ORDINANCE PROHIBITING HABITUAL TRUANCY

Pursuant to the authority conferred by Wis.Stats. 59.07(105)
the County Board of Supervisors of St. Croix County, Wisconsin,
' does ordain as follows:
SECTION 1. PROHIBITION OF HABITUAL TRUANCY. A child is
prohibited from being a habitual truant.
SECTION 2. DEFINITIONS. For purposes of this Section:
(a) "Habitual truant" shall mean a pupil
who is absent from school without an
acceptable excuse for either of the
following: •
1. Part or all of 5 or more days out
of 10 consecutive days on which school is
held during a semester.
2. Part or all of 10 more days on
which school is heltrr during a school
semester.
(b) "Acceptable excuse" shall mean an
. accceptable excuse as defined in Sections
118.15 and 118.16(4), Wisconsin Statutes.
SECTION 3. PENALTY. Upon finding that a child is a habitual
truant, the Court or Commissioner shall enter an order making
one or more of the following dispositions:
(a) Suspend the child's operating
privilege, as defined in Section 340.01
(40), Wisconsin Statutes, for not less
than 30 days nor more than 90 days. The
judge shall immediately take possession
of the suspended license and forward it
to the Department of Transportation of
the State of Wisconsin, together with a
notice stating the reason for and duration of
the suspension.
(b) Order the child to participate in
counseling, community service or a
supervised work program under Section
48.34(9), Wisconsin Statutes.
(c) Order the child to remain at home
except during the hours in which the
child is attending religious worship or a
school program, including travel time
required to get to and from the school
program or place of worship. The order
may permit a child to leave his or her
home if the child -is-Rr accompanied by a
parent or guardian.
(d) Order the child to attend an •
educational program under Section 48.34(12),
Wisconsin Statutes.
SECTION 4. JURISDICTION. Jurisdiction as to proceedings alleging
a violation of this Ordinance shall be in the Circuit Courts of
St. Croix County, unless the Judges of Circuit Court delegate
the authority to hear and adjudicate such matters to the Juvenile

SECTION 5. OTHER OFFENSES. Nothi herein shall be construed to
deprive the Courts of jurisdiction to hear actions arising under
Stat. 947.16 or any municipal or county ordinance adopted in
conformity with those Statutes or with 1987 Act 285.
SECTION 6. AMENDMENTS. Any future amendments, revisions or
modifications to Sections of Wisconsin Statutes referred to
herein are intended to be made part of this Ordinance as such
amendments, revisions or modifications are made to those
Statutes.

This Ordinance shall take effect and be in force from and
after its proper passage and publication pursuant to Wisconsin
Law.
