HomeMy WebLinkAboutResolution 1990 (41) RESOLUTION APPOINTING MEDICAL EXAMINER Resolution No. / (I' J) St. Croix County, Wisconsin WHEREAS, St. Croix County has adopted the medical examiner system as authorized by law; and WHEREAS, the Public Protection Committee has conducted an extensive search for a person qualified to act as Medical Examiner; and WHEREAS, an agreement has been negotiated with Marty Shanklin, of New Richmond, Wisconsin, to provide medical examiner services for the County if he is appointed by the Board of Supervisors; NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors, meeting in regular session, that Marty Shanklin, of New Richmond, Wisconsin, is hereby appointed St. Croix County Medical Examiner upon the terms and conditions of the agreement negotiated with him and attached hereto; BE IT FURTHER RESOLVED that the Chairman of the Board of Supervisors and the County Clerk execute the agreement on behalf of St. Croix County. Nelson, St. Croix County Clerk AGREEMENT FOR MEDICAL EXAMINER SERVICES This agreement is made by and between the St. Croix County Board of Supervisors, hereinafter referred to as County, and Marty Shanklin, hereinafter referred to as Medical Examiner. This agreement regards the provision of Medical Examiner services to the County. The following constitute the terms of this agreement. 1. Subject to appointment by the St. Croix County Board of Supervisors, the Medical Examiner will perform the duties required by Wisconsin Statutes, commencing on the day after the expiration of the coroner's term in 1991. 2. The Medical Examiner shall appear before and make monthly reports to the County Public Protection Committee, at the committee's regular monthly meetings, regarding his official activities. The Medical Examiner will provide all information deemed necessary by the committee. 3. The County will pay the Medical Examiner $500 per month as compensation for his services. The Medical Examiner shall also be paid $50 each time he: (1) goes to a death scene, when requested by a law enforcement officer or otherwise required by law or; (2) views a body and issues a cremation ' permit. The Medical Examiner shall each month submit a voucher and copies of all death certificates required to be issued in the month for which payment is requested. 4. The term of this agreement shall be one year, from January 1, 1991 through December 31, 1991. • 5. Both parties agree that the Medical Examiner shall utilize the Ramsey County, Minnesota Medical Examiner's office for necessary death investigations and autopsies. 6. The County will provide the Medical Examiner with office space, and the Medical Examiner shall keep in his office current complete and accurate records. 7. The Medical Examiner shall provide a bond in the amount of $5,000 for the faithful performance of all official duties required of him by statute. 8. The Medical Examiner shall appoint, train and supervise assistants as he deems appropriate and necessary. The cost of the assistants shall be the responsibility of the Medical Examiner. 9. This agreement does not create an employer - employee relationship between the County and the Medical Examiner; the Medical Examiner is an independent contractor. The County is interested only in the results to be achieved, and the conduct and control of the work will lie solely with the Medical Examiner. The Medical Examiner is not to be considered an agent or employee of the County for any purpose, and the employees of the Medical Examiner are not entitled to any of the benefits that the County provides its employees. 10. The work to be performed under this agreement will be performed entirely at the Medical Examiner's risk. The Medical Examiner shall indemnify the County for all claims and liability arising out of his acts or omissions. Medical Examiner shall provide insurance indemnifying the County in an amount not less than $1,000,000. 11. Either party may terminate this agreement on 60 days written notice. Upon termination, all equipment provided by the County, files, books, records, accounts, vouchers • and memoranda pertaining to the work performed by the Medical Examiner shall be turned over to the County. 12. The Medical Examiner shall perform his duties professionally, courteously and in a manner consistent with the sensitive nature of the work. 13. Bills from Ramsey County Medical Examiner, transportation service providers and other necessary services related to deaths shall be submitted to the Medical Examiner but paid by the County. 14.
