BOARD OF ADJUSTMENTS
The public hearing held October 10 , 1975 , was called to
order at 10 :00 by Chairman Afdahl. All members present.
The Zoning Administrator, Harold Barber, read the request of Mr.
Ronald Pflieder to construct a garage on his property not meeting
the required setback distance. He wishes to construct approximately
33 feet from the centerline of Cove Road, Troy Township.
The Zoning Administrator also informed the group that he had
not received a reply from the township or the Department of Natural
Resources stating any objections.
Mr. Harper Welton, neighbor, objected to the proposed construction
due to the run-off causing severe erosion problems in the past.
Mr. Pflieder informed the group that he had received a building
permit from the township in July not knowing of the 133 feet setback
requirements and the St. Croix Riverway Ordinance.
Questions wereasked`by the Board members.
Mrs. James Wilson, neighbor, informed the Board that her family
had no objections to the construction of the garage.
Chairman Afdahl informed the group that the Board would inspect
the property before making a decision. Hearing adjourned on request
for setback variance.
Mr. Kenneth Peterson and Mr. Gerald Dopkins , Board of Adjustments
Members , Highway Commissioner, and Zoning Administrator informally
discussed the Hammond gravel pit.wit
Mr. Ralph Brown, Highway Commissioner informed Mr. Peterson and
Mr. Dopkins that the County Highway Department could put calcium
chloride on the road to help hold down the dust.
Inspection was made of the Pflieder property. Members of the
Board elected to wait on decision until receiving a reply from the
township and DNR.
Hearing adjourned at 4:40 p.m. The next Board of Adjustment
hearing is scheduled for November 11, 1975, at 10 :00 a.m.

Dear Harold:
This is to verify our discussion of a few days ago on the highway department
policy the last few years in regard to returning depleted gravel pits, etc.
to their best possible use.
In the past three years the St. Croix County Highway Department has instituted
a policy and have been leveling the gravel pits the county crushes out and
have been depleted. Examples of this would be the following:
Erickson Pit located in the Town of Eau Galle,
S.E.4 Sec. 9, T28N-R16W
Hagen Pit located in the Town of Glenwood,
S.E.'3r, Sec. 33, T30N-R15W. (A limestone ledge is
exposed here due to private contractor testing).
Van Dyke Pit located in the Town of Richmond,
S.E.k Sec. 24, T30N-R18W. (Pit is still in operation
some distance off the road, the front part is now
being cropped).
There are numerous sand pits the county hauled from the past years that are
now back in shape and being cropped.
The St. Croix County Highway Department does intend to�se-turn the Hanson
Pit located in the Town of Hammond, N.E.3r, Sec.16, T NF L? 1,ts best
possible use when they finish crushing there.

Re: Gravel Pit on Christian Hanson Property
Dear Mr. Barber:
As you know, on Monday September 15, 1975 I reviewed the records regarding
the above entitled variance in your office.
The reivew of the records was provoked by our office having been retained
by certain interested residents in the vicinity of the gravel pit.
The immediate concern of the residents is the failure of the owner and operator
to comply with provision number 3 as stated in your notice of October 10, 1974.
This letter will formally call to your attention the fact that provision number
3 has not been complied with at all.
It was the understanding of the residents that provision number 4 was to; be
an emergency exit as previously indicated by you to Mrs. Kenneth Peterson.
Rather than utilizing the access called for in provision number 4 as an emer-
gency exit, that particular access is used as the only access to the gravel pit.
The residents have also been led to b6lieve that the access called for at pro-
vision number 3, which is intended to be the main access is not intended to be
installed by either the owner or the operator.
It is, therefore, the purpose of this letter to call this violation to your
attention so that immediate steps can be taken for the enforcement of the var-
iance restrictions.
I can appreciate the difficulties in enforcement of zoning ordinances and the
difficulty of gaining their acceptance by the electorate. Because of these
problems, it would seem particularly,, important to enforce the ordinance against
municipalities in favor of the electrorate in a most careful manner. As you know,
the typical case involves the municipality enforcing the ordinance against a
member of the electorate. In this instance the reverse is true. I would hope
that your office and that of the Highway Commissioner is not one which concludes

that "the king can do no wrong."
In going through your records I also note that apparently no action
has been taken with respect to Stipulation number 5 which is specifically called
for in the ordinances.
I indicated to my client that I would be writing this letter to you
and requesting that some positive action be taken toward correction itithin the
very near future. I indicated to them that I was confident some action could
be taken within ten (10) days from the receipt of this letter and would hope
that is not an unreasonable request.

TO WHOM IT MAY CONCERN:
After inspection of the Hanson property, there was evidence that
open pits were discovered .on land in question and surrounding
lands . The Board of Adjustments found that gravel had been
taken from adjoining land to the west which has run out of good
road material.
The Board of Adjustments agreed to grant a variance for the
gravel pit provided the following restrictions are met .
(1) Extreme east end of the gravel pit be no closer than
1000 feet from center line of CTH "T" .
(2) Gravel from pit will be used exclusively for St .
Croix County roads .
(3) Access drive shall enter town road on extreme north-
west corner of property.
(4) ' Access to east side of property shall be no closer
than 300 feet north of present property owner on
CTH "T" .
(5) Bond or financial guarantee shall be in writing, re-
corded and a copy of the agreement in the Zoning
Administrators office to insure that land will be
returned to its best possible use within one year
after pit is closed.
(6) If any changes of the above requirements are to
be made, Mr. Hanson will have to have another
public hearing.

BOARD OF ADJUSTMENTS HEARING
Hearing called to order by Chairman Afdahl at 10 : 00 a.m.
Due to the amount of people attending the hearing it was moved to the
County Board Room.
Chairman Afdahl had Zoning Administrator read the request of Christian
Hanson for Hanson Brothers to put a gravel pit in the NE 1/4 of Section
16, T29N-R17W. A portion of the land would be used for a gravel pit .
Attorney John Davison spoke for Mr. Hanson explaining the need for
gravel pits in the county and this land is one of those that have
acceptable soils for road construction use . Not all property has soils
that can be used for road building materials .
Persons apposed to the granting of a variance are as follows :
Mrs . Kenneth Gullexson- trucks traveling road would be dangerous
for children. Also with a gravel pit in the area property values
would go down and it would not be fit to live in the area due to
dirt and dust .
Kenneth Peterson-traffic and children living in the area.
Others speaking against the variance were : Reuben Jacobson, Don Roth,
James Cutler, Marion Peterson, Don Elhorn, and Kenneth Gullexson.
Being no further discussion Chairman Afdahl stated that the Board
would make a decision after inspecting the property. The Hanson hearing
closed.
Mr. Gail Swanson requested to build a silo 85 feet from the center line
of town road in Township of Star Prairie.
Zoning Administrator read notice and request of Mr. Swanson.
Mr. Swanson explained that due to land, buildings and water in the area
it would be impossible to build further from the road. He also stated
that the new structure would not cause any sight problems because the
road is straight and the road access is on the level .
Questions from Supervisors Holmes and Luckwaldt .
Chairman Afdahl informed Mr. Swanson that after inspection of the property
a decision would be made and the Zoning Administrator will send him a
notice.

Hearing adjourned in order to make inspections .
Mr. Gene Swanson asked the board if he could speak to them about a
building that was built by Menard Pole Buildings in Eau Claire. The
building is 94 feet from the center line of town road. Mr. Swanson
said that the building was staked out more than 100 feet but when it
was constructed it was moved without his knowledge . Mr. Swanson
wanted to know what could be done. He was informed that he should
probably have his attorney write to Menards and request that the
building be moved back to the 100 foot setback as Menards have a copy
of the St . Croix County Zoning Ordinance and know the setback requirements .
Being no further business the hearing was adjourned to make inspections
of the properties of Swanson and Hanson.
After inspection of the Gail Swanson property. A motion by Luckwaldt
to permit the construction of a silo no closer than 85 feet from center
line of road. Seconded by Holmes . Motion carried.
After inspection of the Hanson property, there was evidence that open
