Re: Rezoning and Special Exception Applications
Dear Mr. Bettendorf:
This letter will summarize where we are at in re above matter,
Rezonement application signed and dated February 26, 1997 was
received in this office on April 17, 1997 with the $300 fee paid.
An unsigned Special Exception permit was received in this office
April 17, 1997 with the $150 fee being paid April 21, 1997. Both
applications are considered incomplete and are being returned. The
following information be submitted to this office with the
completed applications:
1. Correct legal description of the properties that are the
subject of the requests, for each file.
2. A copy of the properties tax bills, for each file.
3 . A copy of the properties deeds, for each file.
4. Appear before the Town Board and secure a recommendation
on the Rezonement and later in conjunction with the
Special Exception.
4. Sign the Special Exception permit.
In addition to the above, you will have to notify the Kinnickinnic
Town Board that you are seeking a rezonement and make arrangements
to appear before them to secure their positive or negative
recommendation.
The June deadline, for a completed application for rezonement to be
scheduled by the Planning Zoning and Parks Committee for a public
hearing, is noon on Friday May 16, 1997.
If the rezonement is successful you will need to pursue the Special
Exception.
The letter from Matthew A. Biegert of Doar, Drill & Skow, S.C.
dated January 29, 1997 stated "we will file the necessary documents
for a zoning change within the next 30 days", this commitment was
not met. Todate this office has not received completed
applications.
This is an ongoing matter that will be turned over to St. Croix
County Corporation Counsel unless a completed application is
received in this office by noon on May 16, 1997 and unless all
required Rezonements, Special Exceptions and permits are secured
and conditions complied with.

VARIANCE
Variances from the provisions of the Zoning Ordinance may be-applied for only where, owing
to special conditions, a literal enforcement of the Ordinance will result in an "unnecessary-
hardship" which is defined in the Zoning Ordinance as meaning "an unusual or extreme decrease
in the adaptability of the property to the uses permitted by the zoning district, which is caused
by facts such as rough terrain or good soil conditions, uniquely applicable to the particular piece
of property in the same zoning district."
If you believe that under the facts and circumstances unique to your property a variance could
be granted to you, under the definition cited above, please set forth the type of variance which
you are requesting and the reasons that you have for making the request.
Requesting that additional land be zoned for our trucking ccapany in order
