CONTINUATION OF FACTS , CONCLUSIONS OF LAW, PERMIT AND ORDER
The St. Croix County Board of Adjustments , pursuant to due notice,
held a public hearing on November 11, 1975 , in the matter under provisions
of and in accordance with Section 9. 7. 4, St. Croix County Zoning
Ordinance, in the St. Croix County Courthouse, Hudson, Wisconsin, to
determine whether or not the variance request to maintain the constructed
structure at its present location of 89 feet from the centerline of the
road should be granted to the applicant under Section 9 .5. 3, St. Croix
County Zoning Ordinance.
Upon reviewing the findings of facts , the Board unanimously agreed
to deny the request of A feet from the centerline of the road.
However, upon the recommendations of the District Attorney and
counsel of the applicant, the Board of Adjustment reopened the case on
December 16, 1975 , for continuation of the facts.
CONTINUATION OF FACTS
1. All of the procedural requirements of Section 9 . 5. 2 , St. Croix
County Zoning Ordinance, regarding notice of the hearing held herein have
been complied with.
2. At the hearing, Mr. Plank agreed to a forfeiture of $ 500. 00.
CONCLUSIONS OF LAW
The Board of Adjustment has authority, based upon the foregoing
findings of fact, to issue a decision on the application for a variance
to Section 8. 4. 2 , St. Croix County Zoning Ordinance.
PERMIT AND ORDER
AND HEREBY DOES DISCLOSE THE FOLLOWING DECISION: Upon the acceptance
of the $500. 00 forfeiture by the applicant, the Board hereby recinds its
decision of November 11, 1975, denying the request.
On a motion by Supervisor Holmes, seconded by Supervisor Luckwaldt
and unanimously carried, the Board approved the request to maintain the
structure at its present location of 89 feet from the centerline of the
road.

The Zoning Administrator read the request for Substation that
Northern States Power Company to build a temporary

electrical needs of the area.

Mr. Robert Krueger presented a request for a variance of the
St. Croix Riverway Ordinance setback requirements. The Zoning Administrator
read the notice for a variance of the St. Croix Riverway setback of
100 feet. Mr. Krueger wishes to construct 40 feet from the bluffline.
The Zoning Administrator read correspondence from Merle Ellsworth I
and the Department of Natural Resources.

Mr. Krueger that they would inspect the property and the Zoning Administrator,
would advise him of their decision.
The Zoning Administrator read the request of David Plank, Town of
Hudson, for a variance from the setback ordinance to 89 feet from the
centerline of a town road. Mr. Plank has agreed to a forfeiture of
$500.00.
Questions were asked by Board members and the District Attorney.
The Board of Adjustments went into Executive session on the Plank

David Plank. Seconded by Supv. Luckwaldt. Motion carried
unanimously. 1

Board will meet on January 13, 1976, at 10:00 a.m. to set guidelines
for Zoning Board of Adjustments.
After inspection of the Robert Krueger property. A motion by Supv.
Luckwaldt to approve the variance of 60 feet setback from the bluffline
and the building shall be no more than one story with a maximum height of
25. feet from the basement floor=--when at least 50% of the basement story
is , for its whole perimeter is below the natural ground level . The Zoning e�
Administrator shall approve the building plans before sanitary permits
are issued. Seconded by Supv. Holmes. Motion carried unanimously.
After inspection of the Northern States property. A motion by Supv.
Holmes to approve the temporary substation with a setback of 63 feet from t
centerline of the town road to the fence perimeter of the substation.
Seconded by Supv. Luckwaldt. Motion carried unanimously.
Motion by Supv. Luckwaldt to adjourn. Seconded by Supv. Holmes.
Motion carried. Hearing adjourned at 3 :00 p.m.
