REZONING LAND FROM
AGRICULTURE TO AG.- RESIDENTIAL
ORDINANCE NO. 366, (c a )
WHEREAS,the Statutes of the State of Wisconsin provide for a
Planning and Development Committee to act in all matters pertaining
to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the
St. Croix County Planning and Development Committee; and
WHEREAS, at the request of the County Board this committee
is to review petitions, hold public hearings, and present its
recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the'St. Croix County Planning and Development
Committee has fulfilled its duties regarding the petition of
RICHARD AND ROBERT DERRICK; with the following description:
That certain parcel of land located in the Northwest 1/4 of
the Southwest 1/4 of Section 17, T31N -R17W, Town of Stanton, St.
Croix County, Wisconsin, more fully described a follows;
Commencing at the Northwest corner of the Northwest 1/4 of the
SW 1/4 thence East six - hundred seventy -five (675) feet; thence
South two - hundred twenty -five (225) feet; thence Southwest at
43 ° 56' for approx. nine - hundred twenty (920) feet to center of
150th street; thence North for six - hundred twenty -five (625) feet
to the point of beginning. Parcel contain approx. eight (8)

THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of
Supervisors, meeting in regular session, that the above parcel is
rezoned from Agriculture to Ag.- Residential.

We, Richard Derrick and Robert Derrick, under oath, swear and state as follows:
1 That in 1992, we petitioned the St. Croix County Board for
rezonement of a parcel land we owned in Stanton Township, St.
Croix County, Wisconsin, from Agricultural to Agricultural -
Residential, which Petition was approved by said Board;
2. That the legal description of said parcel of land as set forth in
Ordinance No. 306(92), dated August 18, 1992, was as follows:
That certain parcel of land located in the NW1 /4 of SW1 /4 of
Section 17 - T31N -R17W, Town of Stanton, St. Croix County,
Wisconsin, more fully described as follows: Commencing at the
Northwest corner of the NW1 /4 of SW1 /4, thence East 675 feet;
thence South 225 feet; thence Southwest 43 °56' for approximately
920 feet to center of 150th Street; thence North 625 feet to the
Point of Beginning;
3. That said legal description set forth in Ordinance No. 306(92) was
not correct and was actually an approximation of the actual legal
description intended;
4. That the actual -legal description of the parcel of land subject to
rezonement in Ordinance No. 306(92) is as follows:
Part of the NW 1 /4 of SW 1 /4 of Section 17 -T31 N -R17W, Town of
Stanton, St. Croix County. Wisconsin, described as follows:
Lot 1 of Certified Survey Map filed in Volume 9, Page 2625;
AND
Commencing at the W1/4 corner of said Section 17; thence
S00 ° 26'00 "E, along the West line of the SW1 /4 of said Section,
225.00 feet to the Point of Beginning; thence continuing
S00 ° 26'00 "E, along said west line, 400 feet; thence N59 ° 18'44"E,
781.40 feet; thence N89 53'56 "W, 675 feet to the Point of
Beginning;

5. That it was our intention to rezone the property described in No.
4 of this Affidavit by Ordinance No. 306(92) and we were
unaware that the legal description used in the Petition for said
Ordinance was incorrect and not accurate;
6. That we make this Affidavit for purposes of clarification and to
correct the legal description used in Ordinance No. 306(92).
