CROIX COUNTY BOARD OF ADJUSTMENT HEARINGS Meeting of June 26, 1979 , called to order by Chairman Pierson at 10 :00 a.m. Present were : Supvs . Pierson and Afdahl. Absent : Supv. George. Minutes of . the May meeting accepted as read. Zoning Administrator read correspondence from Professor Lehmann on private airstrips . Chairman Pierson said that this will be brought up at the next meeting. He would also like to set-up a joint meeting with the Zoning Committee. Hearing called to order by Chairman Pierson at 10 : 15 a.m. Supv. George absent. Chairman Pierson informed those present that the Zoning Administrator would inform them after inspection of the property of their decisions . Zoning Administrator read Notice of Hearing as published in the county designated newspaper. 1. Mr. Gerald Baumgardt, representing Ed Kraemer & Sons and Mr. & Mrs. Virgil Stang, requested to open a gravel pit in the SE4 of NE-,, of Section 31, T29N-R15W, Town of Springfield. There had been a gravel pit on the property. but it has been closed for several years . The land will be returned to agriculture when the pit is closed. Questions by Board members . There will not be a hot mix plant on this site. 2. Mr. Elmer Magsam, SW-, of SW4 of Section 32 , T29N-R19W, Town of Hammond, requested to construct an addition to his house that would setback 75 feet from CTH J. The addition would not cause a traffic hazard. Mr. Magsam informed the Board that he was granted a building permit from the Township not knowing he needed a variance. He did not proceed after receiving orders from the Zoning Office. Zoning Administrator informed the Board that the Township made an error in issuing the building permit. 3. David Cloutier, NE4 of NE4 of Section 4, Lot 12 , High Ridge Court, T28N-R19W, Town of Troy, requested a variance of 8. 4(B) , highway setbacks . He requested to have a setback of 100 feet from the interior of the blacktop of a cul-de-sac . He has a problem with a slope and possible erosion problem as well as losing some large trees if 'he would build 133 feet back. Questions by Board members. Mr. Frank Ogden adjoining landowner had no objections to the lesser setback. Zoning Administrator, Harold Barber , objected as all lots in this subdivision could meet the setbacks . 4. Gary Svenningsen, NZ of NE4 of Section 14, Lot 18 , High Ridge Court, T29N-R19W, Town of Troy, requested to construct a house 85 feet from the centerline of a town road in the subdivision. He stated that building a house 133 fe^t- from the centerline that only the roof top could be seen from the road_,.: Mr. Francis Ogden explained the subdivision on how it had problems with slopes , etc. Questions by members of the Board. Zoning Administrator, Harold Barber, objected as there is a building site on all lots within the subdivision. 5. Mr. David Black, SE4 of SE4 of Section 1, T28N-R19W, Town of Troy, requested to build a machine storage shed that would be 48 feet from the centerline of a town road. Mr. Black explained that the snow partially destroyed the building and he would like to build on the same foundation. Questions by Board members . r 6. Mr. Lawrence Handlos , Chairman of the Town of Troy, presented the request of Douglas Evans for a variance to 8 . 4 (F) (lc) access driveways , that would be only 85 feet from the adjoining driveway. The reason for the request is that moving the driveway 200 feet would destroy a considerable amount of good farmland. Mr. John Ruemmele, adjoining land owner, stated that the requested location is the best area in order to save good farmland. Questions by Board Members . %r* Motion by Supervisor Afdahl to deny the request of Paul Casey to have a gravel pit on his property located in the NW4 of NE4 of Section 15 , T30N- R18W, Town of Richmond, due to the absence of Mr. Casey or his representative at the May 22 or June 26 hearing. Mr. Casey has the option to come back before the Board of Adjustments for reconsideration after additional fees have been paid. Seconded by Supv. Pierson, motion carried. Vote to deny : Afdahl-yes , Pierson-yes , George-absent. Hearings recessed in order to make inspections of the properties in question. Zoning Administrator read notice of variances and special exceptions as published in the county designated newspaper. 1. Mr. John Walsh requested modifications to Section 3 . 4(B) of the Shoreland Ordinance, Filling, Grading and lagooning. Location : Part of Gov' t. Lot 4, Section 3, T31N-R18W, Town of Star Prairie. Zoning Administrator read letter received from Department of Natural Resources denying the request of Mr. Walsh' s as it is a wildlife and wetlands area. Mr. Walsh presented his request to clean rubbish from the area and fill the area on the north side of the cabin which would improve the appearance of the property. Questions b Q y Board members. e bers. Mr. Vern Nelson, Chairman of Star Prairie Township , objected to the request stating that the lake does fluctuate and the area would be q g covered with water. It is a spawning and nesting area on the lake. 2. Mr. James Giossi, NE,, of SE,',- of Section 2 , T31N-R18W, Town of Star Prairie , requested to construct a summer home on this parcel of land. The new structure would set back 63 feet from the water and 63 feet from the centerline of CTH H. The new structure would be about 25 feet further from the water than the present cottage. Questions by Board members. 3. Mr. William Wilson, SW-, of SE-, of Section 2 , T31N-R18W, Town of Star Prairie, requested to construct a garage that would not meet the setbacks from CTH H. The setback would be 75 feet from the centerline of the road. Mrs . Wilson representing her husband said the garage would be 43 x 28 with the doors opening and driveway access on CTH H. They would like to use the present drivewy as a second driveway. Questions by Board members . 4. John Caldwell, Part of Gov' t Lot 1, Section 3 , T31N-R18W, Star Prairie Township. Mr. Caldwell requested to construct an addition to his house with a basement for a storm shelter. The addition would be 65 feet from the water and 75 feet from the town road on the lake side of his house. Mrs . Caldwell explained that it would be impossible to build on the opposite side of the house due to the sanitary system being located there. Questions by Members of the Board. 5. Mr. Richard Hilmanowski, SE,',- of SE-, of Section 30 , T31N-R18W Town of Star Prarie , requested a variance of Article 8. 4 (Flc) access driveways . He is requesting a separation of 154 feet from the next driveway explaining the reason for his request. Town Board Chairman informed the Board that the Township has no objections . Questions by Board members . 6. Mr. Thomas Lubner , National Advertising Company, requested to construct an advertising sign on the commercially zoned property of Henry Lentz located in the NW4 of the SE-, of Section 22 , T30N-R20W. Town of St. Joseph. The sign will be located on the west side of the property and 150 feet from the centerline of STH 35-64. Questions by Board members . Hearings recessed for inspection of properties . Board entered into an Executive Session at 2 :00 p.m. returning to open session at 2 :45 p.m. for decisions . The following decisions were rendered: 1. Edward Kraemer and Sons : Motion by Supervisor Afdahl to grant the request of Edward Kraemer and Sons , Inc. for a gravel pit located in the SW-, of the NE-, of Section 31, T29N- R15W, Town of Springfield. Seconded by Supv. Pierson. Motion carried. Vote to approve motion : Afdahl-yes , Pierson-yes , George-absent. 2. Elmer Magsam: Motion by Supv. Afdahl to grant the request of Mr. Magsam to construct an addition that would not extend towards CTH J closer than the present structure. Seconded by Supv. Pierson, motion carried. Vote to approve motion: Afdahl-yes , Pierson-yes , George-absent. 3. David Cloutier: Motion by Supv. Pierson to grant a setback of 130 feet from the interior side of the blacktop on the cul de sac. Eaves shall not extend 130 feet beyond the black top. Seconded by Supv. Afdahl, motion carried. Vote to grant the variance : Pierson-yes , Afdahl-yes , George- absent. 4. Gary Svenningsen : Motion by Supv. Pierson to deny the request of a variance to Article 8.4(B) to 85 feet from the centerline as ample area is available to meet all setback requirements . Seconded by Supv. Afdahl , motion carried. Vote to deny request : Afdahl-yes , Pierson-yes , George-absent. 5. David Black: Motion by Supv. Pierson to deny the request of David Black for a variance of Section 8. 4 (B) of 48 feet from the centerline of a town road. There is other areas which the storage building could be constructed to meet the setbacks . Seconded by Supv. Afdahl , motion carried. Vote to deny request : Afdahl-yes , Pierson-yes, George-absent. 6. Douglas Evans: Motion by Supv. Afdahl to grant the rquest of Douglas Evans for a variance of 8 . 4 (Flc) driveway separation of 85 feet. However, if land is further developed or subdivided in the future. The driveway shall be removed to conform with the 200 foot driveway separation requirement. Motion carried. Vote to approve: Afdahl-yes , Pierson-yes , George-absent. 7. John D. Walsh : Motion by Supv. Afdahl to deny the request for. a special exception use Article 3. 4(b) as filling with the Shoreland District and SS 30 . 15 will not permit filling of any wetlands . Seconded by Supv. Pierson, motion carried. Vote to deny request : Afdahl-yes , Pierson-yes , George-absent. 8. James Giossi : Motion by Supv. Pierson to grant the request of Mr. James Giossi for a variance of Article 8. 4 (B) (3b) as follows : 50 feet from the centerline of CTH H and a minimum of 72 feet from the highwater mark of Cedar Lake. If building width is reduced in width , the distances from the water shall be increased. Seconded by Supv. Afdahl , motion carried.
