RESOLUTION OPPOSING 2013 WISCONSIN ACT 20, SECTION

1 WHEREAS, 2013 Wisconsin Act 20 was enacted by the State Legislature and signed by
2 Governor Walker on June 30, 2013; and

4 WHEREAS, Section 1270 of 2013 Wisconsin Act 20 purports to end St. Croix County's
5 long standing practice of residency requirements for certain county employees; and
6
7 WHEREAS, the issue of local residency is not a matter of statewide concern but is
8 instead clearly a matter of "local affairs and government" to be determined by local units of
9 governments that are directly accountable to the local voters; and
10
11 WHEREAS, factors unique to St. Croix County, including both population and
12 geography, contribute to the need to ensure that sufficient staff are able to respond in a timely
13 manner to weather and other emergency conditions, homeland security events and other events
14 requiring prompt service from county employees; and
15
16 WHEREAS, minimizing the County's response time is critical to reducing personal
17 injury, property damage and adverse economic and financial impact and is necessary to protect
18 the health, safety and welfare of the public; and
19
20 WHEREAS, St. Croix County has not experienced difficulty recruiting or retaining
21 public employees as a result of its long standing residency requirements; and
22
23 WHEREAS, the Legislature was in error when it found that "Public Employee Residency
24 Requirements" are a matter of statewide concern;" and
25
26 WHEREAS, by incorrectly declaring this as a matter of statewide concern, the Wisconsin
27 Legislature is in violation of Wisconsin Statute § 59.03 (1) entitled Administrative Home Rule.

29 THEREFORE, be it resolved that the St. Croix County Board of Supervisors opposes
30 2013 Wisconsin Act 20 and supports the challenging of said legislation by legal means.

32 FURTHER be it resolved that the St. Croix County Clerk forward copies of this
33 resolution to Senator Sheila Harsdorf, State Assembly Representatives Erik Severson, John
34 Murtha, Dean Knudson and Governor Scott Walker.
