The owner, as defined in chapter 101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements. The following conditions shall be met during construction or installation and prior to occupancy or use: • This system is to be constructed and located in accordance with the enclosed approved plans and with the "Mound Component Manual for Private Onsite Wastewater Systems VERSION 2.0" SBD-10691-P (N.O1/O1) and the SSWMP Publication 9.6 Design of Pressure Distribution Networks for ST_SAS (01/81) In the event this soil absorption system or any of its component parts malfunctions so as to create a health hazard, the property owner must follow the contingency plan as described in the approved plans. In addition, the owner must insure that the operation, maintenance and monitoring duties as described in section VIII of the Mound manual, and the pressure distribution component manual are complied with. A copy of this letter including instructions and information relating to proper use and maintenance of the system must be given to the owner and each subsequent owner upon completion of the project. • The well must be a minimum of 25 feet from any POWTS tank, and a minimum of 50 feet from the absorption area. • Access to the filter for cleaning must be provided per Comm 84 product approval conditions. lviaintenance information must be 4~iven to the owner of the tank explaining that periodic cleaning of the filter is required. • Limited activities are allowed in the area 15 feet down slope of the component area. Soil compaction, excavation, vehicular traffic and other similar activities that impact the treatment and dispersal are prohibited. • Comm 83.52(3) The activities relating to evaluation and monitoring mechanical POWTS components after the initial installation of the POWTS in accordance with an approved management plan shall be conducted by a person who holds a registration issued by the department as a registered POWTS maintainer. f ~ j ~ r [ i ' JACK A BOWMAN Page 2 I Ul3/o! • Comm 83.52 Responsibilities, The owner of a POWTS shall be responsible for ensuring that the operation and maintenance of the PO WTS occurs in accordance with this chapter and the approved management plan under s. Comm 83.54(1). In addition, the owner is responsible for submitting a maintenance verification report acceptable to the county for maintenance tracking purposes. Reports shall be submitted at intervals appropriate for the component(s) utilized in the POWTS. • Comm 83.52(2) A POWTS that is not maintained in accordance with the approved management plan or as required under s. Comm 83.54(4) shall be considered a human health hazard. • A Sanitary Permit must be obtained from the county where this project is located in accordance with the requirements of Sec. 145.135 and 145.19, Wis. Stats. • Inspection of the private sewage system installation is required. Arrangements for inspection shall be made with the designated county official in accordance with the provisions of Sec. 145.20(2)(d), Wis. Stats. • The changes made to this plan on i 1/13/01 by this reviewer were acknowledged and approved by the system designer. • An overpayment of $115.00 was paid. As of today's date, our records indicate that a refund in the amount listed in the FEE portion of this letter is due. The refund will be sent to you under separate cover. Please expect a 6-8 week time for fiscal processing. Refunds will be made to the payer. A copy of the approved plans, specifications and this letter shall be on-site during construction and open to inspection by authorized representatives of the Department, which may include Local inspectors. All permits required by the state or the local municipality shall be obtained prior to commencement of construction/instal lation/operation. In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should conditions arise making them necessary for code compliance. The owner of a POWTS shall be responsible for ensuring that the operation and maintenance of the POWTS occurs in accordance with this chapter and the approved management plan under s. Comm 83.54(1). In addition, the owner is responsible for submitting a maintenance verification report acceptable to the county for maintenance tracking purposes. Reports shall be submitted at intervals appropriate for the component(s) utilized in the POWTS. • Comm 83.52(2) A POWTS that is not maintained in accordance with the approved management plan or as required under s. Comm 83.54(4) shall be considered a human health hazard. • Comm. 83.52(3) The activities relating to evaluation and monitoring mechanical POWTS components after the initial installation of the POWTS in accordance with an approved management plan shall be conducted by a person who holds a registration issued by the department as a registered POWTS maintainer. • A Sanitary Permit must be obtained from the county where this project is located in accordance with the requirements of Sec. 14S.13S and 145.19, Wis. Stats. Inspection of the private sewage system installation is required. Arrangements for inspection shall be made with the designated county official in accordance with the provisions of Sec. 145.20(2)(d), Wis. Stats A copy of the approved plans, specifications and this letter shall be on-site during construction and open to inspection by authorized representatives of the Department, which may include local inspectors. All permits required by the state or the local municipality shall be obtained prior to commencement of construction/installation operation. In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should conditions arise making them necessary for code compliance. I recall a conversation we had regarding driveways in floodplain areas, I guess I need you to reassure me that a driveway can go through the floodplain as long as it is not higher than 6 inches from the original grade. The driveway will not cross any portion of a navigable waterway, so I dori t believe any other permits would be required. I am asking because Mickey is purchasing land from her ex-husband just south of her existing 6-acre parcel that she wants to extend the existing driveway to this property. The kicker is that the driveway runs right through the mapped floodplain we adopted. The area where she is building is about 30 feet above the mapped hydraulic shadow, so we should not have, ar-~ problems in the future. Please get back to me as soon as possible. Contingency Fund Request for Law Enforcement Conversion: Computer Services Director Kathryn Beutel said the conversion costs to the new system have gone over by $700. Payment for Track Lighting in the Jail: Public Protection Chair Speer explained a new digital camera is now used for "mug shots" and the present lighting is inadequate. The cost for track lighting was bid at $838 from Mitchell/Hansen Electric. Speer asked who should pay this cost--Maintenance Dept. or Jail fund. Facilities Director Ralph Robole was asked if the Maintenance Dept. could install this lighting at a lower cost. Robole said there are hard ceilings in the jail and access is difficult and wiring is difficult. The Maintenance personnel do not do much electrical work. Outside vendors are used for difficult and complex projects. Motion by Giese, 2nd by Dorsey to transfer $838 from the Contingency Fund to the Maintenance budget for track lighting in the jail. Motion by O'Connell, 2nd by Boche to adopt the amended agenda by removing the item on funding for a wage study as requested by Giese. The Personnel Committee wishes to re-address this issue. Motion carried. Next meeting scheduled for December 10. Motion by Dorsey, 2nd by O'Connell to adopt the minutes of September 28, 29, October 8 and and 26. Carried. Vouchers: Dorsey had reviewed the bills prior to the meeting and moved approval, 2nd by Giese. Carried. Finance Director: Rich Loney reported the apportionment sheets had been sent to the municipalities. The mill rate for the year 2000 is $3.58 compared to $4.05 in 1999 which is approximately a loo reduction. Regarding the transfer of the 1999 Contingency Furid balance to the 2000 budget, Loney said no motion was made during the budget process. Normal procedure has been to return this money to the General Fund. Chair Brown said action would be taken later when the amount remaining will be known. Loney said many departments will overspend their 1999 budget due to increased health insurance costs. It is too early to tell how the insurance fund is recovering, but Loney will give quarterly reports to the Finance Committee. County Clerk: Sue Nelson said the Safety and Security Committee discussed decorative barriers by the front and side entrances but did not believe it feasible to install them due to the large number needed. No decision was reached on posting signs regarding use of a camera. Committee will revisit the issue. Doa Damage Claim: Motion by Boche, 2nd by Dorsey to approve $260 claim for loss of a steer by Norman Hagen, Town of Glenwood. Carried. Corporation Counsel: Greg Timmerman hoped the ownership issue of the flume on Cedar Creek would be solved this week. DNR has discovered NSP does not own the land under the flume. According to DNR the County does own the land and Timmerman is seeking more information. Supr. Berenschot commented the Star Prairie Sportsmen Club has an interest in and would be responsible for this area. Timmerman will view the area and provide a sketch for committee members. Y2K Committee Budget: Chuck Mehls, Chair of Y2K committee explained the Emergency Operations Center plan for the Y2K event. The chain of command was outlined with Jack Colvard, Emergency Government Director, as chief in command. Mehls requested a member of Finance be present the night of December 31. Dorsey plans to be there and O'Connell volunteered as an alternate. The EOC will be set up Friday noon on December 31 and remain up until Monday noon. Staffing will be present from 9:00 pm., Dec. 31 to 3:00 am. on Jan. 1. Mehls said the biggest concerns are power and communications. Some municipalities are setting up EOC units also. Mehls outlined the Contingency Planning including Reaction Force, Emergency Operation Center and Patrol Division. The funding request of $1,016.24 includes money for RACES (Amateur Radio people), mileage, postage, food and refreshments and unanticipated expenses. The over time costs for Sheriff's and Computer Services Departments will be paid from their 2000 budget. Motion by Boche, 2nd by Giese to allow $1,020 for the Y2K committee. Carried. Interim Administrative Coordinator: Don Brown said he took this position to keep continuity especially in the budget and negotiations process. He believes things are going very well and noted the 2000 budget is a success with a 10% reduction in the mill rate. Dorsey said in regard to filling the Administrative Coordinator position, the Screening Committee is scheduled for Nov. 11 and 12 and interviews will be held the first week in December. Glen Hills Structure 2: Supr. Berenschot, Mickey and Darren Brettingen were present. Chair Brown read a letter from Ms. Brettingen in which she gave the history of her house and property. In 1996 she was granted a sanitary permit by the County Zoning Office and a building permit from the Town of Glenwood. A double wide home was placed on the property. Shortly after, Bob Heise from the Land and Water Conservation office informed her the home should not have been placed there. A moratorium was placed on this area to not allow any more building permits being issued. We recommend this information often to be provided on many C.S.M.'s that are located in or near flood plains. I also recall that Dave Salissen made a statement at that meeting that a certain % of the cost of the C.S.M. could be covered under this agreement as eligible costs. (The % was not determined.) I did receive a phone call from a interested surveyor looking at doing this project and I had talked to him regarding the issues out their, other surveys and elevations that were already identified and permanent Bench Marks and elevations to which they could use as their Datum. The county highway and LWCD surveyed elevations identifying the flood plain and Hydraulic shadow to assist Micky in identifying IF the existing septic system could be used. This survey also identified floodplain boundary line to aid her in her future decisions on house and septic locations. (We did not have to do this!) We provided this service to move thing along for her and to help her in the decision making process. Although, these floodplain elevations have been shot and identified on the ground we had discussed having these floodplain locations and elevations identified on the C.S.M. The C.S.M. serves as a recorded document with required information attached to it for future references or sales. Reports shall be submitted at intervals appropriate for the component(s) utilized in the POWTS. • Comm 83.52(2) A PO WTS that is nvt maintained in accordance with the approved management plan or as required under s. Proper maintenance consists of pumping out the septic tank every three years or sooner, if needed by licensed septic tank pumper. What you put into the system can affect the function of the septic tank as a treatment stage in the waste disposal system. St. Croix County residents may be eligible to receive a grant for a maximum of 60% of the cost of replacement of a failing system, which was in operation prior to July 1, 1978. St. Croix County accepted this program in August of 1980, with the requirement that owners of all new systems agree to keep their system properly maintained. The property owner agrees to submit to St. Croix Zoning a certification form, signed by the owner and by a mater plumber, journeyman plumber, restricted plumber or a licensed pumper verifying that (1) the on-site wastewater disposal system is in proper operating condition and (2) after inspection and pumping (if necessary), the septic tank is less than 1/3 full of sludge and scum. This situation is a bit tricky because of the age of components and the floodway issue. The new code in 83.32(3)(c) does generally prohibit a new POWTS from being built in the floodway unless allowed under NR 116. I'm not sure what NR 116 states specifically, but it likely speaks to things being constructed or replaced, and not what existed prior to the code and in use now. It is my understanding that the current provisions of 83.32(3)(c) are not retroactive, and thus to determine the compliance of the soil system on this one issue (we should also be checking vertical separation) we need to know the date of installation. I suspect that if NR 116 doesn't prohibit continued use of the soil absorption system, the Department of Commerce will allow its continued provided it is in compliance with the other provisions of Comm 83. If you need a defmitive answer on our position, I suggest we consult with Roman Kaminski, POWTS Program Manager. Unfortunately, he's out until next week sometime. I will bring this matter to his attention and get back to you, unless you're satisfied with my interpretation. Is effluent sampling required for all POWTS systems approved after July O1, 2000? A. No. There is no provision in the new code that automatically requires effluent sampling from all POWTS systems. Sampling could be required by the department or perhaps by the manufacturer of a treatment component, for a specific POWTS system. A sampling requirement would typically be listed in a POWTS system design approval letter or in a management plan that accompanies the approved plan. Q. Under the new code, if someone is replacing a septic tank the soil absorption site does not have to be upgraded if: 1. Documentation is available to show that the system complied with the rules in effect at the time of approval/installation, and; 2. There is proper vertical soil separation between the bottom of the infiltrative surface and a limiting condition. Is this correct? A. Yes, this is correct. If documentation is not available then the next logical step would be to conduct an evaluation of the system against whatever code was in effect at the time it was installed. The most critical issue would be the vertical soil separation distance. Older systems should-not be evaluated against the new code with the exception of a few specific instances that are 'clearly listed in the new code. (Example -Minimum two foot vertical soil separation requirement for systems installed prior to Dec. O1, 1969. Q. I read in the Plumbing Code Report that fees are being revised and that Comm 2 where the fee schedules are listed will go into effect on September O1, 2.000. Is that when the POWTS related fees will change? A. No. The POWTS program related fees were included in the Comm 83 "code package" that went into effect on July O1, 2000. Q. In Table 2.65 it appears that there is an error in the fee schedule for holding tanks. Specifically, items 3. and 4. are worded identically. Is there an error? A. Yes. When the code was printed by the Revisor's office the word "not" was inadvertently omitted in 4. The correct wording should be: "Holding tanks not approved under s. Comm 84.10(2) or (3):". Q. I can't find any reference in the new code for submitting plans to the Department for a POWTS system that will be installed in a floodplain. Can the county approve plans for those categories of POWTS systems listed in Table 83.22-3 that may be installed in a floodplain? A. A county may review and approve plans for those categories of POWTS systems listed in Table 83.22-3, (or Table 83.22-2 if a designated agent). The design must meet all the floodplain criteria found is ss. Comm 83.32(3)(c) and Comm 83.45(6). Consultation with the Department of Natural Resources regarding the requirements of NR 116 may be necessary. Completion of the old "Plb 89" form is no longer necessary. Q. Is there a standard "management plan" example that the department will provide as a guidance document? A. No. The department will not be providing an example of a standard management plan. While the management/maintenance requirements for a "traditional" septic tank soil absorption system would seem to be the same for all applications, that may no longer be true under the provisions of the new code. Designers may select different and/or additional treatment components that require their own unique management/maintenance schedules. For example, a "traditional" septic tank soil absorption system may now also include a treatment tank outlet filter or maybe instead of a septic tank the design will include a "trash tank" upstream from an aerobic treatment unit. Each of these treatment components will have a specific management/maintenance schedule required by the manufacturer and/or the designer. Because of the many component combinations that are now available, it is not possible to provide a standardized example. We will post examples of various managementlmaintenance documents on our website as they become available. Q. Is a management plan a stand alone document, or should it be included with other documents during the plan review/Sanitary Permit issuance process? A. The ultimate goal is to insure that the POWTS system owner has a managementlmaintenance plan that they can refer to. For example, the component manuals currently recognized by the department have a requirement fora "User's Manual" that contains additional important information such as contact names and phone numbers. A management plan could be included as part of this user's manual. It could also be a stand alone document in addition to the user's manual. The provisions of the management plan could also be included in the POWTS design documents as long as the management plan details are clearly identified.
