Dear Mr. & Mrs. Schmidt:
This letter confirms zoning approval according to plans prepared by your agent, Roger Harter of
Valley Pools, submitted on August 20, 2013 for the following activities that require a land use
permit:
To build an in-ground pool with patio and retaining walls (accessory structures) in a conforming
location in the Lower St. Croix Riverway District pursuant to Section 17.36 F.2.a.9 of the St.
Croix County Zoning Ordinance.
Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the
Lower St. Croix Riverway District based on the following findings:
1. The property located at 188 Starr Wood is a non-riparian lot, is zoned Ag/Residential,
and is in the Rural Residential Management Zone of the Lower St. Croix Riverway
District;
1. The existing principal structure is conforming in that it is located more than 200 feet from
OHWM of the St. Croix River, is not visible from the river, is >25' to any lot line, and is
more than 40 feet from the nearest bluffline. Per definitions in both NR 118 and county
ordinance Section 17.09.23."a bluffline is a line along the top of the slope preservation
zone. There can be more than one bluffline." Slope preservation zone, as defined in NR
118.03(41) and county ordinance Section 17.09.212 is "The area riverward from the
bluffline where the slope towards the river is 12% or more, as measured horizontally for
a distance of not more than 50 feet or less than 25 feet." Riverward is not defined in the
ordinance, however a dictionary definition is "toward or facing a river' and toward is
defined as "in the direction or vicinity of'. Steep slopes that do not face or are not
"toward the river' are not slope preservation zones and therefore the top of those slopes
are not blufflines. The rear of the Schmidt's house is near a ravine with >12% slopes that
do not face in the direction of the St. Croix River and are not by definition slope
preservation zones, thus there are no bluffline setback requirements for the proposed
pool installation;
2. Accessory structures are allowed with a land use permit pursuant to Section
17.36.F.2.a.1 and 17.36.F.2.a.9 of the Ordinance;

3. The proposed pool and patio will require filling and grading on slopes <12% and will add
approximately 800 sq. ft. of impervious coverage to the site. The stormwater runoff from
the patio will be directed into landscape planting beds, which will provide adequate
infiltration of runoff into the soil;
4. Mike Wenholz of the Wisconsin Department of Natural Resources reviewed the
application materials sent via e-mail attachment on August 23, 2013. No comments were
received as of 9/6/13.
5. If constructed as proposed, this project will meet the spirit and intent of the Lower St.
Croix Riverway District. It will not degrade the scenic, recreational, or natural values of
the St. Croix River Valley, nor will it negatively affect the water resource or public health,
safety and welfare of County residents.
This approval is for the reconstruction of an enclosed porch attached to a conforming principal
structure, as indicated in the plans submitted, and as provided in the conditions below:
1. Prior to commencing construction, the applicants must obtain any other local or state
permits or approvals.
2. The finished accessory structure (pool and patio) shall not exceed the dimensions
shown on approved plans. Planting beds surrounding the pool and patio will use native,
non-invasive plant species and provide infiltration of runoff as a method of stormwater
control.
3. The applicants shall notify the Zoning Administrator when the construction of the pool
and retaining walls has been completed and provide photos of the completed
construction and landscaping as viewed from all angles.
4. Within 30 days of substantially completing the proposed pool, the applicant shall submit
to the Zoning Administrator certification from the contractor/agent that the construction
has been done in compliance with the approved plans.
5. All activities approved as part of this land use permit shall commence within one year
from the date of approval and be substantially completed within two years, after which
time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to
expiration, the applicant may request extensions of up to six months from the Zoning
Administrator. The total time granted for extensions shall not exceed one year.
6. Failure to comply with the conditions above may result in the revocation of this permit
pursuant to Section 17.36 J.8.b of the Ordinance.
This approval does not allow for any additional construction, grading, filling, or clearing
of vegetation beyond the limits of this request. Any remaining site work above and
beyond what is identified as part of this land use permit application shall be subject to
the review and approval of the Zoning Administrator.
Your information will remain on file in the St. Croix County Planning and Zoning Department. It
is your responsibility to ensure compliance with any other local, state, or federal rules or
regulations, including but not limited to obtaining a town building permit, County sanitary permit,
and any permits that may be required by the Wisconsin Department of Natural Resources.

The owners would like to have a small swimming pool installed in their back yard; however
their property lies in the St. Croix Riverway District so there are set back issues. Because of the
placement of the house, the septic and the well there is only one location that will
accommodate even a small, 14'x 28' swimming pool. To fit the pool in and keep retaining wall
construction and site disturbance to a minimum the only placement of the pool puts it near the
crest of the hill and closer than the setbacks. The owners are requesting a Land Use Permit to
construct a 14'x 28' vinyl lined swimming pool as shown in the attached drawings.
Because of the design of the pool there will not be any draining or'backwashing' necessary
and the majority of the runoff water from the concrete deck will be drained away from the hill.
The pool would have a cartridge filter, to eliminate backwashing. It would also have an auto
cover that will capture rain water that will be drained toward the front yard, so the pool won't
overfill from rain water and need draining. Because of the design of the cover it also works as
the winter cover. No draining of the pool is required for winterization. The proposed concrete
deck area around the pool totals approximately 730 square feet, of this, approximately 590
square feet will be pitched toward a drain tile and be directed to the front yard so there will be
very little runoff around the pool that is not contained.
The owners were issued a building permit for this project by the Town of Hudson.
There will not be a private water or sanitary system included in this proposed construction.
