RESOLUTION AUTHORIZING SOLID WASTE COMMITTEE TO ACT IN REGARD TO
CONTRACTS WITH AMERICAN RESOURCE RECOVERY.

WHEREAS, on October 9, 1986, St. Croix County entered into a
Design and Construction Agreement and a 20 year Service Agreement
with American Resource Recovery for processing the County's solid
waste through incineration; and
WHEREAS, during the November, 1986 session of the County
Board, the Solid Waste Committee was reduced to five members from
twelve members; and
WHEREAS, the reduction in the number of members of the Solid
Waste Committee was meant to increase its efficiency in regard to
the agreements with American Resource Recovery, including the
implementation of the service agreement, supervision of the de-
sign and construction of the incinerator and exercise of the
other rights and performance of the other obligations of the
said agreements; and
WHEREAS, American Resource Recovery intends to proceed
expeditiously in the construction of the incinerator, thereby
necessitating prompt decision- making on the part of the county
regarding its rights and obligations; and
WHEREAS, it is in the best interest of St. Croix County to
delegate any. necessary authority to the Solid Waste Committee to
exercise County rights and perform County obligations under the
said agreements;
NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board
of Supervisors, meeting in regular session, that the Solid Waste
Committee is hereby authorized to act on behalf of St. Croix
County in any and all matters relating to the exercise of County
rights or the performance of County obligations under the Design
and Construction Agreement and the 20 year Service Agreement with
American Resource Recovery; and
BE IT FURTHER RESOLVED that the Solid Waste Committee is also
authorized to act in other matters relating to the said
agreements, including, but not limited to:
1) applying for a loan from the State Trust
Fund in an amount not to exceed $250,000 to
cover costs incurred in exercising County
rights and performing County obligations under
w
the agreements;
2) making decisions regarding any landfill
matters relating to the agreements with
American Resource Recovery;
3) hiring, if necessary, any consulting
services, including engineering and legal;
4) siting, upgrading, and /or constructing
necessary access roads to the incinerator;
