This letter confirms zoning approval according plans submitted by Michelle Bruette, on
Real Property June 26, 2008 for the following activities that require a land use permit:
715-386-4677
1. Filling and grading an area of approximately 9,800 square feet outside of the
Reo viing slope preservation zone and greater than 40 feet from the slope preservation
715-386-4675 zone. The filling and grading is being conducted to re-establish lawn in the front
and back yard.
2. Construction of a retaining wall as an accessory structure. The retaining wall
will be located in the back yard as well as along the side of the house and will be
located 40.5 feet from the bluffline at the closest point. The walls will be lined
with fieldstone rock. The height of the retaining wall will be about 10 feet tall at
the highest point.
3. Construction of a deck/patio onto the existing residence on the riverward side of
the house. The patio will be 24 feet by 45 feet long and will be 100.5 feet from
the bluffline at the closest point. Part of the patio (deck) will be elevated to the
upstairs of the house and will be 20 feet by 20 feet. The deck will be >100 feet
from the bluffline at the closest point.
Additional work proposed as part of this project that does not require a County land use
permit, but still requires a Town permit, includes driveway relocation. Additional work
proposed as part of this project that does not require a County or Town permit but is
referenced in this letter includes the rainwater tank, outdoor chess game, outdoor pond,
and outdoor lighting as stated in the plan.
Staff finds that the proposed activities meet the spirit and intent of the St. Croix County
Zoning Ordinance and Riverway District with the following findings:
1. The property consists of 3.8 acres, is zoned Ag/Residential, and is located in the
Rural Residential Management Zone of the Lower St. Croix Riverway District;
2. The Wisconsin Department of Natural Resources has been sent a copy of the
application and visited the site and recommends that: a) No structures are allowed
within the 40 foot setback of the slope preservation zone; b) A list of the plants
used and sizes of the gardens be submitted; and c) A drawing of the site should be
completed.

t site and recommends that: a) Perimeter erosion control needs to be installed and maintained until
getation is fully established; b) Native vegetation needs to be reestablished within the 40 foot
uffline setback; c) Stormwater measures will need to be taken to infiltrate 1.5" of runoff for any
i 'pervious coverage added to the site; and d) Fill needs to be removed from the base of the trees.
4. The erosion control plan features perimeter silt fencing installed below the grading and rock
retMnirtg wall. This will include conditions for supplementing the silt fence to ensure that sediment-
ladoi runoff is not allowed to reach the river; maintaining the silt fence and any additional erosion
control measures until self-sustaining permanent vegetation is established on all disturbed areas;
prohibiting the use of phosphorous fertilizer to establish and maintain a lawn on the disturbed areas;
and providing long-term storm water management on the site with use of infiltration structures;
potenil negative impacts to the water quality of the ponds and drainage in the area will be
minimized;

eservation zone is allowed with a land use permit in the Lower St. Croix Riverway District pursuant to
Section 17.36.F.2.a.2) of the St. Croix County Zoning Ordinance;
6. No filling and grading will occur on slopes over 12 percent or within 40 feet of the bluffline;

7. Accessory structures to a single family residence are allowed in the Riverway District subject to
standards in Section 17.36.1-1 and with a land use permit from the St. Croix County Zoning
Administrator;
8. The: retaining wall is at least 200 feet from the OHWM of the Lower St. Croix River;
9. The structure is 40.5 feet from the bluffline at the closest point;
10. The structure does not protrude above the bluffline as viewed from at or near the mid-line of the river or
from 250 feet riverward from the OHWM whichever is less;
11. The structure will not located in a slope preservation zone;
12. The structure will utilize building materials that are earth tone in color and of a non-reflective nature.
13. The structure is greater than 25 feet from property lines;
Construction of patio/deck
14. Accessory structures to a single family residence are allowed in the Riverway District subject to
standards in Section 17.36.1-1 and with a land use permit from the St. Croix County Zoning
Administrator;
15. The patio/deck will be greater than 25 feet from property lines and greater than 100 feet from the
bluff line at the closest point;
16. The height of the patio/deck will not exceed the 35 foot maximum height;
17. The deck/patio is at least 200 feet from the OHWM of the Lower St. Croix River;
18. The structure will be constructed from materials that are earth tone in color;
This approval is for filling and grading an area not to exceed 9,800 square feet, constructing a retaining
wall, and constructing a patio/deck as indicated in the plans submitted and as provided in the conditions
below.

2. for to commencing construction, the applicants shall install the silt fence (or other approved
s diment barrier) in accordance with the erosion control plan and shall supplement the silt fence
w dditional erosion control measures as necessary to ensure that sediments do not reach the
St. Croix River. All silt fence and other erosion control measures shall be maintained until
permanent, self-sustaining vegetation is successfully established on all disturbed areas of the site.
3. Nolphosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of
the site, unless a soil test confirms that phosphorous is needed.
4. Upon completing the initial site work outlined as part of this land use permit application, the
applicants shall submit to the Zoning Administrator photos of the excavated area and erosion
control measures as viewed from all angles.
2. Prior to commencing construction, the applicant shall submit to and have approved by the Zoning
Adminisator a vegetation management plan for the area between the bluffline and the east
propert line.
3. Th finished principal structure shall be no taller than 35 feet in height pursuant to Section 17.36
. G .a.1) of the Ordinance.
4. All materials used for the retaining wall shall be earth tone in color and of a non-reflective nature so
as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a) and
17.36 H.1 of the Ordinance
5. The applicant shall not disturb or attempt to implement any erosion control on the riverward side of
the bluffline. The gully that was thought to be an erosion concern was determined by the Land and
Water Conservation Department to not be an erosion threat at this time. The applicant shall contact
Land and Water Conservation Department if future erosion/stabilization concerns arise. The
applicant is allowed to plant native vegetation within this area, as long as no fill is used.
6. Since the permit application materials have been received, it has come to this Departments
attention that many of the trees on the property have been damaged from machinery. Any trees
within 100 feet of the bluffline that die as a result of the grading and filling activity shall be replaced
according to the tree replacement schedule pursuant to Section 17.36 H.8.f of the Ordinance.
7. The applicant shall work with the Town of St. Joseph to obtain a driveway permit within (60) sixty
days of the approval of this permit. The driveway itself should be designed so that WDNR Storm
water Construction Technical Standards are implemented. Prior to construction of the driveway, the
applicant needs to submit a storm water management and erosion and sediment control plan for the
newly created impervious surface from the proposed driveway to this Department.
8. As mentioned in the plan, the applicant wishes to construct a water drainage system on the
property to collect stormwater and run-off into a plastic tank located near the bluffline. This
Department has determined that the proposed 7' x 7' x 2' plastic water tank is not considered a
structure and therefore does not apply to the setback regulations. The applicant will be allowed to
place this tank within the setbacks granted the structure is above ground. No fill, including
landscaping rocks, may be placed around this tank. If possible, the applicant should purchase a
tank with an earth tone color or paint the tank to an earth tone color.
9. The applicant is responsible for contacting the Town of St. Joseph to determine whether or not the
deck/patio will require a building permit.
10. The applicant shall plant a row of evergreen seedlings or a hedge consisting of native vegetation
along the northern property line, between the location of the house and the northwestern property
corner, in order to provide sufficient screening to the neighboring property line.
11. Solar lighting that is planned on being installed throughout the gardens shall be positioned away
from property lines and away from the St. Croix River.
12. While the applicant is allowed to place outdoor furniture within the setback to the bluffline, the
applicant is not allowed to install outdoor tiles to be used as a permanent sitting area within 40 fee#.

oposed outdoor chess game. If the chess game is to be permanently set up, it will need to be
eater than 40 feet from the bluff line and greater than 25 feet from property lines.
13. T lanned outdoor pond on the east side of the property shall meet the required setback to the
Town road.
14. All ettiviiies approved as part of this land use permit shall commence within one year from the date
of approval and be substantially completed within two years, after which time the permit expires
pursual to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request
extensions of up to six months from the Zoning Administrator. The total time granted for extensions
shall not exceed one year.
15. Failure to comply with the conditions above may result in the revocation of this permit pursuant to
Section`-:17.36 J.8.b of the Ordinance.
This approv does not allow for any additional construction, grading, filling, or clearing of
vegetatio eyond the limits of this request. Any remaining site work above and beyond what is
identifi as part of this land use permit application shall be subject to the review and approval of
the Z ing Administrator.
Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your
responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but
not limited to obtaining a town building permit, County sanitary permit, and any permits that may be
required by the Wisconsin Department of Natural Resources.

The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete
application and supporting documents, the Zoning Administrator will:
• send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to contact
their town to discuss their application and inquire about necessary building permits and approvals at the town level;
• schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project corners
and label the flags accordingly; and
• review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval, the permit will be
mailed to the applicant or to the applicant's agent.
If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be required to
apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the application become
the property of the Planning and Zoning Department and will remain in the file.

Project schedule and contractor list.
Erosion control plan (Best Management Practices).
CI' Storm water management plan stamped by an engineer and including all runoff calculations.
Vegetation plan including schedule, seeding rates, and species size, type and location.
