CROIX COUNTY, WISCONSIN WHEREAS, 1989 Wisconsin Act 335, the "State Recycling Act" designates municipalities (cities, villages and towns) as a "responsible unit" for purposes of implementing a recycling program within its jurisdiction (sec. 159.09, Wis. Stats.); and WHEREAS, the Act provides an alternative by allowing a county board of supervisors to adopt a resolution designating the county a responsible unit, which makes the county the responsible unit for the entire county, except as follows; and WHEREAS, within 90 days after the county board of supervisors adopts a resolution designating the county a responsible unit, the governing body of a municipality may adopt a resolution retaining the municipality's status as a responsible unit, leaving the county the responsible unit for the remainder of the county; and WHEREAS, a grant program has been developed for responsible units; and WHEREAS, for a county that is the responsible unit for at least 75% of the population of the county, the grant amount would be at least $100,000 annually, but would be much less if the county were the responsible unit for less than 75% of the population of the county; and WHEREAS, it is advisable to determine with certainty if municipalities representing at least 75% of the population of St. Croix County approve of the County being designated the responsible unit by passage of a resolution; NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board - of Supervisors that: 1. A written request be made of all municipalities in St. Croix County that they adopt a resolution in support of St. Croix County designating itself as the responsible unit for State Recycling Act purposes; 2. A model resolution of support be provided to all municipalities to act on; 3. The municipalities take action on the resolution of support before October 1, 1991 or the municipality will be deemed to not support the County's designation of responsible unit; 4. The County designates itself the responsible unit for the county for purposes of implementing a recycling program; 5. If at least 75% of the population of St. Croix County does not pass the resolution of support before October 1, 1991, this resolution be rescinded at the October, 1991 session of the Board of Supervisors; BE IT FURTHER RESOLVED that St. Croix County take the following actions to create an effective recycling plan: 1. Develop and adopt an ordinance to comply with Act 335 landfill and incineration bans; 2. Develop and adopt an ordinance which requires all waste haulers licensed in St. Croix County to provide collection, processing and marketing of recyclables for each resident and business of the County; 3. Develop and implement a waste reduction, reuse and recycling public education program; 4. Develop and adopt an ordinance which requires that occupants of residential, commercial, retail, industrial and governmental buildings separate from their postconsumer waste the materials subject to Act 335 ban on disposal effective January 1, 1995; 5. Develop and adopt an ordinance that requires owners of commercial, retail, industrial and governmental facilities to do all of the following: (1) provide containers for a separation program; (2) regularly notify all users and occupants of the facilities of these programs; and (3) provide for the collection and transportation of recyclable materials separated from solid waste by these users and occupants; 6. Develop and adopt an ordinance in which all charges for waste disposal are made according to a volume -based fee system; and 7. Provide adequate enforcement of all ordinances. BE IT FURTHER RESOLVED that municipalities will be expected to perform the following tasks: 1. Help provide information for educational materials; 2. Help distribute brochures and posters; and 3. Provide local, grass roots publicity and support. BE IT FURTHER RESOLVED that a copy of this be forwarded to all St. Croix County municipalities. Dated this j 3 day of , 1991. NNE, St. Croix Caner l RESOLUTION APPROVING ST. CROIX COUNTY'S DESIGNATION AS THE RESPONSIBLE UNIT FOR THE COUNTY RESOLUTION NO. St. Croix County, Wisconsin WHEREAS, 1989 Wisconsin Act 335 requires recycling throughout the State; and WHEREAS, the Act designates each city, village and town as a "responsible unit" for purposes of establishing and maintaining a recycling program; and WHEREAS, the Act provides an alternative to the cities, villages and towns of a county by allowing the county to designate itself as the responsible unit; and WHEREAS, if 75% of the population of a county supports the county designating itself as the responsible unit, substantial annual grants are available to the county to carry out its recycling program; NOW, THEREFORE, BE IT RESOLVED by the City, Village, Town) of that it supports St. Croix County designating itself as the (Name) responsible unit for the County for as long as the County maintains that designation; and BE IT FURTHER RESOLVED that the option for a city, village or town to "opt out" of the County's designation as the responsible unit within 90 days of the adoption of the County's designation resolution, pursuant to section 159.90(1)(c), Wis.
