Ail service events or inspections of this POWTS shall be reported to the county within 10 business days. 6. The owner may not remove any of the wastes from the holding tank(s), or cause such wastes to be removed by any person no# authorized to do so under Ch. 281, Wis. Statutes. The discharge of wastes from this holding tank to the ground surtace, including intentions[ discharges and discharges caused by neglect, constitutes a failing POWTS and may result in issuance of correction orders or a citation by the county or state. 7. No one should enter a holding tank for amp *eeson without being in full compliance with OSHA standards for entering a confined space. "fne atmosphere within these tanks may contain lethal gases, and rescue of a person from the interior of the tank may be difficult or impossible. 8. In the event that this POWTS fails and cannot be repaired, a code compliant replacement holding tank may be installed in the same loca#ion (a new sanitary permit is required #or such a replacement). The owner further agrees to pay the pumper for all charges incurred in servicing the holding tank(s) as mutually agreed upon by the owner and pumper. 3. The pumper agrees to submit to the local governmental unit that has signed the pumping agreement and to the County, a report for the servicing of the holding tank(s) on a semiannual basis. The pumper further agrees to include the following in the semiannual report: a. The name and address of the person responsible for servicing the holding tank; b. The name of the owner of the holding tank; c. The location of the property on which the holding tank is installed; d. The sanitary permit number issued for the holding tank; e. The dates on which the holding tank was serviced; f. The volume in gallons of the contents pumped from the holding tank for each servicing; g. The disposal sites to which the contents from the holding tank were delivered. 4. .This agreement will remain in effect until the owner or pumper terminates this contract. The area in question is very small and leaves no room to use heavy equipment from up slope, or at the end slopes areas, to avoid compaction of the down slope toe area. Soil compaction immediately (within 15 feet) down slope of the mound may be detrimental to lateral flow of treated wastewater away from the mound system. By the plumber's evaluation it seems impossible to construct the mound without trafficking the down-slope area and he is correct in this determination. The soils at this site appear suitable for an A+0 mound if an interpretative determination is completed and approved to certify both the site and soils as suitable. Any mound design would have a 30 inch sand lift using septic tank effluent (STE) or 18 inches using highly treated effluent (HTE). It appears that a total mound length must be less than 60 feet. Access to the mound site to place sand fill and other materials is generally from the up slope or side slope areas and the 15 foot down slope area is a no traffic area during construction. This presents a problem, but not one that would completely negate the use of a mound. The soil report by Steel indicates that the house has three bedrooms or a design flow of 450 gpd. However, a design for a system with an occupancy of four (300 gpd) would better fit this site and a possible option. Overall mound dimensions for STE (300 and 450 gpd) and HTE (300 and 450 gpd) mounds follow: 450 gpd (STE) 59.95 ft along the contour and 82.72 ft wide. 68.0 inches high at the centerline. 450 .gpd (HTE) 59.10 ft along the contour and 75.43 ft wide. 55.2 inches high at the centerline. 300 gpd (STE) 59.56 ft along the contour and 55.77 ft wide. 60.5 inches high at the centerline. 300 gpd (HTE) 57.22 ft along the contour and 52.62 ft wide. 47.8 inches high at the centerline. Mound dimensions and the amount of sand fill would be much less if HTE were used and the distribution cells were stepped down the hillside and the flow to each cell adjusted to maintain equal distribution. The use of highly treated effluent will add substantial cost to the installation but will allow the most flexible design and increase system longevity. Maintenance and energy costs for the secondary treatment unit should also be considered when planning a design using highly treated effluent. This site has very restricted access for heavy equipment to build the mound without traveling over part of the 15 foot area down slope of the mound. toe. In addition, the length of the site along the land surface Page 2 of 2 Banyai Report July 12, 2006 contour is limited to no more than 60 feet. This forces the mound design to multiple cells and increases the amount and cost of the sand fill. It is my opinion that it is possible to design and construct a mound system at this site with an appropriate design and equipment for the limitations present. Department review staff indicate that an individual site design could address the access issue by staying on the far south end of the mound provided the design incorporates a method to remediate soil compaction in travel/access areas. If the owner could get permission to travel on his neighbor's property to the south that would eliminate the concern of down slope toe compaction. Removal of the old .shed, which is highly recommended, would also serve to provide access to the mound site from the north end of the mound site and allow the mound to be installed without traveling across the down slope toe area. None of these. alternatives will be inexpensive as compared to the initial cost of a holding tank system. However, holding tank pumping costs can be high and in a few years may overshadow the cost of a mound. system. In addition, the owner needs to be aware that if this home will be a rental property that the maintenance of the system is still 100 percent the responsibility of the owner. Enforcement actions and penalties for mismanagement of a holding tank (or any other system) would be issued against the owner. The interpretation and enforcement of the county sanitary ordinance is a county concern. It appears possible that. the current design and installation rules in Comm 83, Wis. Adm. Code and associated component design manuals would allow a mound to be designed and installed at this site but at great expense and difficulty of installation. Neither state or county rules address the expense and difficulty involved in system design, construction, and maintenance. The owner could seek a variance to the county limitation on holding tank use when an option exists to install a mound or other type of system. Denial of a sanitary permit application for a holding tank could lead the owner to appeal that decision pursuant to Comm 83.21(3)(d)2., Wis: Adm. Code, and applicable county rules. The area in question is very small and leaves no room to use heavy equipment from up slope, or at the end slopes areas, to avoid compaction of the. down slope toe area. Soil compaction immediately (within 15 feet) down slope of the mound may be detrimental to lateral flow of treated wastewater away from the mound system. By the plumber's evaluation it seems impossible to construct the mound without trafficking the down slope area and he is correct in this determination. The soils at this site appear suitable for an A+0 mound if an interpretative determination is completed and approved fo certify both the site and soils as suitable. Any mound design would have a 30 inch sand lift using septic tank effluent (STE) or 18 inches using highly treated effluent (HTE). It appears that a total mound length must be less than 60 feet. Access to the mound site to place sand fill and other materials is generally from the up slope or side slope areas and the 15 foot down slope area is a no traffic area during construction. This presents a problem, but not one that would completely negate the use of a mound. The soil report by Steel indicates that the house has three bedrooms or a design flow of 450 gpd. However, a design for a system with an occupancy of four (300 gpd) would better fit this site and a possible option. Overall mound dimensions for STE (300 and 450 gpd) and HTE (300 and 450 gpd) mounds follow: 450 gpd (STE) 59.95 ft along the contour and 82.72 ft wide. 68.0 inches high at the centerline. 450 gpd (HTE) 59.10 ft along the contour and 75.43 ft wide. 55.2 inches high at the centerline. 300 gpd .(STE) 59.56 ft along the contour and 55.77 ft wide. 60.5 inches high at the centerline. 300 gpd (HTE) 57.22 ft along the contour and 52.62 ft wide. 47.8 inches high at the centerline. Mound dimensions and the amount of sand fill would be much less if HTE were used and the distribution cells were stepped down the hillside and the flow to each cell adjusted to maintain equal distribution. The use of highly treated effluent will add substantial cost to the installation but will allow the most flexible design and increase system longevity. Maintenance and energy costs for the secondary treatment unit should also be considered when planning a design using highly treated effluent. This site has very restricted access for heavy equipment to build the mound without traveling over part of the 15 foot area down slope of the mound. toe. The owner, agrees to contract with a person who is licensed under Ch. NR 113, Wls. Adm. Code, to have the holding tank serviced and to file a copy of the contract with the governmental unit. The owner further agrees to file a copy of any changes to the service contract, or a copy of a new seMce contract, with the governmental unit within ten (10) business days from the date of change to the service contract. 5. The owner agrees to contract with a person licensed under Ch. NR 113, Wis. Adm. Code, who shall submit to the county on a semiannual basis a report detailing the servicing of the holding tank. The governmental unit or county may enter upon the property to investigate the condition of the holding tank when pumping reports and meter readings may indicate that the holding tank is not being properly maintained. 8. This agreement will remain in effect only until the county office responsible for the regulation of private onsite wastewater treatment systems certifies that the property is.served by either a municipal sewer or a private onsite wastewater treatment system that complies with Ch. Comm 83, Wis. Adm. Code. in addition, this agreement may be cancelled by executing and recoMing said certification with reference to this agreement in such manner which will permit the existence of the certification to be determined by reference to the property. 7.
