of the County Board this Committee is
to review petitions, hold public hearings, and present its
recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning, Zoning and Parks
Committee held a public hearing on the rezoning request of DONALD
C. RIGGOTT on July 30, 1977 in the Baldwin Town Hall; and
WHEREAS, the St. Croix County Planning, Zoning and Parks
Committee having considered all written information and verbal
testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a
rezoning of the following described land:
The NE1 /4 of SE1 /4 of Section 19 -29 -16 EXCEPT commencing
at the SW corner of NE1 /4 of SE1 /4; thence North 22 1/2
feet; thence Southeast 32 feet; thence West 22 1/2 feet
to Point of Beginning.
From Agriculture to Ag. /Residential.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of
Supervisors, meeting in regular session, that the parcel is now
rezoned from Agriculture to Ag.- Residential.

MEETING OF JULY 22,1997
PLANNING, ZONING AND PARKS COMMITTEE REPORT
SUBJECT: Report of the Planning, Zoning and Parks Committee decision
recommending denial of the John D. Bettendorf rezoning request from
Agricultural /Residential District to Commercial District.
BACKGROUND: John D. Bettendorf requested that 4.499 acres be rezoned from
Agricultural /Residential District to Commercial District. This parcel is
currently used for storage of trucks and trailers for Bettendorf Trucking, in
violation of the St. Croix County Zoning Ordinance.
The parcel lies directly west of a 4.822 acre parcel owned by Mr.
Bettendorf and presently zoned Commercial District. The Commercial
District is the site of the Bettendorf Trucking facility. Mr. Bettendorf was
granted a special exception for the site to allow truck repair and the
operation of a transfer facility.
The rezoning is requested with the intent of following it with a special
exception request to expand the trucking operation to the 4.499 acre
parcel.
The St. Croix Zoning Ordinance gives the purpose and intent of the
Commercial District.
17.18 Commercial District. The commercial District is created to
establish and protect locations in which a wide variety of compatible
commercial uses may be located. Within this district most residential
development, manufacturing and industrial, and nonretail commercial
enterprises are not allowed in the interest of furthering the livelihood
of the permitted retail commercial uses and protecting uses from the
effects of incompatibility.
LOCATION: The property is located in Section 19, NW' , NE 1 /4, in the Town of
Kinnickinnic. The property is located approximately 320 feet east of
"CTH " SS.
FINDINGS: The Committee considered all written information submitted and verbal
presentations. After careful consideration, the Committee found:
1. The property owners in the area expressed their opposition to the
proposed rezoning and the committee concurred with their concern
over safety, existing and anticipated traffic conditions, increased truck
traffic, general welfare of the occupants of the surrounding lands, the
effect of increased truck traffic on the roads, noise and increased
traffic on the public streets.
2. The use is detrimental to the above factors and can not comply with
the above factors.
3. The existing and proposed use and the rezoning request is not in
harmony with the general purpose and intent of this ordinance.
4. The County must consider the need to prevent and avoid a traffic
safety hazard.
5. The adjacent Commercial District property is the location of a large
trucking facility.
6. The existing operation is not appropriate in a Commercial District and
is not appropriate in the Agricultural / Residential neighborhood. The
existing use is more of an industrial use than a commercial use,
expansion is therefore not appropriate now or in the future.
DECISON: The Committee disapproved the proposed amendment.
REQUIRED BOARD ACTION:
1. Accept the report of the Committee, or
2. The Board may refuse to deny the petition as recommended by
the Committee. In such event, the Board shall refer the petition to
the Committee with instructions to draft an ordinance effectuating
the petition and report the ordinance back to the County Board,
which may then adopt or reject the proposed ordinance.

The Town Board reconvened the regular monthly meeting of July 1, 1997
immediately following the Bettendorf Hearing on July 2, 1997.
Final motion after reconvening into open session regarding rezoning issue:
Motion to approve rezoning request for 4.499 acres as presented on Certified
Survey Map by Larry Murphy with stipulations. The area will only be used
for trailer parking for the current trucking operation. If Bettendorfs
discontinue operation of the trucking operation, or sell the property, it
reverts back to the original zoning of agricultural /residential.
Vote: Gerald Larson - No
David Wittig - Yes
Charles Andrea - Yes
