FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and conducted an on-site
inspection, the Board finds the following facts:
1. The applicants are Chris and Sheila Rohl, whose address is 473 County Roaad SS,
Roberts WI 54023.
2. The applicants filed with the Zoning Office an application for a special exception for a
contractor storage yard to store equipment on their property that is used for their
excavating business. The applicant also requests a variance to the 15-foot height
restriction for accessory buildings to allow them to construct a building tall enough to store
the large equipment used for their excavating business.

buildings under Section 17.12(5). The proposed building is being constructed to replace a
building that burned down and was used to house the excavating equipment.
5. The Town of Kinnickinnic supports the applicants' request.
6. The Board of Adjustment found that this special exception application conforms with the
requirements for granting a special exception under Section 17.15(6)(d). The Board of
Adjustment found that this variance application conforms with requirements for granting a
variance under Section 17.12(5).
7. The Board of Adjustment found that the spirit and intent of the ordinance would be met by
granting this special exception permit and variance request.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board
approved the applicant's request for a special exception for a contractor storage yard and for a
variance to the 15-foot height restriction for accessory buildings. Variance request approved
based on the following findings:
1. The Town of Kinnickinnic recommends approval of the request.
2. The Board believes this to be a good location for the business. This is not a residential
development.
3. The new building is replacing an existing building that burned down.
4. The building will be adequately screened from surrounding properties and neighbors.
5. In order to provide adequate storage of the equipment for the business, 14-foot doors
are needed on the building.
6. There is an existing structure on the property that is approximately the same height.
7. There were no objections to the request.
8. The spirit and intent of the ordinance will be met.
With the following conditions:
1. The structure height shall not exceed 28-feet in height.
2. This variance is valid for a period of one year from the date of issuance; failure to obtain
the necessary approvals within this time frame shall result in revocation of the variance.
3. Any change to the above conditions shall require a new application and new public
hearing.
4. Failure to comply with the above conditions shall result in revocation of the variance.
5. The applicant shall secure a local building permit.
The following vote was taken to approve: Golz, yes; Rose, yes; King, yes; Peterson, yes;
Chairperson Speer, yes. Motion carried.
Special exception request approved based on the following findings:
1. The Town of Kinnickinnic supports the request.
2. The building being constructed for the storage is replacing an existing building that
burned down.
3. The proposed screening plan is appropriate for this contractor storage yard.
4. This business has been in operation for 14 years with no complaints from neighboring
residences.
5. The business is conducted off-site.
6. There were no objections to the request.
7. The spirit and intent of the ordinance will be met.
With the following conditions:
1. This approval is for a Contractor's Storage Yard.
2. All equipment related to this request shall be stored within the confines of the storage
shed as indicated on the site plan. The applicant may only replace/upgrade equipment
with similar equipment. The size of the contractor storage yard cannot expand beyond
the plan as submitted.

5. Applicant to provide a screening plan to the Zoning Office by October 1, 2000. Trees to
be used for screening should be 6-foot evergreens, to be placed 8 feet on center along
the north property line beginning at the Count Road to a distance 350 feet east, and

along the west property line from the existing driveway to the north property line.
6. This approval does not include storage of hazardous materials onsite. All other
petroleum waste products to be disposed of properly. (This does not apply to chemicals

that the applicant may use for personal use.)
7 . The applicant shall limit the travel—related to business—to and from the site, from %2
hour before sunrise to Y2 hour after sunset, Monday—Saturday. The applicant shall
avoid excess trips to and from the property during these hours.
8. Applicant has indicated that no more than three employees, other than the residents of
the principal dwelling, will be engaged in the business.
9. All designated outside storage areas shall be so placed or screened by plantings as not
to be visible from County Road SS or any residential building other than that of the
owner of such yard.
10. The applicant shall have the Zoning Administrator review this special exception permit in
two years from the approval date for compliance with this approval (August 2002).
11. This approval does not give the authorization to place a sign on the parcel. All signage
must be approved by the zoning department and must strictly adhere to the St. Croix
County Signage Ordinance. Maximum size of sign, if approved, can be no larger than 6
square feet.
12. The applicant shall have one (1)year from the issuance of the Special Exception permit to
act on the Special Exception Permit. Failure to commence business operation in this
timeframe shall result in the expiration of this Special Exception permit. If the Special
Exception permit expires, the applicant will be required to secure a new Special Exception
permit before commencing the business operation.
13. Any minor change (or addition) in expansion of the project, including the business,
signage, lighting, hours of operation, shall require review and approval by the zoning
administrator. Any major change and/or addition to the originally approved plan will go
through the special exception approval process, where applicable, as stated in the
ordinance.
The following vote was taken to approve: Peterson, yes; Rose, yes; Golz, yes; King, yes;
Chairperson Speer, yes. Motion carried.
APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30
days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin Statutes. St. Croix
County assumes no responsibility for action taken in reliance on this decision prior to the
expiration of the appeal period. St. Croix County does not certify that the identity of all persons
legally entitled to notice of the Board of Adjustment proceedings, which resulted in this decision,
was provided to the County.

If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her
expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available
from Northwestern Court Reporters, Hudson, Wisconsin. It is the responsibility of the Board of
Adjustment to submit its record (file)of this matter to the circuit court.

BOARD OF ADJUSTMENTS

The meeting was called to order by Chairperson Julie Speer at 8:30 a.m. A roll call was
made. Julie Speer, Dick King, Nick Golz, Rich Peterson and Tom Rose were present.
Chairperson Speer believes this to be a properly noticed meeting.
Staff included: Steve Fisher, Zoning Director, Rod Eslinger, Zoning Specialist, and Deb
Zimmermann, Administrative Assistant
There are two items under"Other Business". Chairperson Speer asked that they be
moved to the end of the meeting rather than the beginning. With that change, a motion
was made by King, second by Golz to adopt the agenda. Motion carried.
The Board set the next meeting date as September 28, 2000. The starting time will be
8:30 a.m. The meeting will be held in the County Board Room at the Government
Center.
Motion by Peterson, second by Rose to approve minutes from the July meeting. All in
favor. Motion carried.
CORPORATION COUNSEL REPORT/ UPDATE ON VIOLATIONS AND LITIGATION
Corporation Counsel will be available if needed.
NEW BUSINESS
Chairperson Speer welcomed everyone in attendance and gave a brief overview of how
the Board of Adjustment meeting is conducted. Chairperson Speer stated that the public
hearing notice was published correctly and was read into the record as follows:
PUBLIC HEARING NOTICE
The St. Croix County Board of Adjustment has scheduled a public hearing for Thursday,
August 24, 2000 at 8:30 a.m. at the Government Center, 1401 Carmichael Road, Hudson,
Wisconsin, to consider the following appeals to the St. Croix County Zoning Ordinance. An
on-site investigation will be made of each site in question, after which the board will return
for the purpose of deliberating and voting on the appeals.
1. ARTICLE: Request #1: Variance request to 15 foot height restriction for
accessory buildings pursuant to Section 17.12(5). Request is for a
7-foot variance to this height restriction.
Request #2: Special Exception request for a permit to operate a
contractor storage yard in the Ag/Residential District pursuant to
Section 17.15(6)(d). Request is to construct a building on the site
to store trucks and equipment related to applicant's excavating
business.

Article One: Chris and Sheila Rohl
Eslinger explained that this request is a two part request. The applicant is asking for a
variance to the accessory building height restriction, as well as a permit to operate a
contractor storage yard for his business.
The applicant had a fire that destroyed a building on his property that housed the
excavating equipment for his company. He plans to construct a new building and is asking
for a 7-foot variance to the 15-foot height restriction.
The request for the contractor storage yard is for an existing business the applicant has
been conducting since 1986. He would like to continue storing his excavating equipment
at this site. There will be no outside storage of materials. Eslinger explained that the
applicant indicated in the written narrative that there will be no more than three employees,
other than the residents of the principal dwelling. There will only be equipment stored on
site. No work will be conducted on the property, other than regular maintenance on the
equipment owned by the applicant.

Chris Rohl, being duly swom, is the owner of the property. He explained that he has had
this business since 1986. His building that stored his equipment burned down, and he
needs to rebuild it. He would like to utilize the old footings from the burned down building.
The reason he is asking for the variance is that, due to the size of the large equipment
used for his business, he needs to put in 14-foot doors in order to store this equipment in
the building. There is another structure on the property that is used for agriculture that
would be about the same height as the proposed building.
Rohl explained his business to the Board. He does not store material at the site, with the
exception of some small amounts of earthen material that is kept there from time to time.
He generally leaves early in the morning and is gone all day. There have been no
problems with any surrounding neighbors. Rohl stated that this new building will be an
improvement over the one that was previously there. He plans to use pine trees for
t he will use blues spruce or
Town, that screening on the south side, and had indicated to the To p
red pines and planting will be completed by June 1 of 2001.
Photographs of the property were introduced as Exhibit 6 and were reviewed by the
Board. Eslinger stated that the.Town of Kinnickinnic has written a letter recommending
approval of the application and he read part of the letter into the record.
The Board will visit the site.
Article Two: Jeff Haas
Eslinger stated that this application is for a contractor storage yard and very similar to the
previous application. This was brought to the staffs attention through a complaint. Mr.
Haas is attempting to bring his storage yard into compliance. The applicant operates a
business by the name of "J.Haas Excavating and Snowplowing".
Eslinger went over the staff report with the Board. This property is in the Ag/Residential
district and is located on a dead end road adjacent to 1-94 in the Town of Kinnickinnic.
There are no other residences on the road. The Town of Kinnickinnic supports the
application with no suggested conditions.

Jeff Haas, being duly swom, is the owner of the property. He told the Board that he did
not realize that he needed a permit to store business equipment on his site. All of the
work for his business is done off site. He keeps a majority of his equipment stored in the
Twin Cities from late spring until November. The rest of the equipment is stored on his
property. There is some earthen material (topsoil) stored on the property, but is not a
large amount.
The Board will view the property.

Article Three: Robert Frame
Eslinger informed the Board that the applicant plans to operate a manufacturing/
machining business on his property in the Town of Pleasant Valley. This will be a tooling
operation that will provide services to local businesses. There will be no retailing done at
the site and will be working with larger volume distributors who subcontract their needs out
to smaller businesses. The applicant will be utilizing an existing building on the site and
will partition the building off so as to be using less than 1,000 sq. feet for his business,
which is required by the ordinance. The Town of Pleasant Valley has no objections to this
application. Eslinger read the approval letter from the Town into the record.
The applicant is allowed up to two employees, outside of the residents of the principal
dwelling. He has indicated that if his business grows, he will move to another site.
Eslinger stated that there is currently hard surfacing for the parking area.

A question was raised by the Board on disposal of waste and oils. Eslinger stated that the
amount of waste is very minimal, therefore, no need for the Land and Water Conservation
Department to review. If this was a business on a larger scale it would be reviewed by the
Department of Commerce.
Robert Frame, being duly sworn, states that this is a very small facility at his residence.
He will have 3 or 4 machines in his shop. Frame is looking to get a start in this business,
and if it grows into something larger, he plans to move to an industrial park.
Frame addressed the issue raised on oil disposal. There is a very minimal amount of oil
used, only what is used to lubricate the parts on the machines. Any access will be
collected in 5-gallon jugs and disposed of properly or recycled.
The Board will visit the site.
Article Four: Emmett and Margaret Langness
Eslinger informed the Board that this request is for a variance to the road setback
requirement of 133 feet from the centerline of a road. The applicant would like to add on
an addition of 14' by 22' to their existing home, along with a 14' x 14' deck. The existing
home is 76-feet from the centerline of 140th Avenue in the Town of Richmond. They would
also like to attach a handicap ramp for access. These additions would require a variance
of 57-feet. The ramp may be added without the variance, as according to the ADA
standards.
Eslinger went over the staff report with the Board. He stated that staff has informed the
applicant what is involved in obtaining a variance, and that an unnecessary hardship must
be present. Eslinger went over criteria the Board must following in granting a variance.

Eslinger went over Exhibit 3 and 5 with the Board. The proposed addition is for the west
side of the home.
Margaret Langness, being duly swom, is the owner of the home. She and her husband
want to add on to their home, and make it handicap accessible. They bought the home
about 2 years ago and did not know at that time that it was non-conforming. The home is
small, and they would like to add on to it, as they plan to live there for a long time.
The Board will visit the site.
Article Five: Jim Povolnv
Eslinger stated that this request is for a stream crossing in the Town of Cady. Cady is an
unzoned township. The shoreland provisions apply to the entire geographical area of St.
Croix County, thus this grading request needs Board of Adjustment approval.
This request was originally heard in April of 1999, and was approved. The applicant did
not complete the project, and is asking to widen the crossing. The crossing that is
proposed will be used for recreation and personal uses. Eslinger reminded the Board that
Cady is not under county zoning, so they may only address the application for the
crossing, not the land use.
The Land and Water Conservation Department has approved the plans for this project.
Eslinger stated that we have not received any recommendation from the Department of
Natural Resources, nor has anything been sent from the Town of Cady. A copy of the
application and attachments were sent to the Town on August 3, 2000.

Eslinger pointed out that the plans have been designed by a licensed engineer. The
crossing is to be constructed according to the designs that have been submitted. If this
application is approved, staff suggests that seeding of the project should be done no later
than September 15,2000.
Jim Povolny, being duly swom, is the applicant. He stated that the initial decision time
lapsed due to time constraints. He would like to get approval to continue to move forward,
so that he can have access to his property. He is currently working with the DNR to obtain
his Chapter 30 permit.
The Board will visit the site.
Other Business
Fisher updated the Board on ordinance changes that are upcoming: The Planning, Zoning
and Parks Committee held a hearing and approved the change to the ordinance regarding
Temporary Occupancy Permits. This permit will be issued as a Land Use Permit by the
zoning office, and will no longer require approval from the Board of Adjustment.

There is also a change with regard to the plats that have land in the St. Croix Riverway
District. The plat will be placed on the agenda for the Board of Adjustments hearing as an
informative item for their approval. Fisher stated that by the time the plats get to this point,
they have been approved by the Town, County, Land and Water Conservation, the
Department of Natural Resources, and any other pertinent agencies. The Board agreed
that this is a good change.
Fisher updated the Board on the zoning budget for 2001. Staff will be purchasing a
television for the department, and asked if the Board would like sites taped for viewings, or
if they prefer touring the sites as they now do. Discussion held. The Board decided they
would like to continue viewing the sites personally. They believe they can make better
decisions by actually seeing the site.
Fisher stated that the department will be adding another full time secretary to our office
staff for next year. A discussion was held on the staff and their roles.
The Board recessed at 10:00 a.m. to view the sites.

The Board reconvened at 1:10 p.m. to render Decisions.

A motion was made by Peterson, second by King to approve the request for a variance to
the 15-foot height restriction of an accessory structure based on the following findings:
1. The Town of Kinnickinnic recommends approval of the request.
2. The Board believes this to be a good location for the business. This is not a
residential development.

5. In order to provide adequate storage of the equipment for the business, 14-foot
doors are needed on the building.
6. There is an existing structure on the property that is approximately the same
height.

With the following conditions:
1. The structure height shall not exceed 28-feet in height.
2. This variance is valid for a period of one year from the date of issuance; failure to
obtain the necessary approvals within this time frame shall result in revocation of
the variance.

public hearing.

The Board directed the staff to review this part of the ordinance to allow for taller
structures for this type of business. With the larger equipment being used today, a taller

1. The Town of Kinnickinnic supports the request.
2. The building being constructed for the storage is replacing an existing building

2. All equipment related to this request shall be stored within the confines of the
storage shed as indicated on the site plan. The applicant may only
replace/upgrade equipment with similar equipment. The size of the contractor
storage yard cannot expand beyond the plan as submitted.

11. This approval does not give the authorization to place a sign on the parcel. All
signage must be approved by the zoning department and must strictly adhere to
the St. Croix County Signage Ordinance. Maximum size of sign, if approved,
can be no larger than 6 square feet.

5. Applicant meets the 500-foot setback from all surrounding neighbors.
6. Required hard surfacing is in place.
7. Applicant has indicated that he will relocate business to a commercial or
industrial site if expands beyond current size.

Motion by Golz, second by P Y Speer to den variance request to the required 133-foot t road
setback from the centerline based on the following findings:
1. This is anon-conforming structure. Approval of such variance would add
to the
non-conformity of the structure. Applicant did not prove that there was a
hardship in this case. The applicant has reasonable use of the property without
the variance. The applicant presently has a 28' x 52' rambler, which includes a
single car attached garage, and a large detached storage shed on this parcel.
2. The request is for the convenience of the property owner rather than the physical
limitations of the property.
3. The entire structure lies within the 133-foot setback from 140 'Avenue.
4. A handicap accessible ramp may be added onto the home pursuant to the
Americans with Disabilities Act, without a variance from the Board.
5. The Board feels that by granting this variance, the spirit and intent of the
ordinance would not be met.
6. The Board asked the Zoning staff to work with the applicants to pursue
alternative options to expand their living space.
The following vote was taken to deny: Rose, yes; King, no; Peterson, no; Golz, yes;

Motion by Golz, second by King to approve the special exception request to construct a
creek crossing in the Shoreland District based on the following findings:

1. The plans presented for the project were designed by a professional engineer.
Plans for the project are to be followed as submitted to the Zoning Office.
2. The project was previously approved in April of 1999.
3. The new proposal of a 24-foot wide gravel surface will provide for a safe access
for any future uses of the property.
4. The applicant is working with appropriate agencies to obtain permits needed for
the project.
5. There were no objections to the request.
6. The spirit and intent of the ordinance will be met.
With the following conditions.
1. This approval is for the construction of a creek crossing utilizing two six-foot
galvanized culverts with a 24-foot wide gravel surface.
2. The applicant must obtain a Chapter 30 permit from the Department of Natural
Resources before commencing construction of the project, as well as any permits
needed from the Town of Cady.
3. The applicant shall follow the engineered plans as submitted.
4. It is preferred that all seeding shall be completed prior to September 15, 2000. If
seeding cannot be completed by this date, the applicant must apply mulch to all
disturbed areas to minimize erosion, and seeding for permanent re-vegetation
must be completed as soon as weather conditions allow in the spring of 2001.
5. Applicant to supply the Zoning Office with the name of company and contact
person who is responsible for the erosion control measures and notify zoning
staff once erosion control is installed.
6. The applicant and contractor are responsible for installation and on-going
maintenance of all erosion control practices/devices.
7. The applicant is responsible to contact the Zoning Office at the beginning and the
end of the project to insure compliance with the engineered plans.
8. The applicant shall have one (1)year from the issuance of the Special Exception
permit to act on the Special Exception permit. Failure to commence business
operation in this time frame shall result in the expiration of this Special Exception
permit. If the Special Exception permit expires, the applicant will be required to
secure a new Special Exception permit before commencing the business
operation.
