AMENDMENTS TO ST. CROIX COUNTY CODE OF ORDINANCES
LAND USE AND DEVELOPMENT CHAPTER 17 ZONING
_ SECTION 17.72 REZONING AMENDMENTS - GJOVIK, TOWN OF
CYLON
1 The St. Croix County Board of Supervisors does ordain as follows:

3 WHEREAS, Timothy and Vicki Gj ovik have applied to the St. Croix County Community
4 Development Department to rezone approximately 10.0 acres from Agricultural to Agricultural
5 Residential, and 25.0 acres from Agricultural to Agricultural District Two, all within the SW 1/4 of
6 the SW 1/4, Section 7, T3 IN, RI 6W, in the Town of Cylon; and
7
8 WHEREAS, the St. Croix County Community Development Committee held a public
9 hearing on the rezoning request on August 15, 2013, in Hudson, Wisconsin; and
10
11 WHEREAS, the St. Croix County Community Development Committee considered all
12 written information and verbal testimony presented at the hearing, and made the following findings
13 in support of the request:
14 1. The Town of Cylon has recommended approval.
15 2. The request is consistent with the St. Croix County Comprehensive Plan and the St.
16 Croix County Natural Resources Management Plan based on:
17 a. The request will preserve productive soils as identified by the county land
18 evaluation system.
19 b. The proposed uses will minimize the loss and fragmentation of farmland in rural
20 areas.
21 c. The propose uses will limit development and will not convert productive
22 agricultural land.
23 d. The proposed uses are consistent with residential densities of 1 unit/40 acres
24 based on the productivity of the soils as rated by the LESA system.
25 e. The proposed uses are consistent with the County's policy to favor agricultural
26 uses over non-agricultural uses when considering land use conflicts.
27 f The proposed uses are consistent with the County's policy of agricultural uses to
28 include a broad range of agricultural activities.
29 g. The proposed uses are consistent with the County's policy to establish and make
30 available zoning standards to prohibit major subdivisions in the farmland
31 preservation areas.
32 h. The proposed uses are consistent with the County's policy to prohibit non-farm
33 development on productive farmland.
34 i. The proposed uses are consistent with the goal to protect and improve
35 groundwater quality to supply clean water for drinking and recharging surface
36 waters and wetlands.
37 j. The proposed uses are consistent with the goal to protect and enhance surface
38 waters and wetlands to preserve their ecological functions and recreational and
39 scenic values.

40 k. The proposed uses are consistent with the goal to protect and restore fish and
41 wildlife habitats for native species, improved water quality, recreational
42 opportunities, and natural beauty.
43 1. The request is consistent with the goal to preserve agricultural land for crop
44 production, scenic values, and wildlife habitat.
45 3. It appears that the proposed uses can comply with standards in the Land Use,
46 Subdivision and Sanitary ordinances.
47 4. The proposed uses are consistent with the spirit or intent of the Ordinance.
48 5. The request meets the requirements in WSS 91.48 (1).

50 THEREFORE, the following described parcel is hereby rezoned from Agricultural to
51 Agricultural Residential:
A parcel of land located in partiof the fractional 5W114 of the 5W1/4 of section 7, T31N, R16W, Town of Cyiori, st.
Croix County, Wisconsin; described as follows:
Commencing at the SW Comer of said Section 7; thence N89"48'43"E, alongthe south line of the fractional SW1/4,
1238.60 feet to the point of beginning; thence continuing N89"48'43"E, alcngsaid south line, 332.88 feet to the
east line of said fractlonaI SW1/4; thence N0 1°46'01"W, along said east line,1908.65 feet to the north line of said
fractional SW 114; thence 589'57'29"w, along said north fine, 332.90 feet; thence 501'46'0]."E 1309.50 feet to the
point of beginning. Described parcel contains 10.00 acres (435,504 Sq. Ft.).
54 And, the following described parcel is hereby rezoned from Agricultural to Agricultural
55 District Two:
A parcel of land located 1n part crf the fractional SW1/4 of the SW1/4 of Section 7, T3IN, R16W, Town of Cylon, 5t.
Croix County, Wisconsin; described as follows:
Cummencing at the SW Corner of said Section 7; thence N89°48'43"E,, along the south Ilne of the fractional SW1/4,
407.35 feet to the west fine of the east 35 acres of said fractional 5W1/4, being the paint of beginning; thence
continuing N89°48'43"E, along said south line, 831.25 feet; thence NO1°46'01"W 1309.50 feet to the north line of
said fractional SW214; thence 589"57'79"1N, along said north line, 831.32 feet to said west line of the east 35 acres;
thence 501°46`01"E, along said west line, 1311.62 feet to the point of beginning. Described parcel wntalns n.00
56 acres (1,089,004 5q. FL).
