RESOLUTION REQUESTING DELAY IN
IMPLEMENTATION OF MA ESTATE LIABILITY PROGRAM

Whereas, the State Biennial Budget for 1991 -93 authorizes the Department of
Health and Social Services to recover from MA recipient estates, an amount up
to the total costs of Medicaid paid on behalf of an individual while the
individual (at any age) resided in a nursing home, and /or the costs of any
Medicaid services paid on behalf of an individual when s /he was age 65 or older
(whether or not in a nursing home).
Whereas, the new provisions affect the estates of recipients who die after
September 30, 1991 and who received, after August 15, 1991, Medicaid nursing home
services and /or any Medicaid services when they were age 65 or older.
Whereas, the state may file a claim against a recipient's estate of his /her
surviving spouse, for recoverable amounts only when there is no surviving spouse,
or surviving child under age 21, or surviving adult child who is blind or
disabled.
Whereas, the effective date for changes to the estate is August 15, 1991 while
county government and local units on aging were not informed of the law change
until October 1, 1991.
Whereas, the State Division of Health which is charged with implementing the
provision of the new law has yet to develop procedures for implementation.
Therefore, be it resolved that the St. Croix County Board of Supervisors
recommend that the effective date for initiating the Medical Assistant Estate
Liability Program be changed to January 1, 1993 so that MA recipients may make
an informed decision regarding whether to accept MA benefits with full knowledge
that their estates will be charged the full cost of services after they are
deceased.
