Variances from the provisions of the Zoning Ordinance may be applied for only where, owing
to special conditions, a literal enforcement of the Ordinance will result in an "unnecessary.
hardship" which is defined in the Zoning Ordinance as meaning "an unusual or extreme decrease

SPECIAL EXCEPTION
Special exception use permits are granted at the discretion of the Board of Adjustment. They are
made available to validate uses which, while not approved within the zoning district in question,
are deemed to be compatible with approved uses and/or not found to be hazardous, harmful,
offensive orb otherwise adverse to other uses, subject to review by the circumstances and the
imposition of conditions, subject to the provision of the St. Croix County Zoning Ordinance.
If it is your belief that a special exception use permit should be granted to you for the above
described property, please set forth in detail the intended use of the property and your
justification in applying for such a permit:

OWNER'S RESPONSIBILITIES:
The Applicant, as witnessed by his signature on this application, hereby acknowledges that he has
read and that he understands the following:
1. Applicants are responsible for appearing at the Town Board's regular meeting prior
to the Board of Adjustment meeting to obtain a Town Board recommendation and
have the Town send a letter to the Zoning Department stating their position on the
request.
2. Applicants must submit a site plan showing distances from property lines, roads and/or
water.
3. Applicants are to submit a list of adjoining property owners and their addresses, including
those on the opposite side of a public road.
4. Applicants will be heard by the Board of Adjustment after a public hearing on the
application at which time testimony and arguments will be received. The Board will
adjourn to view the sites in question after which time they will reconvene to render
decisions. However, the applicant should not consider the decision to be final until
written notice of the decision has been presented to him.
5. At the public hearing, the applicant may appear in person or through an agent or an
attorney of his choice. The applicant/agent/attorney may present testimony, evidence and
arguments in support of his application.
6. The fact that an application for a permit has been filed does not automatically mean that
a permit is granted. If you are uncertain as to how to present your case, you may want
-to consider the advice of legal counsel.

7. The fee assessed for this application is non-refundable.
8. All site plans, pictures, etc. become the property of the Zoning Department and will
remain in the file.
9. Statements of representatives of the Board of Adjustment made to you concerning matters
of whether the Board can, will or will not grant the permits you seek are understood to
constitute the opinions of those representatives. Staff are not empowered to act on behalf
or instead of the Board of Adjustment.
10. Applications must be returned to the Zoning Department by the last day of the month
preceeding the next Board of Adjustment meeting.
11. Board of Adjustment meetings are held the fourth Thursday of each month.
Assistance in filling out this application will be provided to you by a representative
of the St. Croix County Zoning Department at your request.
All interested parties have a right to appear at the hearing and express their support of or
opposition to this request. Please provide below names and addresses of all adjoining
property owners including those on the opposite side of a public road.

POND APPLICATION
The pond area to be developed is located in the flood fringe area,within
300ft of the Iinnikinic.The pond basin will be excavated with a large
bulldozer ,andthe spoils will be deposited and leveled off within the same
adjacent flood fringe area.This spoil area is approximately .R,000sq.ft. with
anapproximate cu.vol. of300 to400 cu. ft.
The cu. footage of spoil removed for the pond and the cu.feet of fill added in
the flood fringe will be equal,so that the flood fringe will have the same water
displacement volume as existed prior to creating the pond and fill areas.This
soil(spoil material),which is a sandy clay will stabilize quickly with a seed
and mulch cover.Native grasses and indigenous plant material will be used to
support and enhance wildlife.
It is our intent to create a ponding area to enhance wild life and aesthetic
characteristics.We will not be developing a pond for fish.
The depth of the pond area will be an average of 3ft. with the largest area
having a depth of 6ft.The bottom of the basin will be sand,that currently lies
2.5ft. below the existing surface.This basin then will fill from groundwater.
The spoils from the pond excavation will be arranged with a slope of no
greater than 3:1 and in most areas from 5:1 to 10:1.
All spoil deposit areas will have erosion control barriers placed between the
spoil area and the lower elevations.
The site plan,page 1 of ,indicates the location of all adjacent landowners

construct a pond adjacent to the Kinnickinnic River in St Croix County. Your
permit # 3-WC-97-1011LC is extended until October 1, 1998. All other conditions
of your original permit remain in effect.
If your project is not completed by October 1, 1998, you will have to apply for
a new permit.

PERMIT CONDITIONS
1. You must notify Water Management Specialist Daniel S.Puich,Eau Claire,WI,54702,715-839-3769,before starting
construction and again not more than 5 days after the project is complete.
2. You are hereby authorized to construct two ponds with the following conditions:
a) You may not connect the ponds with surface waters, locate it within 50 feet of the OHWM of any navigable
waterway.
b) The maximum surface area of the unconnected ponds may not exceed 2 acres.
c) You may not place the material removed to create the unconnected ponds in any surface water or wetland. You
must dispose and stabilize all material at the upland site described in your application and plans.
d) The side slopes of the unconnected ponds may not be steeper than 3 feet horizontal to 1 foot vertical(3H:1 V).
e) The unconnected ponds must be for the purpose of improving wildlife or fish habitat or recreational
opportunities not associated with any commercial use.
f) The unconnected ponds must not be associated with any metallic or non-metallic mining projects.
3. This permit does not authorize any work other than what you specifically describe in your application and plans,and
as modified by the conditions of this permit. If you wish to alter the project or permit conditions, you must first
obtain written approval of the Department.
4. You are responsible for obtaining any permit or approval that may be required for your project by municipal, town
or county zoning ordinances or by the U.S. Army Corps of Engineers before starting your project.
5. You must allow free and unlimited access to your project site at any time to any Department employee who is
investigating the project's construction, operation, or maintenance.
6. The Department may modify or revoke this permit if the project becomes detrimental to the public interest.
7. You must keep a copy of this permit and approved plans at the project site at all times until the project is complete.
8. Your acceptance of this permit and efforts to begin work on this project signify that you have read, understand and
agree to follow all conditions of this permit.

FINDINGS OF FACT Permit# 3-WC-97-1011LC
1. Neil Anderson has filed an application for a permit to construct two unconnected ponds adjacent to the Kinnickinnic
River in the SE',4 of the SE'A of Section 19, Township 28 North, Range 18 West in the Town of Kinnickinnic, St
Croix County.
2. The applicant is a riparian owner of the project site.
3. The Department has completed an investigation of the project site and has evaluated the project as described in the
application and plans.
4. The proposed project will not materially obstruct navigation and will not be detrimental to other public interests if
constructed in accordance with this permit.
S. The proposed project will not adversely impact wetlands.
6. The Department has determined that granting or denying this permit does not constitute a major state action
significantly affecting the quality of the human environment.
7. The Department of Natural Resources and the applicant have completed all procedural requirements and the project
as permitted will comply with all applicable requirements of Section 1.11, 30.12(3)(a)4 Wisconsin Statutes and
Chapters NR 102, 103, 115, 116, 150, 299 of the Wisconsin Administrative Code.
8. Consistent with social, economic,and other essential considerations,the Department has adopted all practical means
to avoid or minimize environmental harm.
CONCLUSIONS OF LAW (These are the legal reasons why the Department can make these decisions)
1. The Department has authority under the above indicated Statutes and Administrative Codes, to issue a permit for the
construction and maintenance of this project.
NOTICE OF APPEAL RIGHTS
If you believe that you have a right to challenge this decision, you should know that Wisconsin Statutes and Wisconsin
Administrative Rules establish time periods within which requests to review Department decisions must be filed.
To request a contested case hearing pursuant to Section 227.42, Wisconsin Statutes, you have 30 days after the decision
is mailed or otherwise served by the Department, to serve a petition for hearing on the Secretary of the Department of
Natural Resources. This notice is provided pursuant to Section 227.48(2), Wisconsin Statutes.
