CROIX COUNTY, WISCONSIN Case No: 57-91 Filing Date: 7-31-91 Notice Dates: Weeks of Aug. 5 & 12, 1991 Hearing Date: Aug. 22 , 1991 0 FINDINGS OF FACT Having heard the testimony and considered the evidence presented, the Board find the following facts: 1. The applicant or appellant is: Daniel & Carol Hegman 193 River view Acres Rd. Hudson, WI 54016 2 . The applicant or appellant is the owner of the following described property which is the subject of the application or appeal : Gov't Lot 4 of Sec. 35, Town of St. Joseph, St. Croix Co. 3 . The property is presently used for: 4 . The applicant or appellant proposes: To construct a four season addition replacing an existing deck on the bluffline. 5. The applicant or appellant requests: A variance permit under section 17. 36(5) (c) of the ordinance. 6. The features of the proposed construction and property which relate to the grant or denial of the application or appeal are: The applicant submitted two plans showing the location of the proposed four season addition. The desired location shows the addition over the bluffline . The township provided correspondence supporting the proposal. CONCLUSIONS OF LAW Based on the above finding the fact the Board concludes that: VARIANCE- The variance will be contrary to the public interest as expressed by the objectives of the ordinance because the addition will be more visually conspicuous from the St. Croix River . Also , in the absence of this variance there is a reasonable use of the property. A variance to this project would further encroach upon the the bluffline. 1 r r ORDER AND DETERMINATION The basis of the above finding of fact, conclusions of law and the record in this matter the board orders: VARIANCE/SPECIAL EXCEPTION - The requested variance permit is denied. Motion to approve by Sinclear, seconded by Kinney. Motion carried. Vote: Menter, yes; Sinclear, yes; Kinney, yes and Bradley, yes. ****************************************************************** This decision may be appealed by filing an action in certiori in the circuit court for this county within 30 days after the date of filing of the decision. The municipality assumes no liability for and make no warranty as to the reliance on this decision if construction is commenced prior to expiration of this 30 day period. ZONING BOARD OF APPEALS/ADJUSTMENT Date: Signed �.w.� � Filed: 9-24-91 Chairperson cc: Town Clerk and file 2 BOARD OF ADJUSTMENT MEETING AND HEARING Aug. 22, 1991 This meeting was recorded by a court reporter The meeting was called to order by chairman Kinney at 8:00 A.M. chairman Kinney explained the procedures of the hearing, requesting that individuals wishing to testify sign their names and addresses on the sheet in the front of the room. Supervisors Bradley, Menter, Sinclear and Kinney were all in attendance. Supervisor Stephens absence was excused. Staff included Corporation Counsel Greg Timmerman and Zoning Administrator Tom Nelson. Bradley made a motion to adopt the agenda as presented. Menter seconded the motion. Motion carried. OLD BUSINESS ZAPPA BROTHERS EXCAVATING There was a general discussion on what had been happening with the gravel and sand operation Zappa Brothers were operating. GARY CARLSON Mrs. Gary Carlson requested another extension of their temporary occupancy permit of the trailer home while they built their new home. Bradley made a motion to extend the period until Jan. 1, 1992 after which time the trailer house must be vacated and removed. Motion seconded by Menter. Motion carried. NEW BUSINESS Hearing was called to order at 8 : 30 A.M. Nelson read the notice of the hearing as published: The St. Croix County Board of Adjustment as scheduled a public hearing for Thursday, Aug. 22 , 1991 at 8: 30 A.M. in the County Board Room of the St. Croix County Courthouse, Hudson, Wisconsin to consider the following appeals to the St. Croix County Zoning Ordinance. An on site investigation will be made of each site in question, after which the board contemplates adjournment into closed session for the purpose of deliberating on the appeals, pursuant to Sec . 19 . 85 ( 1 ) (a) , Wisconsin Statutes , and will reconvene into open session for the purpose of voting on the appeals. 1. Nelson stated that no plan has been submitted dealing with their proposed non-metallic mining operation. Sinclear made a motion to postpone a decision until the necessary information has been provided. Motion seconded by Bradley. Motion carried. DUANE & CONNIE HAUPT 2 Duane requested a variance of 14 feet to build an addition closer to the ordinary high water mark of Squaw Lake. At 61 feet, theirs would be constructed over an existing deck. The township of Star Prairie supports this proposal. EUGENE SCHULDT Eugene requested a variance of 12 feet to be closer than 200 feet to another driveway. This location is the .safest access from the town road onto the lot. The township of Star Prairie supports this proposal. TOM GLEASON Tom presented a variance request of 175 feet from another driveway on STH 35. This location would provide central access to property that could someday provide multicommercial uses. The township of St. Joseph supports this proposal. TOM & KELLY LEMURE Kelly presented a request for an 18 hole golf course and driving range. The driving range would be constructed first with the golf course being added later. Should the clubhouse ever be desired for restaurant or entertainment purposes it would have to be rezoned to commercial . The township of Star Prairie supports the proposal . DEAN EGGEN HOMES/FRED & SANDY SOBOTTKA Dean requested a variance to construct a residence 51 feet from the township road. The proposed setback is the most conducive for a walkout basement. Discussion on if there is a true hardship. The township of Troy recommends they be 70 feet from the town road. WAYNE STRAUB Nelson stated that this salvage operation had been reported as a violation of the ordinance. Straub is requesting a special exception for a salvage operation. The township supports this proposal as do adjoining property owners. TERRY LARKIN/FRANK BACHMAN Terry presented a request to build 40 feet from the bluffline onto an existing residence. In addition he would like the 50% rule relaxed, allowing him to exceed 50% of the assessed value. Discussion on how the Board of Adjustment has no authority to relax this provision. Motion by Sinclear to postpone a decision so as to receive estimates of the values of the construction. Motion seconded by Bradley. Motion carried. DAN & CAROL HEGMAN Carol requested a variance allowing the construction of a four season room to be built over the bluff of the St. Croix River. Nelson stated this was a convenience and not a hardship and should be denied. 3 ALLEN NYHAGEN/MARK FAGERLAND Al presented a plan for filling and grading within 300 feet of a navigable water for the purpose of constructing a road to serve a subdivision. This plan also included a seeding and erosion control plan.
