(• WHEREAS,the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Development Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Development Committee has fulfilled its duties regarding the petition of SANDY BRINK (NEW DIMENSIONS, INC. AND TONY PIATZ (DATON, INC.), with the following legal description: TRACT NO. 1 A tract of land in the South Half the Northwest Quarter(S'NW3/4), Section Three (3), Township Twenty -Nine North (29), Range Eighteen (18) West, Fourth (4) Principal Meridian, St. Croix County, Wisconsin, more particularly described as follows: For the purpose of locating the point of beginning; commencing at the southwest corner of said South Half of the Northwest Quarter (SkNW;); thence easterly along the south line of said South Half of the Northwest Quarter (SkNWh) on an assumed bearing of S 85° 33' 30" E, 760.23 feet to the point of beginning of tract to be described; thence N 36° 08' 45" E, 461.29 feet; thence N 53° 51' 15" W, 566.00 feet; thence N 36° 08' 45" E, 345.00 feet; thence S 53° 51' 15" E, 921, 00 feet; thence S 36° 08' 45" W, 587.00 feet, more or less, to the south line of said South Half of the Northwest Quarter (ShNW3/4); thence westerly along said south line, on an assumed bearing of N 85° 33' 30" W, 417.26 feet, more or less, to the point of beginning. This tract of land contains 5.50 acres, more or less, and is also known as Tract No. A- 100 -2. TRACT NO. 4 A tract of land in the Northwest Quarter of the Southeast Quarter (NW3/4SE3), Section Four (4), Township Twenty -Nine (29) North, Range Eighteen (18) West, Fourth (4th) Principal Meridian, St. Croix County, Wisconsin, more particularly described as follows: Beginning on the east line of said Northwest Quarter of the Southeast Quarter (NASE3/4); 190.0 feet northerly of the southeast corner thereof; thence westerly along a line parallel to the south line of said Northwest Quarter of the Southeast Quarter (NW3/4SE3/4), on an assumed beazaing of N85° 12' 45" W, 435.0 feet; thence northerly along a line parallel to the east line of said Northwest Quarter of the Southeast Quarter (NW'SE3/4), 345.0 feet; thence easterly along a line parallel to the south line of said Northwest Quarter of the Southeast Quarter (NASE3/4), 435.0 feet to the east line thereof; thence southerly along said east line, 345.0 feet to the point of beginning. This tract of land contains 3.44 acres, more or less, and is also known as Tract No. A- 100 -3. TRACT NO. 5 The westerly 260.0 feet of the southerly 535.00 feet of the Northeast Quarter of the Southeast Quarter (NE3/4SE3/4), Section Four (4), Township Twenty -Nine (29) North, Range Eighteen (18) West, Fourth (4th) Principal Meridian, St. Croix County, Wisconsin. This tract contains 3.19 acres, more or less, and is also known as Tract No. A- 102 -2. TRACT NO. 6 A tract of land in the Northeast Quarter of the Northeast Quarter (NE3/4NE3/4) of Section Nine (9), Township Twenty -Nine (29) North, Range Eighteen (18) West, Fourth (4th) Principal Meridian, St. Croix County, Wisconsin, more particularly described as follows: Beginning on the north line of said Northeast Quarter of the Northeast Quarter (NE3/4NE3/4), 630.00 feet westerly of the northeast corner thereof; thence westerly along said north line of, on an assumed bearing of N 85° 20' W, 511.17 feet; thence S 5° 15' 30" W, 209.07 feet; thence S 85° 07' E, 511.00 feet; thence N 5° 18' E, 211.00 feet, more or less, to the point of beginning. This tract of land contains 2.46 acres, more or less, and is also known as Tract No. A -101. The property herein conveyed contains 40.03 acres, more or less, and was formerly known as Nike Battery 20, D -Wisc -500, under the administrative jurisdiction of the Department of the Army, an agency of the United States Government. Residential to Commercial for Sandy Brink and Tony Piatz. According to the St. Croix County Zoning Code, Section 17.72 (f) c: Such Ordinance shall be effective 40 days after adoption unless the town board of such town files with the County Clerk a certified copy of a resolution disapproving of the ordinance. If such town board approves the ordinance, the ordinance shall be effective upon the receipt of the approving town board resolution by the County Clerk.
