Re: Completion of the Waste Storage Pond-Baldwin Dairy
The waste storage pond on the Baldwin Dairy is now complete except for the seeding and mulching. The
facility was constructed according to the original plan except that the following changes were made:
1. A leakage detection lysimeter was added to monitor leachate quality and quantity under a i%
sample of the side slopes and the bottom.
2. Steel rods were installed as wear gages to indicate when the clay liner will have to be refurbished. I
understand that twelve gages were installed. The gages are 6" below the surface of the liner. It is
understood that,when the gages become visible, the liner will be refurbished.
3. Two concrete agitation pads and sumps were installed instead of the five that we originally specified.
This change was made at the landowner's request to accommodate the way that the pit would be
emptied. Their intention is to agitate the pond lightly at a number of places rather than to do
vigorous agitation at limited agitation points. The agitation will be done at the surface of the pond
rather than at or near the bottom. Since the three additional pads will seldom if ever be used, they
were eliminated from the design.
All of the changes are consistent with the minimum requirements of the NRCS standards 313"Waste
Storage Structure"and 425"Waste Storage Pond'. To the best of my knowledge, belief and
professional judgment, except for the seeding and fencing, this storage facility now meets or exceeds the
minimum requirements of the Natural Resources Conservation Service's standards.
In talking to the St. Croix County LCD, I understand that the landowner can now begin suing the waste
storage pond. The pond will therefor be put into service today. I will send the"As Built"plan when the
seeding and fencing are complete.

Dear Mr. Vrieze :
This is a reminder that as a condition of granting the special
exception you received on 5/20/97, the Board of Adjustment Decision
included a requirement that the old manure pit be properly
abandoned and the new pit be constructed and utilized. It has come
to our attention that construction has stopped on the new manure
pit . This pit must be completed for the special exception permit
to be valid.

FINDINGS, CONCLUSIONS, AND DECISION
OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT
Having heard all the testimony, considered the entire record
herein, and conducted an on-site inspection, the Board finds the
following facts:
1. The applicant is Vrieze Farms, Inc. whose address is 2036 Co.
E. , Baldwin, Wisconsin.
2. The applicant on February 28, 1997, filed with the Zoning
Office an application for a special exception request for
livestock operations in excess of one animal unit.
3 . John Vrieze is an owner of the property which is the subject
of the application and is located in the SE1/4 of the SW1/4 of
Section 12, T29N-R17W, Town of Hammond, St. Croix County,
Wisconsin.
4. The subject property is presently used for agriculture.
5. John Vrieze, being duly sworn, states that his address is 2036
Co. E, Baldwin, Wisconsin and that he is the agent for Vrieze
Farms.
6. Tom Nelson, Zoning Specialist, informed the Board that this is
a request for exceeding number of animal units, noting that 1
cow = 1 animal unit, 2 calves = 1 animal unit.
7. The following Exhibits were introduced:

Exhibit 3 : Construction Plan
Exhibit 4: Copy of CSM (10.89 acres)
Exhibit 5: Correspondence from the Town of Hammond in support
of the application.
8. Vrieze stated that he is asking for 450 cows on 11 acres. All
of the plans for this have been taken care of.

9. Pete Kling, being duly sworn, states that he is from the Land
Conservation Office in Baldwin, Wisconsin and that he has been
working with Vrieze on this project. They have come up with
a Nutrient Management Plan.
10. Kling feels that he has enough land leased, 715 acres, to
dispose of the manure.
11. The Board asked that he provide copies of the signed
agreements to have on file with the county. Vrieze stated
that the leases are 5-10 years. Chairman Bradley asked who
will keep track of the leases as they expire, and Kling
answered that he will.
12. Bob Heise, previously sworn, stated that he has gotten a few
calls from concerned people on this matter. They gathered
them all together at Heise's office and answered any questions
that they had. He feels that the concerns have been taken
care of.
13 . Vrieze informed the Board that they will have no young stock.
14. This is a whole new facility, with 250 acres surrounding it.
They have plans drawn for a 405 day storage under the barn
with a clay lined pit. The pads in the pit for pumping are
concrete. He noted that he will be following Heise's plan.
15. Nelson asked that Land Conservation be notified when the pit
is pumped.
16. Mike Tiery, being duly sworn, states that he owns Tiery
Engineering in Chippewa Falls, Wisconsin and that he is the
consultant that designed the manure storage unit. He has also
consulted with Heise.
17. Tiery stated that he has designed hundreds of these and
believes this to be a perfectly safe structure in protection
of ground water. The unit should hold 240 days (8 months)
storage for 450 head of cattle. The frequency of pumping from
storage pond will probably be about every 6 months (spring and
fall) . Pumping from the barn to the pit will probably be
weekly.
18. Kling noted that some neighbors were concerned about ground
water. Tiery explained that a licimeter will take care of
monitoring this, and Kling agreed that this is a very good way
to monitor.
19. Introduced Exhibit 6, a copy of a licimeter diagram. Tiery
explained that if anything gets through the clay liner, it
will mostly be just water. There will be very little
nitrates. The licimeter will track this. The clay liner will

be inspected whenever empty to check for any erosion due to
agitation.
20. Vrieze stated that his family has lived there many years and
it is important to them to do this project properly.
21. Larry Sanford, being duly sworn, states that he is from
Bloomington, Minnesota. He is an adjacent co-landowner of 100
acres to the east. His father has referred to this land as
the best drained area around. Has concerns about any leakage
from the pit and how it will affect the ground water, and is
also concerned about the proper disposal of manure.
22. Sanford asks that the best monitoring equipment be used for
this. He is also concerned about the setbacks of the pit.
23. Nelson stated that setbacks are not an issue here.
24. Sanford is also concerned about pollutants in the air. He
wonders if this business will also cause more traffic on the
road with feed being brought into 450 animals.
25. Sanford did state that he has met with Land Conservation, but
wants to be sure that Vrieze is in compliance with above
concerns.
26. Vrieze said that a truck will be coming in once a day for
feeding. They do not plan on feeding at night. He noted that
the road is already quite busy. He also stated that there is
not a setback and that everything will flow towards his land,
not toward the neighbors. .
27. In addressing the pollution issue, Vrieze noted that there
will be a smell twice a year when the manure is moved out of
the pit. He will let Land Conservation and the neighbors know
when they plan to empty the pit.
28. The Board will visit the site later today.
CONCLUSIONS OF LAW
The Board concludes that:
1. The Board of Adjustment has authority under Section 17.70 (5)
(c) 4 to approve special exception uses.
2. Special exception uses may be terminated as per 17.70 (7) (d)
of the St. Croix County zoning Ordinance if the plan or the
conditions of the decision are not followed.

3 . This application conforms to the requirements of
sec. 17.15(6) (o) St. Croix County Zoning Ordinance.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and
the record herein, the Board approves the applicant's request for
a special exception for livestock operations in excess of one
animal unit and has been approved on the following vote:
A. Jensen yes
T. Filipiak yes
N. Golz yes
Chairman Bradley yes
with the following conditions:
1) Copies of data from licimeter tests relating to area
wells that are provided to Land Conservation should be
sent to the Zoning Office. This should be an ongoing
process to determine any nitrogen level increases.
2) Construction to be consistent with plan submitted or with
any changes by agencies.
APPEAL RIGHTS
This decision may be appealed by any person aggrieved by filing an
action in certiorari in the circuit court of this County within 30
days after the date of filing shown below. The County assumes no
liability for and makes no warranty as to the legality of any
construction commenced prior to the expiration of this 30-day
period or the identity of any person who may claim to be aggrieved
by this decision.
