CROIX COUNTY LAND USE REGULATIONS ORDINANCE NO. 3 6 / St. Croix County, Wisconsin WHEREAS, the St. Croix County Planning and Development Committee has duly noticed and conducted a public hearing or public hearings on proposed amendments to the St. Croix County land use regulations; and WHEREAS, the St. Croix County Planning and Development Committee recommends adoption of the amendments set forth below; THEREFORE, the St. Croix County Board of Supervisors does ordain as follows: 1. Amend sec. 17.15(1)(d) to read: (d) One single family residence. 2. Create sec. 17.145 AGRICULTURAL DISTRICT TWO as shown on Exhibit A. 3. Make the additional amendments to the zoning districts as shown on Exhibit B. 4. Amend sec. 18.16(F) to read as shown on Exhibit C 5. Amend the Nonmetallic Mining & Reclamation Ordinance [Ordinance #226(89)] as shown on Exhibit D. Adopted this jq day of Y l'YTh , 1992. Nelson, St. Croix Comb Cldt EXHIBIT A 17.145 AGRICULTURAL DISTRICT TWO. The Agricultural District Two (A -2) is created to establish and provide for areas of interim or small -scale agricultural uses and rural low- density housing with lots large enough for significant agricultural activity. It is intended to apply to continuous areas that are planned for urban or rural development or to scattered sites within agricultural areas that are not suitable for commercial agricultural production due to parcel size, soil productivity, topography or other limiting physical conditions and would not conflict with surrounding commercial agricultural uses. (1) PERMITTED USES. (a) Any use permitted in the Agricultural District; (b) One single- family residence. (2) MINIMUM LOT AREA. 20 acres (3) HEIGHT. The provisions of ss. 17.13(4) shall apply to buildings sized for human habitation. (4) SIDE YARD. The provisions of ss. 17.13(4) shall apply. (5) REAR YARD. The provisions of ss. 17.13(4) shall apply. (6) SPECIAL EXCEPTIONS. The following uses may be allowed within the Agricultural District Two (A -2) as a special exception upon approval of the Board of Adjustment as provided in subchapter VII. (a) One two - family dwelling), (Duplex), (b) Contractor's storage yard. Any such yard shall be so placed or screened by planting as not to be visible from any public highway or any residential building other than that of the owner of such yard, his agent or employee. (c) Pea viners, sawmills or charcoal kilns, which shall not be located less than 700' from any lot line shared with property upon which a dwelling may be located. (d) Kennels, which shall not be located less than 700' from any lot line shared with property upon which a dwelling may be located. (e) Quarrying or gravel pits, subject to the provisions of the nonmetallic mining ordinance. (f) Slaughterhouses, which shall not be located less than 700' from any lot line shared with property upon which a dwelling may be located. (g) Junkyard, salvage operation or storage of junk. 1 (h) Licensed game management or fur farms as set for in Ch. . Wis. Stats. (i) Dams, power plants, flowage areas, telephone, telegra ph, cabl television and power transmission towers, poles and lines, including transformers, substations, relay stations, equipment housing and other similar necessary appurtenant facilities, radio relay towers, provided that such facilities are found to be necessary and to be located as to avoid unreasonable interference with other uses permitted or existing in the district. (j) Limited commercial recreational activities which are found to be subordinate to the primary agricultural use of the property, compatible with the agricultural use on that and surrounding properties and not likely to attract other related commercial uses. (k) Hot mix plants engaged in public highway related projects provided that such operations be of a temporary nature not exceeding 120 days of operation. (1) Livestock operations in excess of one animal unit per acre of land suitable for animal waste disposal, consistent with the provisions of Ch. NR 243, Wis. Adm. Code. (m) Airstrips, private or personal, subject to procedures and standards established under ss. 17.14(6)(g). (n) Bed and breakfast establishment, in compliance with ss. 50.50, Wisconsin Statutes. (o) Golf course and uses incidental to a golf course, including the limited service of food and beverages. (p) Home occupation, pursuant to sec. 17.155. (q) Any construction or land disturbance activities on slopes of 20% or more with the horizontal interval of measurement being 25 feet when calculating slope. Except conservation practices identified in a currently approved soil and water conservation plan. 2 EXHIBIT B 1. d the Additional Revisions To o f Zoning Districts Ad following definition "an unit" to Section 7.09, Definitions: ANIMAL UNIT. One animal unit shall be defined as the equivalent of any of the following: one (1) cow, steer or bull; One (1) horse or pony; Two (2) calves; Two (2) swine; Four(4) llamas; Ten (10) sheep; Ten (10) goats; 50 turkeys; 75 ducks; 100 chickens; or 100 rabbits. 2. Make the following revisions to the Agricultural District: a. Replace the feedlot provisions of s.17.14(6)(k) with the following: (h) Livestock operations in excess of one animal unit per acre of land suitable for animal waste disposal, consistent with the provisions of Ch. NR 243, Wis. Adm. Code. b. Add the slaughterhouse language from s.17.145(6)(f) as s.17.14(6)(j). c. Add the pea viner language from s.17.145(6)(c) as s.17.14(6)(k). d. Add the construction or land disturbance language from s.17.145(6)q as s.17.14(6)(.). 3. Make the following revisions to the Agricultural- Residential District: a. Delete s. 17.15(1)(c) regarding the requirement of 35 acres to keep farm animals. b. Revise s. 17.15(1)(c) to read: (c) Raising or maintaining farm animals on parcels of 2 1/2 acres or more when: (1) One animal unit is permitted on parcels of 2 1/2 to less than 5 acres in size. 3 (2) One animal unit per acre is permitted on 5 or more acres. C. Revise s. 17.15(6)(g) to read: (g) Quarrying or gravel pits, subject to the provisions of the nonmetallic mining ordinance. d. Replace language of s.17.15(6)(h) regarding slaughterhouses with language s.17.145(6)(f). e. Add "cable television" to s.17.15(6)(1). f. Revise 17.15(6)(n) to change "County related" to "public highway - related ". g. Add the construction or land disturbance language from s. 17.145(6)q as s. 17.13(6)(d). 4 • EXHIBIT C SUBDIVISIONS 18.16(F) Drainageway easement Where a subdivision is traversed by a water course, drainageway, channel or stream, a drainageway easement may be required. In most instances, the property covered by a drainageway easement shall be privately owned as a part of a lot(s). The location, width, alignment and grading of such easements shall be designed to accommodate the anticipated discharge from the property being subdivided and also the anticipated run off that will occur from property at a higher elevation in the drainage basin when it is developed. The Committee may approve ownership and control of easement rights and obligations within a drainageway.
