Staff has verified that those provisions did not Real Pc ''rry 715 -4677 require a performance bond, nor were any conditions placed on the 1984 special exception permit requiring one. Section 17.82(1)(a) of the current Zoning Ordinance states that any R (5-386-4675 l6 transmission facility for which a permit has been issued prior to August 28, 1997 shall not be required to meet the requirements of this subchapter exceeding those in effect at the time the permit was granted. The existing tower is therefore exempt from the current performance bond requirement since that requirement exceeds those in place in 1984. F<:. • Section 17.82(1)(a)3 of the Zoning Ordinance goes on to state that any addition or change to a x: preexisting transmission facility shall comply with applicable requirements of this subchapter, provided that such modifications...which add a collocating antenna without increasing its height are exempt from the requirements adopted after August 28, 1997. As such, the proposed collocation does not require a land use permit. We will refund the application fee, s : which you should receive in the mail in approximately two weeks. We will also return your application materials. (Please be advised that you may still be required to obtain a building permit for the equipment shelter from the Town of Somerset). I apologize for any inconvenience this has caused and appreciate your patience on this matter. Stick a copy of the refund check in the file before you send it out. FYI - I also placed an envelope at the front desk for Steve to pick up containing his permit application and copies of the 1984 conditional use/special exception permit for the existing tower and copies of the 1978 and 1997 ordinance provisions on towers.
