EMERGENCY
RESOLUTION
AUTHORIZING LEGAL ACTION TO PROTECT
COUNTY INTERESTS IN COURT REIMBURSEMENT
Resolution ## 3V --9 WHEREAS, Wisconsin Statute 814.25 provided reimbursement to counties for
certain court costs in civil actions brought by or against the state; and
WHEREAS, responsibility for fulfillment of this statute existed within the
Department of Justice along with an appropriation but claims for this
reimbursement were denied to counties by the Department of Justice; and
WHEREAS, outstanding county claims against this reimbursement provision
total in excess of $128,000 statewide; and
WHEREAS, the Wisconsin Counties Association (WCA) is ready to pursue the
payment of these claims from the Department of Justice to counties through the
courts; and
WHEREAS, if WCA is not successful in recouping some or all of this
reimbursement there will be no charge to St. Croix County for this effort.
NOW, THEREFORE, BE IT RESOLVED that St. Croix
pursue, on ,our behalf and as our a gent, reimb entooftouruoutstandingA to
$1 L under Section 814.25, Wisconsin Statutes; and g claim of
BE IT FURTHER RESOLVED that the corporation counsel and clerk of ci
court are hereby directed to assist WCA in this effort by rrt
information as may be necessary; and Y Providing support
BE IT FINALLY RESOLVED that if WCA is successful in securin all or some of
our reimbursement claim, 10% of the amount of reimbursement received will be paid
to WCA to help underwrite the costs associated with this legal action.
