HomeMy WebLinkAboutOrdinance 1988 (209) ORDINANCE REGARDING SALE OF TAX DEEDS Ordinance # d,O 9 0 1 ) WHEREAS, Wisconsin Statutes Section 75.35(3) allows a County Board, at its option, by Ordinance, to provide that in the sale of tax deeded lands, the former owner who has lost his title through the delinquent tax collection enforcement procedure, or his heirs, to be given preference in the right to purchase such lands; and WHEREAS, such an Ordinance may provide that such sale be exempt from any or all provisions of Wisconsin Statutes Section 75.69; and WHEREAS, it has been observed by those county personnel who administrate the sale of tax deeded lands that such an Ordinance would be of great benefit to St. Croix County, and would allow individual flexibility where circumstances warrant; NOW THEREFORE, BE IT ORDAINED by the St. Croix County Board of Supervisors as follows: 1. In the sale of tax deeded lands by St. Croix County, the former owner who lost his title through delinquent tax collection enforcement procedures, or his heirs, may be given preference in the right to purchase such lands under the circumstances described as follows: a. Wherein, through no negligence of his own, the former owner or his heirs did not receive proper legal notice of the tax deed proceedings affecting the subject lands. b. Whenever circumstances otherwise indicate that using this Ordinance would serve the best interests of St. Croix County. ' 2. In the event of any of the foregoing circumstances, any such sale shall be exempt from any or all procedures under Wisconsin Statutes Section 75.69. 3. This ordinance shall not apply to the sale of tax deeded lands which have been improved by or dedicated to a public use by St. Croix County subsequent to its acquisition thereof. 4. Any future amendments, revisions, or modifications of the Wisconsin Statutes incorporated herein, are intended to be made part of this Ordinance as such amendments, revisions, or r modifications are made to said Statutes. 5. This Ordinance shall take effect and be in force from and afters its proper passage and publication pursuant to Wisconsin Law. Dated t il1 — day of "T14te, , 1988.
