WHEREAS, presently the St. Croix County Zoning Ordinance
relating to exclusive agricultural zoning does not permit parcels
to be created from existing farm units when such parcels would be
less than 35 acres; and
WHEREAS, Wisconsin Statutes Section 91.75(6) allows
exclusive agricultural use ordinances to be amended to permit,
for purposes of farm consolidation, the creation of smaller
parcels of farm residences or structures which existed prior to
the adoption of the ordinance from larger farm parcels; and
WHEREAS, nearly all Wisconsin counties with exclusive
agricultural use ordinances have amended such ordinances to allow
the creation of such new parcels with the existing farm
residences or structures,
NOW, THEREFORE, the St. Croix County Board of Supervisors of
St. Croix County, Wisconsin does hereby ordain as follows:
Amend the present St. Croix County Zoning
Ordinance Section 17.14(1)(c) to read Section
17.14(1)(d).
Create new Section 17.14(1)(c) to read:
Single family residential dwellings and
related farm structures existing at the
effective date of this Ordinance remaining
after farm consolidation may be separated
from the original farm parcel provided that
the parcel and improvements conform with all
regulations in 17.13(4)(b) and 17.13(5). Such
pre- existing uses located in areas subject to
zoning in this Section which do not conform
to the agricultural related status
requirements shall not be subject to any
limitations imposed or authorized under
Section 59.97(10) of the Wisconsin Statutes
and may be altered, repaired, or rebuilt if
destroyed, but are subject to setback, height
and other dimensional requirements of this
Section.
Amend Section 17.14(2)(b) to read: Residences
allowed under Section 17.14(1)(b) and
17.14(1)(c) which are on parcels
This Ordinance shall take effect and be in force from and
after its proper passage and publication pursuant to Wisconsin
Law.
