Dear Mr. & Mrs. Thommes:
This letter confirms zoning approval according to the plans you have submitted for filling and grading
< 10,000 square feet within 300 feet of the Ordinary High Water Mark (OHWM) of the Apple River to
construct a driveway, single-family dwelling, a detached garage, and a private on-site wastewater
treatment system (POWTS) on the property referenced above in the Town of Star Prairie. Community
Development Department (CDD) staff finds that the proposed project meets the spirit and intent of
the St. Croix County Zoning Ordinance and Shoreland and Floodplain overlay districts with the
following findings:
1. Filling and grading an area less than 10,000 square feet within 300 feet from the OHWM
on slopes less than 25 percent is allowed with a land use permit in the Shoreland Overlay
zoning district pursuant to Section 17.29(2)(c) of the St. Croix County Zoning Ordinance;
2. The filling and grading will consist of excavating for the foundation of a two-bedroom
single-family dwelling, detached garage, driveway, and a POWTS, which will be located
within 300 feet of the OHWM of the Apple River back water. The proposed driveway,
single-family dwelling, and POWTS meet the 75'setback from OHWM and other required
setbacks and dimensional standards contained in the county Shoreland Overlay zoning
ordinance;
3. The proposed principal and accessory structures will be located outside the identified
floodplain boundary and are not subject to Floodplain Overlay zoning ordinance. As long
as the foundation and the lowest building openings are above the 100 yr. flood elevation
of 865' MSL (shown on house construction plans, site plan, and map of survey) and kept
outside the identified floodplain boundary, the principal and accessory structures will only
be required to meet General and Shoreland zoning ordinance requirements;
4. A sanitary permit has been issued for the project. The POWTS' proposed system elevation
will be above the identified floodplain elevation of 865' MSL.

5. The applicant's stormwater management plan includes an erosion and sediment control
plan. With conditions to install appropriate erosion and sediment control measures e.g. silt
fence or sediment"logs"along the floodplain boundary (identified on the map of survey)
prior to beginning excavation, to maintain erosion control measures until self-sustaining
permanent non-invasive vegetation is established on all disturbed areas, and to prohibit
the use of phosphorous fertilizer to maintain a lawn, negative impacts to the water quality
of the adjacent wetlands and Apple River will be minimized;
6. The closest portion of back water of the Apple River identified on a map of survey is —100
ft. from the floodplain boundary and the west side of the proposed house and garage.
With conditions to maintain a minimum vegetative buffer zone extending 35 feet inland
from the river's OHWM and comply with tree cutting regulations in Section 17.28, the
project will preserve shore cover and natural beauty of the river and wetlands;
7. A storm water management plan was included in the application that will allow infiltration
of the first 1.5"of runoff from impervious surfaces (-2800 sq. ft. total). The house and
garage roof will create 1600 sq. ft. of impervious surface and runoff will be directed into a
3'x 70'x 1'seepage bed on the west side of the structures (between the buildings and
floodplain boundary). The driveway runoff will be infiltrated using rain gardens that will
assimilate an additional 150 cubic feet of water. With a condition that an affidavit
documenting the stormwater management plan be recorded against the property prior to
construction, this will meet requirements in Section 17.29(2)(c)3; and
8. The Wisconsin Department of Natural Resources (DNR) was sent a copy of the application
on November 4, 2013 for review. Mike Rogney, Water Management Engineer, commented
that though the house is very close to the Base Flood elevation, the structures appear to
be outside the floodplain and will not be subject to state R 116 floodplain regulations. A
DNR grading permit will not be required for land disturbance less than 10,000 sq. ft. and
outside the 75'OHWM setback.
Based on these findings, approval of the land use permit is subject to the following conditions:
1. Prior to commencing construction, the applicant shall obtain all applicable local, state, or
federal permits and approvals required for construction of the driveway, house and
garage. A sanitary permit has been issued for installation of the POWTS. The applicant
will need to provide a copy of the land use permit and an erosion control plan to the
town's building inspector in compliance with Uniform Dwelling Code requirements.
2. The applicant shall record an affidavit referencing the approved stormwater management
plan with the Register of Deeds prior to commencing construction and before the pre-
construction meeting (affidavit form enclosed).
3. A pre-construction on-site meeting must be scheduled with CDD staff to verify placement
of erosion and sediment control measures and that the stormwater affidavit has been
recorded. The applicant will be responsible for directing contractors to implement storm
water management and erosion control plans, which include installation of silt fencing,
straw waddles, and/or sediment logs between areas of exposed soil on the construction
site and the floodplain boundary to control contaminated runoff and prevent any filling of
adjacent wetlands. Photos will be taken to document pre-construction site conditions for
enforcement purposes.

4. The sanitary permit issued for installation of the POWTS will require compliance with all
conditions of the land use permit and the applicant is responsible for notifying contractors
of the conditions regarding erosion and sediment control during excavation.
5. The applicant shall maintain all erosion and sediment control measures until permanent,
self-sustaining vegetation is successfully established on all disturbed areas of the site,
including a 35' buffer zone along the river.
6. No phosphorous fertilizers shall be used on the disturbed areas of the site, unless a soil
test confirms that phosphorous is needed for establishing permanent vegetative cover.
7. Within 30 days of completing the project, the applicant shall submit to the CDD photos of
the completed structures, the stormwater infiltration devices, and stabilized disturbed
areas for documentation of compliance with conditions. Photos may be sent electronically
via e-mail attachment.
This approval does not allow for any additional construction, structures or structural
changes, grading, filling, or clearing of vegetation beyond the limits of this request. Your
information will remain on file in the St. Croix County Community Development
Department. It is your responsibility to ensure compliance with any other local, state, or
federal rules or regulations, including obtaining a building permit from the Town of
Somerset.

The department's only comment regarding the Thommes land use permit request is to assure the development and
construction on the site is not within or cause discharge to any wetlands, that all conditions of the St. Croix County
Shoreland Zoning ordinance are met, and the proposed stormwater management plan submitted with the application is
implemented.
Please note that these comments are in regard to shoreland zoning only, and do not reflect applicable erosion control,
waterway permitting, or other department regulations.

Hi Mike W.,
I received the comments below from Mike R., but wanted to check with you about any Shoreland concerns so I can finish
the permit. I've talked with Rogney about the close proximity of floodplain and am going to require in conditions that a
sediment control barrier be installed along the floodplain boundary and no fill or excavated materials may be placed on
the floodplain/wetlands side of the barrier. All stockpiled soil and equipment must remain in the limited area outside
the floodplain. I work with the excavator/plumber Schmitt regularly and he is very cooperative in handling these

sensitive Shoreland sites. I went out to the site Tuesday and took attached photos. I'm sure the surveyor was shooting
elevations on the top of foundation walls-the floor is just above the floodplain elevation of 865' based on visual
comparison. I talked to building inspector and he said that if the house is outside the floodplain, the LBO does not have
to be 2' above the 865' elevation. I advised John Schmitt that they should still try to bring the house and lower door
opening up at least 12" from the plans,which currently have it about 865.39'.

From a floodplain standpoint, according to the map presented by the registered surveyor, the house is proposed outside
the mapped floodplain for the Apple River.The structure did seem very close to the defined BFE elevation, but it was
concluded by the Department to be located outside of the floodplain.Therefore, St. Croix County's Floodplain Ordinance
and NR 116 would not apply to the structure. Feel free to contact me if anything else comes up.

APPLICATION:
Applications will not be accepted until the applicant has:
• Met with the Zoning Administrator to review the application;
• Submitted Original plus 2 copies of the entire packet including all supporting information,maps&diagrams; •
• Resolved any land use violations and paid any outstanding fees owed to the Community Development Department;
• Signed the application form(the signatures of the property owners and agents acting on their behalf are required);and
• Submitted the appropriate application fee(nonrefundable)payable to St.Croix County.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application.The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days.Upon receiving a complete
application and supporting documents,the Zoning Administrator will:
• send copies of the applications to the appropriate reviewing agencies for comment.Applicants-are encouraged to contact
their town to discuss their application and inquire about necessary building permits and approvals at the town level;
• schedule a site visit to the applicant's property,at which time the applicant shall flag all applicable property/project corners
and label the flags accordingly;and
• review the file and prepare findings for approval or denial of the permit within 60 days.Upon approval,the permit will be
mailed to the applicant or to the applicant's agent.
If approved,the land use permit will be valid for one year from the date of the permit issuance.The applicant may also be required to
apply through the Town for a local building permit.All site plans,pictures,and other materials submitted with the application become
the property of the Community Development Department and will remain in the file. ' 1 ,

• project location in the town;
• lot/parcel dimensions with total lot area,property lines,and all applicable setbacks;
• location of existing access roads,right-of-way,road setbacks,and recorded easements;
• location of all existing and proposed structures with their square footage and distance from setbacks;
• location of existing and proposed POWTS,wells,driveways,parking areas,access,signs,and other features;
• location of slopes 12%and greater(minimum contours to be determined by the Zoning Administrator);
• all blufflines and slope preservation zones(Riverway)and setbacks from blufflines;
• location of the OHWM of any abutting navigable waterways and all setbacks from the OHWM;
• location and landward limit of all wetlands,specifications and dimensions for areas of proposed wetland alteration;
• existing and proposed topographic and drainage features and vegetative cover;
• location of floodplain and floodway limits on the property;and
• any other unique limiting conditions of the property or information deemed necessary by the Zoning Administrator.
For projects that involve land disturbance requests,the following additional information may be required:
❑ Detailed drawings(scale should not be greater than 1 inch to 200 feet).
❑ Grading plan showing grading limits and pre and post contours.
❑ Project schedule and contractor list.
❑ Erosion control plan(Best Management Practices).
❑ Storm water management plan stamped by an engineer and including all runoff calculations.
❑ Vegetation plan including schedule,seeding rates,and species size,type and location.
❑ Other documents:

I am working on both the sanitary permit and this land use permit for new home construction along the Apple River in
the Town of Star Prairie. John Schmitt is both the plumber&excavator on the job, so it will be easy to coordinate
erosion controls, etc. for this site. Sanitary code requires the septic system to be above the floodplain and we will
measure all elevations in mean sea level to verify compliance with Shoreland,floodplain ordinance requirements.

Storm Water Management Description:
The project will consist of approximately 2800 square feet of impervious surface
including the driveway. All roof areas will drain to in ground seepage beds via a rain
gutter system installed on the buildings. The driveway runoff will be directed to small
rain gardens on either side of the driveway. All disturbed areas will be stabilized as soon
as possible. Silt fence or other means of erosion will be installed where necessary.
