HomeMy WebLinkAboutResolution 2013 (26) Resolution No. 26 (2013) RESOLUTION APPROVING ALTERATION OF SUPERVISORY DISTRICT BOUNDARIES RESULTING FROM AN ANNEXATION TO THE CITY OF HUDSON 1 WHEREAS, in 2011 the St. Croix County Board of Supervisors adopted a 10-year supervisory 2 district plan creating county supervisory districts, municipal aldermanic districts and election wards 3 following the 2010 Census; and 4 5 WHEREAS, Wisconsin Statutes § 59.10(3)(c) allows a county board, in its discretion, to alter the 6 boundaries of supervisory districts based on annexations which occur after the adoption of the 10-year 7 supervisory district plan, as long as the number of supervisory districts is not changed; and 8 9 WHEREAS, on September 13, 2013 the City of Hudson completed an annexation of a parcel of 10 approximately 3.88 acres; and 11 12 WHEREAS, a map of the annexed parcel, along with a copy of the annexation ordinance, has 13 been filed with the St. Croix County Clerk and are attached; and 14 15 WHEREAS, the parcel annexed by the City of Hudson is part of County Supervisor District 8, 16 consisting of Ward 10 of the Town of Hudson; and 17 18 WHEREAS, it is appropriate to redraw the annexed parcel into County Supervisor District 7 in 19 the City of Hudson; and 20 21 WHEREAS, the population of the annexed parcel is two (2) residents which maintains the 22 original numbers of the affected districts; and 23 24 WHEREAS, this resolution does not change the number of supervisory districts. 25 26 NOW, THEREFORE BE IT RESOLVED by the St. Croix County Board of Supervisors that the 27 supervisory district boundaries are hereby altered by moving the annexed parcel of land from County 28 Supervisor District 8 to County Supervisor District 7 consisting of Ward 3 in the City of Hudson as 29 shown on the attached; 30 31 BE IT FURTHER RESOLVED that the St. Croix County Clerk is hereby directed to forward all 32 notices required under Wisconsin Statutes, Chapter 59, to the Secretary of State for the purpose of 33 advising that office of said supervisory district boundary changes. CITY OF HUDSON ORDINANCE No. 5-13 AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF HUDSON, WISCONSIN THE COMMON COUNCIL OF THE CITY OF HUDSON DO ORDAIN AS FOLLOWS: SECTION 1. Territory Annexed. In accordance with Section 66.031 of the Wisconsin Statutes and the petition for direct annexation filed with the City Clerk on August 9, 2013 signed by the land owner in the territory, the following described territory in the town of Hudson, St. Croix County, Wisconsin is annexed to the City of Hudson, Wisconsin. (Refer to attached legal description) SECTION 2. Effect of Annexation. From and after the date of this ordinance the territory described in Section 1 shall be a part of the City of Hudson for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Hudson, Wisconsin. SECTION 3. Zoning Classification. The territory shall be designated as R-1, One-family Residential District, pursuant to Municipal Code, Chapter 255 - Zoning, Section 255-12. The territory is designated as Medium Density Residential in the 2009 City of Hudson comprehensive plan. An application shall be submitted by the land owner to initiate a request to rezone the property to RM-1, Multiple Family Residential District. SECTION 4. Ward Designation. The territory described in Section 1 of this ordinance is hereby made a part of the Third Ward of the City of Hudson. SECTION 5. Severability. If any portion of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application. Stats., provides that the annexation of lands to cities and villages within a county having a population of 50,000 or more shall be reviewed by the Department of Administration in order to determine if the proposed annexation is in the public interest or against the public interest. The proposed annexation from the Town of HUDSON to the City of HUDSON (see attached description) must be reviewed pursuant to the statute. To assist us in making this determination, we urge that you promptly supply the data requested on the enclosed questionnaire (where possible) and return the questionnaire to the department. The purpose of this questionnaire is to assist the department in determining "Whether the governmental services, including zoning, to be supplied to the territory could clearly be better supplied by the town...." The statute further stipulates that the department shall study the "shape of the proposed annexation and the homogeneity of the territory with the annexing municipality."
