REQUIRING LIEN CLAIMANTS TO PROVIDE LIEN WAIVERS FROM ALL
SUPPLIERS' OF MATERIALS PURCHASED OR ORDERED BY THE LIEN CLAIMANT
FOR INSTALLATION ON A PREMISES, AND TO PROVIDE A PENALTY
THEREFORE.

WHEREAS, Chapter 779 Liens allows for foreclosure and sale
of property on which certain construction or improvements have
been made for which a contractor supplier has not received
payment from the contractor; and
WHEREAS, the property owner may have paid the contractor for
labor and materials used; and
WHEREAS, the contractor has failed to pay his supplier for
labor and materials used; and
WHEREAS, under present law, the owner is liable to the
supplier for unpaid bills for materials utilized by the
contractor; and
WHEREAS, the property owner has no way of determining the
financial responsibility or reliability of the contractor,
NOW THEREFORE, BE IT RESOLVED by the St. Croix County Board
of Supervisors, meeting in regular session, that a recommendation
be made to area assemblymen and senators to consider
modifications to Chapter 779 to place a defaulting contractor
under criminal liability for failure to satisfy financial
obligations to suppliers, after having provided the owner with a
Section 779.05 waiver without satisfying financial obligations to
the supplier.
