Croix County Board of Adjustment conducted a public hearing on September 27 , 1983 to consider the request of Patrick Strand for a special exception use , Article 8. 4 B2b , Highway Setback , ST. CROIX COUNTY ZONING ORDINANCE . The St . Croix County Board of Adjustment conducted an on-site inspection .of the site in question . After inspection , the St . Croix County Board of Adjustment entered an Executive Session to discuss the request . After returning to open session , the following decision was rendered . Motion by Supervisor Stephens to grant approval of ° a 75 foot setback from the centerline, of CTH "T" . Seconded by Supervisor George . Motion carried. George , yes ; Stephens , yes ; Meinke , yes . Minutes of the August 23 , 1983 meeting and hearing approved. Old business : Steven Breault . Board did not act on the setback from water. Hearing called to .order by Chairman Meinke . Zoning Administrator Harold Barber read notice of hearings as published in the county and local news- papers . 1 . ARTICLE : 2 . 3 D. 1 , Sideyard Setback APPELLANT : Deane Jameson LOCATION : NEk of SE%, Section 4 , T30N-R18W , Town of Richmond Mr. Patrick Strand presented his request to construct a house that would be 75 feet from the centerline of CTH "T" . Zoning Administrator read letter from Town Board having no objections . Mr. Richard Peterson spoke in favor of the request .. Mr. Richard Krampert presented his request to leave fill in a pond on his property . Mr. Chris Bethke , Town Chairman , informed the Board that they have no objections . The pond is man made and he feels that there should not be any restrictions after the fact . Stanley S,Ilmeiuer , DNR, Game Warden , objects to the request as the rock in the pond is in violation of Chapter 30 of the. Statutes . The pond is approximately 1/2 acre in size . There is litigation pending on this property. Mr. Wallace Cudd presented his request to rip-rap the shoreland on his property. He also wished to construct a. 13' x 24 ' addition to his house that would be the same distance from the lake as the original structure . He also would like to rebuild a wall on his property . Mr. Ted Orf presented his request to use a structure that was used as a church camp . He wishes to use this structure as a summer cabin. Zoning Administrator read a letter from DNR opposing the request . Mr. Marion DeJong presented his request to install a holding tank on his property for a mobile home for a family member. The mobile home is for his daughter and is a temporary situation . Mr. Steve Wilcox presented the request of Dr. Robert Howard to place rip- rap on his shore line that will stop erosion on his property. Questions by members of the Board. Mr. Deane Jameson presented his request to construct an addition to his house that would be 4 feet from the property line of James Moeller. Questions by members of the Board . Hearing recessed to inspect the properties in question. Committee entered into executive session to discuss the properties in question. Board returned to open session to render the following decisions : 1 . Richard Krampert : Motion by Supervisor Stephens to grant the request . Seconded by Supervisor George . Motion carried. Vote to approve : George , yes ; Stephens , yes ; Meinke , yes . 2 . Wallace Cudd : Motion by Supervisor George to approve the request . Seconded by Supervisor Stephens Motion carried. Vote to approve : George , yes ; , Stephens , yes ; Meinke , yes . 3. Ted Orf : Motion by Supervisor Stephens to approve with the stip- ulation that any further exterior or interior improvements other than normal maintenance be made , or if plumbing containers (sinks , lavatories , sanitary stools ) or water be installed this variance shall automatically be revoked and the building shall be returned as close as possible to the status of date of purchase by Ted Orf , Jr. Ted Orf , Jr. shall understand that the premises may be inspected without notice by the Zoning Administra- tor or Environmental Protection Officer once every thirty ( 30) days . Seconded by Supervisor George , Motion carried. Vote to approve : Stephens , yes ; George , yes ; Meinke , yes. 4 . Marion DeJong : Motion by Supervisor Stephens to grant approval. Seconded by Supervisor George . Motion carried. Vote to approve : Stephens , yes ; George , yes ; Meinke , yes. DeJong holding tank to be inspected as per state regulations . 5 . Robert Howard : Motion by Supervisor George to grant approval of rip-rap on Bass Lake. Seconded by Supervisor Stephens . Motion carried. Vote to approve : George , yes ; Stephens , yes ; Meinke , yes . 6. Patrick Strand : Motion by Supervisor Stephens to grant approval of a 75 foot setback from the centerline of CTH "T" . Seconded by Sup- ervisor George . Motion carried. Vote to approve : George , yes ; Stephens , yes ; Meinke , yes . 7 . Deane R. Jameson : Motion by Supervisor George to deny the request to construct an addition four (4) feet from the property line . There is adequate area to the rear of the house to expand and the request would be too close to the property line . Seconded by Supervisor Stephens . Motion carried. Vote to deny : George , yes ; Stephens , yes ; Meinke , yes . Discussion of the Breault request on Bushnell Lake with District Attorney . ,. The District Attorney requested a copy of the building permit , a letter from DNR on establishing the highwater mark and location of the highwater mark. Harold is to talk with the Town Clerk. Being no further business before the Board a motion by Supervisor George to adjourn. Seconded by Supervisor Stephens . Motion carried. Meeting and hearings adjourned at 4 : 15 p . m.
