HomeMy WebLinkAboutResolution 1985 (03) - _ y RESOLUTION N0. 3 3? ) Whereas, the statutory language for the Elder Abuse Law (Wisconsin Statutes Chapter 46, s. 46.90 created by 1983 Wisconsin Act 398) requires the designation of a county agency. Whereas, the St. Croix County Human Services Coordinating Committee meeting on December 21st moved that the Department of Social Services be established as lead agency. Whereas, a second motion created an Elder Abuse Task Force comprised of the following Agencies and Persons: Mental Health Center - Barbra Manthey Office on Aging - Sandy Kittel Law Enforcement - LuVerne Burke Public Health - Joanne Richie Department of Social Services - John Berndt Whereas, ss. 46.90(2) county agency designation: Each county board shall designate an agency in the county as the agency for the purposes of this section. Whereas, for the purposes of these guidelines, the designated county agency will be hereafter referred to as the lead agency. Whereas, the lead agency is responsible for: (ss.46.90(3)) 1. Establishing an Elder Abuse Reporting System to carry out the purposes and intent of the Elder Abuse Law. 2. Receiving reports of abuse, material abuse, neglect or self - neglect of elder persons. 3. Entering into a memorandum of understanding, regarding the operation of the reporting system, with the county department of public welfare or social services, county aging unit, and with any private or public agency, including a board created under s. 51.42 or 51.437, within the county that is participating in the elder abuse reporting system. 4. Developing a policy for notifying law enforcement officials in appropriate cases. 5. Publicizing the existence of an elder abuse reporting system in the county and; 6. Providing a publicized telephone number which can be used by persons wishing to report suspected cases of abuse, material abuse, neglect or self - neglect. Whereas, various parts of the law identify other specific areas of leadership and responsibility such as the provision of investigations and the provision of services. Whereas, 1.) The lead agency shall either investigate the report or refer the report to another agency for investigation. (ss. 46.90(5)(a)). Whereas, 2.) The lead agency or the investigating agency shall determine if the elder person or any other person involved in the alleged abuse, material abuse, neglect or self - neglect is in need of services under this chapter or CH. 47, 49, 51 of 55. (ss. 46.90(6)(a)). Whereas, 3.) The lead agency shall provide the necessary services or arrange for the provision of the services with other agencies or individuals. Those services shall be rendered under the least restrictive conditions necessary to achieve their objectives. This is to be done within the limits of available state and federal funds and of county funds appropriated to match the state and federal funds. (ss. 46.90(5)(e)). Whereas, 4.) The lead agency shall receive copies of investigation reports for instances in which a conclusion is reached that neglect or abuse occurred. Either the county agency or other investigating agency can prepare these reports. (ss. 46.90 (6)(a)). Whereas, time is of the essence the deadline for submission of the County Description is February 1, 1985. NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors, meeting in regular Session, that the St. Croix County Department of Social Services be designated as the Lead Agency to comply with the Guidelines for the Elderly Abuse Reporting System.
