This letter confirms zoning approval according plans submitted by Steve West, Landsted, LLC,
Land Information &on February 14, 2008 for filling and grading an area of approximately 9,990 square feet on slopes

~Y property referenced above. The disturbed area is part of a larger project area for which you have
also submitted a special exception application. The property is located on a 2-acre lot within the
Real P ~Y Shoreland District of Indigo Pond and another unnamed pond in the Town of Hudson. Staff finds
715 -4677 that the proposed project meets the spirit and intent of the St. Croix County Zoning Ordinance and
R ` cling Shoreland District with the following findings:
5-386-4675 1. Filling and grading less than 10,000 square feet in area on slopes less than 25 percent is
;w allowed with a land use permit in the Shoreland District pursuant to Section 17.29(2)(c) of
the St. Croix County Zoning Ordinance;
2. The ro osed building site is on slopes of less than 12 percent to approximately 20 percent. i
. The proposed driveway appears to bisect slopes ranging from 24 - 30 percent; however, no
excavating will occur within this area as part of this land use permit application. According
b to Steve West, Landsted, LLC, a temporary driveway of concrete blocks will be laid to
provide access for vehicles and heavy equipment used to prepare the building site. Any
potential disturbance on slopes of 25 percent or over to install the driveway will need to be
addressed as part of the special exception permit and may require an additional variance;
3. The grading limits for the proposed excavated area is more than 465 feet from the OHWM
of Indigo Pond and over 320 feet from the OHWM of the other unnamed pond to the east;
4. The erosion control plan features a single row of silt fence around the northwest, west, and
southeast boundaries of the grading limits. According to Steve West Landsted LLC storm
water runoff from the site will drain to an existing drainage easement located on the
southeast corner of the lot and to an existing wetland on Lot 37 to the northwest. A culvert is
2 proposed under the driveway to Lot 36 to ensure that runoff from Lot 35 doesn't flood or
wash out the driveway. With conditions for supplementing the silt fence to ensure that
sediments don't reach the wetland on Lot 37; maintaining the silt fence and any additional
erosion control measures until self-sustaining permanent vegetation is established on all
disturbed areas; prohibiting the use of phosphorous fertilizer to establish and maintain a
lawn on the disturbed areas, ; and addressing long-term storm water management on the site
t as part of the special exception permit; potential negative impacts to the water quality of the
ponds and drainage in the area will be minimized;

5. The St. Croix County Land and Water Conservation Department has visited the site and reviewed the plans,
and finds the proposed erosion control measures for the initial filling and grading to be done as part of this land
use permit application to be adequate; and
6. The Wisconsin Department of Natural Resources has been sent a copy of the application and notified staff that
the wetland on Lot 37 is a delineated wetland. The Department has also notified staff that this project is subject
to review by the Wisconsin Department of Commerce and that storm water runoff will have to be managed and
treated on the site in accordance with NR 151 standards.
Based on these findings, approval of this land use permit is subject to the following conditions:
1. The applicants shall contact the Zoning Administrator prior to commencing construction and when the
initial phase of construction has been completed.
2. Prior to commencing construction, the applicants shall install the silt fence in accordance with the erosion
control plan and shall supplement the silt fence with additional erosion control measures as necessary to
ensure that sediments do not reach the wetland on Lot 37. All silt fence and other erosion control measures
shall be maintained until permanent, self-sustaining vegetation is successfully established on all disturbed
areas of the site.
3. The applicants shall be responsible for submitting storm water plans and calculations for the long-term
management and treatment of storm water runoff on the site prior to the Board of Adjustment hearing for
the special exception permit.
4. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of the site,
unless a soil test confirms that phosphorous is needed.
5. Upon completing the initial site work outlined as part of this land use permit application, the applicants
shall submit to the Zoning Administrator photos of the excavated area and erosion control measures as
viewed from all angles.
This approval does not allow for any additional construction, grading, filling, or clearing of vegetation
beyond the limits of this request. Any remaining site work above and beyond the 9,990 square feet identified
as part of this land use permit application shall be addressed as part of the special exception permit
application and shall be subject to the additional conditions of that permit upon approval by the St. Croix
County Board of Adjustment. The project may also require an addendum for an additional variance to
disturb slopes of 25 percent and greater to install the driveway.
Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your
responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but not
limited to obtaining a town building permit, County sanitary permit, and any permits that may be required by the
Wisconsin Department of Natural Resources.
