CRO _ 1 V T Land Use Planning & Land Information Resource Management Community Development Department August 23, 2013 File #LU88009 Larry & Anne Weber 3620 Highland Ave. White Bear Lake, MN 55110 Re: Construction of a conforming accessory & principal structure with filling & grading <10,000 sq. ft. in the Lower St. Croix Riverway District Parcel #22.30.20.440H, Lot 9 of CSM V. 9/P. 2556, Town of St. Joseph Address: 1401 Hilltop Ridge Dear Mr. & Mrs. Weberl: This letter confirms zoning approval based on site and construction plans submitted with application materials on August 16, 2013 for the following activities that require a land use permit: To build a conforming accessory structure and principal structure in the Lower St. Croix Riverway District pursuant to Section 17.36 F.2.a.1 and F.2.a.2 of the St. Croix County Zoning Ordinance. As part of the overall project, filling and grading of <10,000 sq. ft. will be necessary to establish a driveway, excavate for the proposed structures, and install a Private On-site Wastewater Treatment System (POWTS). A driveway and the 32'x 60' accessory structure will be the first phase of construction, with the principal dwelling to be built in 2014. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property located at 1401 Hilltop Ridge is a non-riparian lot containing 3.04 acres, is zoned Ag/Residential, and is in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The lot is more than 200 feet from OHWM of the St. Croix River, and greater than 100 feet from the bluffline, which will allow construction of conforming structures that will not be visible from the river. Construction of conforming principal and accessory structures is allowed with a land use permit if the standards contained in Section 17.36.H are met; 3. The proposed building construction and POWTS will result in 9200 sq. ft. of land disturbance that will not affect slope preservation zones or encroach into a bluffline setback. With conditions for erosion control during construction and permanent stabilization with native, non-invasive vegetation afterward, this project will meet requirements in 17.36.G.5; 4. On February 15, 2011, a memo from Planning & Zoning Director Dave Fodroczi to the towns of Hudson, St. Joseph, Somerset, and Troy provided notification of the intent to authorize replacement of existing POWTS in the Riverway District using both a sanitary permit and a land use permit issued by state-certified county code administration staff. The proposed 32'x 60' accessory building will not exceed the maximum height of 20 feet in compliance with Section 17.12.(5) as calculated using construction drawings submitted. With conditions that windows and building materials on the structure utilize earth-tone colors and non-reflective surfaces, this project will meet standards in Sections17.36 G.5.c.2)a) and 17.36 H.1 with regard to being visually inconspicuous; 6. Stormwater runoff will be directed into rock drainage areas around the perimeter of the house and garage, then to grassed and vegetated areas that do not drain toward the river; 7. The Wisconsin Department of Natural Resources has reviewed the application and plans submitted and did not have any additional requirements to be included in conditions; 8. The Town of St. Joseph building inspector will review the submitted plans and land use permit prior to issuance of a building permit; 9. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This approval is for the alteration of a nonconforming principal structure, as indicated in the plans submitted, and as provided in the conditions below: 1. The applicants shall notify the Zoning Administrator prior to commencing construction and again when the construction has been completed. 2. Prior to commencing construction, the applicants and/or their general contractor shall obtain any other permits required, including but not limited to a building permit from the Town of St. Joseph. 3. Erosion control measures must be implemented prior to and during excavation and, upon completion of building construction and POWTS installation, seed and mulch cover must be applied to stabilize all exposed soils in compliance with requirements in Section 17.36.H.5a. 3 and 4. 4. The finished accessory and principal structures shall not exceed the allowable roof height per Sections 17.12(5) and 17.13(3) respectively and must meet the 25' setback from any lot line. 5. All siding, shingles, trim, and other appurtenances of the structure, including the roof, shall be earth tone in color and of a non-reflective nature (except for windows) so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a) and 17.36 H.1 of the Ordinance. 6. Within 30 days of substantially completing the proposed buildings, the applicant shall submit to the Zoning Administrator certification from the project engineer or architect that the construction was done in compliance with the approved plans. An e-mail from the building contactor with photo attachments of the completed construction as viewed from all angles will be sufficient. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 8. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This approval does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request. Any remaining site work above and beyond what is identified as part of this land use permit application shall be subject to the review and approval of the Zoning Administrator. Your information will remain on file in the St. Croix County Community Development Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but not limited to obtaining a town building permit, County sanitary permit, and any permits that may be required by the Wisconsin Department of Natural Resources. REVIEW: The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete application and supporting documents, the Zoning Administrator will: • send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to contact their town to discuss their application and inquire about necessary building permits and approvals at the town level; • schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project comers and label the flags accordingly; and • review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval, the permit will be mailed to the applicant or to the applicant's agent. If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be required to apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the application become the property of the Community Development Department and will remain in the file. For projects that involve land disturbance requests, the following additional information may be required: Detailed drawings (scale should not be greater than 1 inch to 200 feet). Grading plan showing grading limits and pre and post contours. ❑ Project schedule and contractor list. Erosion control plan (Best Management Practices). Storm water management plan stamped by an engineer and including all runoff calculations. Vegetation plan including schedule, seeding rates, and species size, type and location. ❑ Other documents: NOTE: All maps, plans, and engineering data shall be no larger than 11x17. Lot is heavily wooded. Proposed grading will be minimized to preserve the trees on the lot. Soil is sandy black topsoil. Stormwater Management: All runoff from the garage and the southern half of the house will be directed towards the back of the lot. This runoff will flow across the grass yard area and then across 200 feet of vegetated wooded area, which has an average 3% grade. The runoff from the northern half of the house will flow across grass yard area and approximately 100 feet of vegetated wooded area. This flow goes into a low area on the north lot line and drains east toward the back of the lot. No runoff from the garage or house reaches or crosses the road into the river bluff area. Lot is at the outer limit of the Lower St. Croix Riverway District. Current and proposed drainage from the lot flows away from the Lower St. Croix Riverway District. Landscaping rock will be placed around the perimeter of the garage and house area. Erosion and Sediment Control: Silt fence is in place downstream of proposed disturbed area for the garage. Area disturbed for garage will be seeded this fall. Silt fence will be placed downstream of disturbed area for house next spring.
