CROIX COUNTY CODE OF ORDINANCES LAND USE AND DEVELOPMENT CHAPTER 17 _ ZONING SECTION 17.72 REZONING AMENDMENTS - CRONK, TOWN OF BALDWIN 1 The St. Croix County Board of Supervisors does ordain as follows: 2 3 WHEREAS, Richard and Brenda Cronk have applied to the St. Croix County Community 4 Development Department to rezone approximately 14.0 acres from Agricultural to Agricultural 5 Residential, and 32.55 acres from Agricultural to Agricultural District Two, all within the NE 1/4 of 6 the NE 1/4, and the NW '/4 of the NE'/4 of Section 5, T29N, R16W, in the Town of Baldwin; and 7 8 WHEREAS, the St. Croix County Community Development Committee held a public 9 hearing on the rezoning request on September 19, 2013 in Hudson, Wisconsin; and 10 11 WHEREAS, the St. Croix County Community Development Committee considered all 12 written information and verbal testimony presented at the hearing, and made the following findings 13 in support of the request: 14 1. The Town of Baldwin has recommended approval. 15 2. The request is consistent with the St. Croix County Comprehensive Plan and the St. 16 Croix County Natural Resources Management Plan based on: 17 a. The uses will preserve productive soils as identified by the county land evaluation 18 system. 19 b. The proposed uses will minimize the loss and fragmentation of farmland in rural 20 areas. 21 c. The propose uses will limit development and will not convert productive 22 agricultural land. 23 d. The proposed uses are consistent with residential densities of 1 unit/20 acres 24 based on the productivity of the soils as rated by the LESA system. 25 e. The proposed uses are consistent with the County's policy to favor agricultural 26 uses over non-agricultural uses when considering land use conflicts. 27 f The proposed uses are consistent with the County's policy of agricultural uses to 28 include a broad range of agricultural activities. 29 g. The proposed uses are consistent with the County's policy to establish and make 30 available zoning standards to prohibit major subdivisions in the farmland 31 preservation areas. 32 h. The proposed uses are consistent with the County's policy to prohibit non-farm 33 development on productive farmland. 34 i. The proposed uses are consistent with the goal to protect and improve 35 groundwater quality to supply clean water for drinking and recharging surface 36 waters and wetlands. 37 j. The proposed uses are consistent with the goal to protect and enhance surface 38 waters and wetlands to preserve their ecological functions and recreational and 39 scenic values. 40 k. The proposed uses are consistent with the goal to protect and restore fish and 41 wildlife habitats for native species, improved water quality, recreational 42 opportunities, and natural beauty. 43 1. The request is consistent with the goal to preserve agricultural land for crop 44 production, scenic values, and wildlife habitat. 45 3. It appears that the proposed uses can comply with standards in the Land Use, 46 Subdivision and Sanitary ordinances. 47 4. The proposed uses are consistent with the spirit or intent of the Ordinance. 48 5. The request meets the requirements in WSS 91.48 (1). 49 50 THEREFORE, the following described parcel is hereby rezoned from Agricultural to 51 Agricultural Residential: 52 53 A parcel of land located in the NE'/4 of the NE'/4 and in part of the NW'/4 of the NE'/4 of Section 5, Township 29 54 North, Range 16 West, Town of Baldwin, St. Croix County, Wisconsin described as follows: 55 56 Commencing at the North'/4 Corner of said Section 5, Township 29 North, Range 16 West; thence S.87°47'51'E., 57 along the north line of the NE'/4 of said Section 5, 811.48 feet; thence S.00'1 5'58"E., 83.08 feet to the northeast 58 corner of Lot 1 of a Certified Survey Map recorded in Volume 12, Page 3398; thence S.87°47'51'E., along the south 59 line of a parcel of land recorded in Volume 149, Page 463, 1384.11 feet to the northwest corner of a parcel of land 60 recorded in Volume 352, Page 182; thence S.00°07'34"E., along the west line of a parcel of land recorded in Volume 61 352, Page 182, 349.93 feet to the southwest corner of a parcel of land recorded in Volume 352, Page 182; thence 62 S.87°47'51 "E., along the south line of a parcel of land recorded in Volume 352, Page 182 and the easterly extension 63 of said south line, 433.00 feet to the east line of said NE'/4 of the NE Y41 thence S.00°07'34"E., along the east line of 64 said NE'/4 of the NE Y4, 532.89 feet to the point of beginning; thence N.88°08'17"W., 541.77 feet; thence 65 N.36°08'10'W., 159.13 feet; thence N.74°10'16"W., 131.25 feet; thence N.08°01'01"E., 128.73 feet; thence 66 N.80°31'05"W., 54.49 feet; thence S.88°34'54"W., 431.93 feet; thence S.21 °35'48"W., 609.80 feet to the south line 67 of said NW'/4 of the NE'/4; thence S.87°28'35"E., along the south line of said NW'/4 of the NE'/4 and south line of 68 said NE'/4 of the NE Y4, 1455.76 feet to the Southeast Corner of said NE'/4 of the NE Y41 thence N.00°07'34"W., 69 along the east line of said NE'/4 of the NE Y4, 323.42 feet to the point of beginning.
