HomeMy WebLinkAboutOrdinance 1996 (389) AN ORDINANCE ESTABLISHING A PRIMARY DEVELOPMENT MORATORIUM FOR LANDS WITHIN A MAJOR TRANSPORTATION CORRIDOR ORDINANCE NO. 3s1 ('c The St. Croix County Board of Supervisors does ordain as follows: Section I. Authority This ordinance is enacted to promote the public health, safety and general welfare of the citizens of St. Croix County as provided under sections 59.97, 59.971, 145.20 and 236.45, Wisconsin Statutes. Section H. Purpose The State of Wisconsin is currently designing major transportation improvements to State Trunk Highways 35 and 64 in St. Croix County, and the County has undertaken the preparation of a County Development Management Plan and update of the County Zoning Ordinance. The highway improvements are located in rapidly growing portions of the County. This moratorium is necessary to allow the St. Croix County Board of Supervisors and local communities time to complete studies, make plans and adopt ordinances to provide for and be compatible with the orderly development of these transportation facilities and areas to be served by them, and to protect the public interest in safe and efficient highways and the adjoining local road network. The County Board of Supervisors has concluded that issuance of new development approvals during the period of study and planning could preempt the purposes of these planning efforts and destroy its beneficial effects. Therefore, the County Board of Supervisors finds that the studies, plans and ordinances will not be effective unless a moratorium is imposed on rezonings, subdivisions, zoning and sanitary permits and preliminary or fmal approval of plats for all development within the proposed major transportation corridor in St. Croix County. Section III. Applicability This ordinance shall apply to and govern lands in St. Croix County that are located in the anticipated right -of -way of the propQs,es .S H 35 and 64 from the St. Croix River to New Richmond for the period from the effective date of this ordinance until June 30, 1997, unless this ordinance is amended by the St. Cilia -County Board of Supervisors. These areas are located in the Towns of St. Joseph, Somerset and S&r Prairie and are shown on the accompanying map which is made part of this ordinance by reference. Section W. Scope of Regulations Except as hereinafter provided, this ordinance is in effect: 1 LNo building or structure shall be constructed, erected, placed, or enlarged, nor shall any zoning or sanitary permit be issued by the County for the construction, erection, placement, or enlargement of any building or structure on any property within the area described in Section III. 2) The Planning & Development Committee shall not grant preliminary or final approval to any major or minor subdivisions of lands in the area described in Section III. 3) The Planning & Development Committee shall not recommend and the County Board shall not approve any rezoning applications for lands in the area described in Section III. 4) The Board of Adjustment shall not grant special exception permits or variances for lands in the area described in Section III. 1 • Section V. Exceptions Section IV shall not apply in the following instances, provided that the application qualifies and is in conformance with all other applicable ordinances and regulations of the County: 1) Where the County has approved, prior to the effective date of this ordinance, a development plan or preliminary or final plat for a proposed development. 2) Maintenance and/or repair of any lawful structure, facility or construction existing on the effective date of this ordinance. 3) Construction by a public agency. 4) Interior remodeling within an existing lawful structure. 5) Construction determined to be necessary to protect public health, safety, life or property. Section VI. Penalties Any person, corporation or other entity who violates the provisions of this ordinance shall be subject to civil forfeitures and injunctional orders as provided by section 17.71 of the St. Croix County Zoning Ordinance. Section VII. Severability A finding of invalidity of any word or section of this ordinance shall not affect the applicability of any remaining words or sections which can be applied without reference to the invalid word or section. Section VIII. Effective Date This ordinance shall become effective upon its adoption by the St. Croix County Board of Supervisors and publication.
