HomeMy WebLinkAboutOrdinance 1997 (441) ORDINANCE ESTABLISHING A RESIDENTIAL DEVELOPMENT MORATORIUM ON LANDS WITHIN THE GLEN HILLS WATERSHED Ordinance No. 4 474 / (c 7) St. Croix County, Wisconsin The St. Croix County Board of Supervisors does ordain as follows: I. Purpose. This temporary ordinance is enacted to promote the public health, safety and general welfare of the residents of St. Croix County. Areas below the ten earthen dams located in the Glen Hills Watershed are not presently restricted for residential construction. Failure of an earthen dam would pose a substantial threat of property damage, injury, or loss of life if residential construction occurs. The land and water conservation department is now in the process of developing and implementing a breach route study to identify those areas needing regulation through a flood plain zoning ordinance. Structures (dams) 4, 5, 6, and 10 are presently classified as high- hazard dams by the Wisconsin Department of Natural Resources (DNR). If development below any of the other structures (dams) occurs those structures would also be classified as high - hazard dams by the DNR because of the potential for property damage, injury and loss of life through flooding. II. Authority. This ordinance is enacted under the authority granted by sec. 87.30, Wisconsin Statutes. III. Applicability. This ordinance shall apply to and regulate areas already identified by a breach route study and areas identified as special flood hazard areas as shown the attached map, Attachment A. Attachment A was presented at a public hearing on March 12, 1997. IV. Duration. This ordinance shall be effective for a period of two years from the date of enactment. V. Scope of Regulation. While this ordinance is in effect: A. No residence shall be constructed, erected, placed, or enlarged, nor shall any zoning or sanitary permit be issued by the County for the construction, erection, placement or enlargement of any residence within the area regulated. B. The County Planning, Zoning and Parks Committee shall not grant preliminary or final approval to any major or minor subdivisions of land within the area regulated. C. The County Planning, Zoning and Parks Committee shall not recommend and the County Board shall not approve any rezoning applications for lands within the area regulated if it would be contrary to the purpose of this ordinance. D. The County Board of Adjustment shall not grant special exception use permits or variances for lands in the area regulated if it would be contrary to the purpose of this ordinance. VI. Penalties. Any person, corporation or other entity who violates the provisions of this ordinance shall be subject to civil forfeitures and injunctions as provided by sec. 17.71, St. Croix County Zoning Ordinance. VII. Severability. If any portion of this ordinance is found invalid by a court, that finding shall not effect the applicability of any remaining portions of the ordinance which can be applied without reference to the invalid portion. VIII. Effective Date. This ordinance shall become effective upon its enactment by the St. Croix County Board of Supervisors and publication.
