Land Information & Dear Mr. Belisle:

715-386-4674 This letter confirms zoning approval according plans submitted by Don Schmitt, General
Contractor, on May 9, 2008 for filling and grading an area of approximately 7,400 square
Real Property feet on slopes of less than 20 percent to prepare a site for the construction of a single-
715-386-4677 family dwelling on the property referenced above. The property is located on a 2-acre lot
within the Shoreland District of the Apple River in the Town of Star Prairie. Staff finds that
Recycling the proposed project meets the spirit and intent of the St. Croix County Zoning Ordinance and
715-386-4675 Shoreland District with the following findings:
1. Filling and grading less than 10,000 square feet in area on slopes less than 25 percent
is allowed with a land use permit in the Shoreland District pursuant to Section
17.29(2)(c) of the St. Croix County Zoning Ordinance;
2. The proposed building site is on slopes of less than or equal to 15 percent;
3. The grading limits for the proposed excavated area for the house and septic system is
>75 feet from the OHWM of Apple River and approximately 10 feet above the 100-
year flood elevation of 859.0';
4. The erosion control plan features a single row of silt fence or other approved sediment
control barrier immediately below the proposed septic system installation area, running
north/south along the contour of the slope facing the river. With conditions for
supplementing the silt fence to ensure that sediment-laden runoff is not allowed to
reach the river; maintaining the silt fence and any additional erosion control measures
until self-sustaining permanent vegetation is established on all disturbed areas;
prohibiting the use of phosphorous fertilizer to establish and maintain a lawn on the
disturbed areas; and providing long-term storm water management on the site with
use of infiltration structures; potential negative impacts to the water quality of the
ponds and drainage in the area will be minimized;
5. The St. Croix County Land and Water Conservation Department has reviewed the
plans and finds the proposed erosion control measures for the initial filling and grading
to be done as part of this land use permit application to be adequate; and
6. The Wisconsin Department of Natural Resources has been sent a copy of the
application and notified staff that the OHWM may be determined by St. Croix County
staff. The Department has also notified staff that this project is subject to review by the
Wisconsin Department of Commerce and that storm water runoff will have to be
managed and treated on the site in accordance with NR 151 standards.
Based on these findings, approval of this land use permit is subject to the following
conditions:

1. The applicants shall contact the Zoning Administrator prior to commencing construction and when the
initial phase of construction has been completed.
2. Prior to commencing construction, the applicants shall install the silt fence (or other approved sediment
barrier) in accordance with the erosion control plan and shall supplement the silt fence with additional
erosion control measures as necessary to ensure that sediments do not reach the Apple River. All silt
fence and other erosion control measures shall be maintained until permanent, self-sustaining
vegetation is successfully established on all disturbed areas of the site.
3. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of the
site, unless a soil test confirms that phosphorous is needed.
4. Upon completing the initial site work outlined as part of this land use permit application, the applicants
shall submit to the Zoning Administrator photos of the excavated area and erosion control measures as
viewed from all angles.
This approval does not allow for any additional construction, grading, filling, or clearing of vegetation
beyond the limits of this request. Any remaining site work above and beyond the 7,400 square feet
identified as part of this land use permit application shall be subject to the review and approval of the
Zoning Administrator.
Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your
responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but not
limited to obtaining a town building permit, County sanitary permit, and any permits that may be required by the
Wisconsin Department of Natural Resources.
