CROIX COUNTY ZONING A-50-06 ORDINANCE. Location: NEi/4 of the'9G'E1/4 of August 26, 1986 Section 20, the NW1/4 of the SWi/4 of Section 21, and the SE1/4 of the NE1/4 of Section 2, T28N-R18W, Town of Kinnickinnic . The St . Croix County Board of Adjustment conducted a public hearing on August 26, 1986 to consider the request of the Department of Natural Resources, Fish Management, for a special exception use, Article 3 . 4 B, Rip Rap, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on- site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an executive session to discuss the request . After returning to open session, the following decision was rendered : Mutiun by Supervisor Kinney to approve the request as it will enhance the stream bank and protect the grout habitat. Seconded by Supervisor Sweitzer . Motion carried . Vote to approve : Sweitzer, yes; Kiiiney, yes; Mcinke, yes . All variances approved must be acted on or constructed within one year from date of approval or they shall be null and void . Meeting called to order by Chairman Meinke at 9: 00 a. m. in the County Board Room, Courthouse, Hudson. All members present . Minutes of the July meeting and hearing approved as written. Chairman Meinke called the hearing to order at 9: 30 a. m. Zoning Administrator read notice of the hearings as published in the newspapers. 1 . ARTICLE: 3. 7B, 3. 40, 6. 3C( 1 ) (c ) , and 8. 4B(4) (b) � APPELLANTS: Walter and Thomas Laumeyer � LOCATION: SW1/4 of the SE1/4 of Section 14, T30N-R19W, Town of Somerset Scott Stewart , DNR, presented the DNR request to rip rap a portion of the banks on the Kinnickinnic River . Mr . Stewart explained the reasons for the request . Timothy Pitzen presented his request to construct a house and pole building that would be = feet from the centerline of a town road, explaining that there is a steep grade on the property prohibiting him from meeting the setback requirements. Thomas Seim presented his request to fill and grade the private road on his property, explaining the reasons for the request . Perch Lake has risen and it is over the road. Peter Torgerson, U 1 � ~ adjoining land owner , objected. Mr . Seim rebutted Mr . Torgerson' s remarks. Ms. Cynthia Swanberg presented the request of DNR to construct three ponds adjacent to Lundy Pond, explaining that ponds are for experimental water holes for cattle and increase wild life habitat . Questions by members of the board. Ms. Swanberg also presented the DNR request to construct a dike in the Cylon wildlife area to create an impoundment for water that would impound 15-20 feet of water 3 feet deep, which would increase wild life habitat . Mr . Richard Kruschke objected to the DNR request , explaining his reasons for the objections. Ms. Swanberg rebutted Mr . Kruschke' s remarks. Mr . Peter Torgerson also objected to the DNR request . Questions by members of the board. Mr . Wally Laumeyer presented his request to move a cottage out of the water , and a 42 foot setback from a town road, rip rap, and holding tanks to stop pollution on his property located on Bass Lake. Qs y L es t i on b members of the board. Kenneth and Julie Speer did not present their request . Kent Drinkwine did not appear at the hearing. Hearing recessed to inspect the properties in question. After inspecting the above properties, the Board of Adjustment rendered the following decisions: 1 . DNR, rip rap portions of the Kinnickinnic River banks. Motion by Supervisor Kinney to approve the request as it will enhance the stream bank and protect the trout habitat . Seconded by Supervisor Sweitzer . Motion carried. Vote to approve: Kinney, yes; Sweitzer , yes; Meinke, yes. 2. Timothy Pitzen: Motion by Supervisor Sweitzer to approve the request to b U ld a house and building that would be 100 feet from the centerline of a town road . Seconded by Supervisor Kinney. Motion carried. Vote to approve: Sweitzer , yes; Kinney, yes, Meinke, yes. 3. Kenneth and Julie Speer : Rip rap. Postponed until September . 4. Kent Drinkwine: Duplex. Motion by Supervisor Kinney to deny this request as they did not appear at the hearing and township objections. Seconded by Supervisor Sweitzer . Vote to deny: Sweitzer , yes; Kinney, yes; Meinke, yes. 5. Thomas Seim: Motion by Supervisor Kinney to approve the filling and grading of 750 feet of road with the following requirements: 1 . Rip rap the road where needed to prevent erosion. 2. There shall be no soil removed from the side hill along the road. 3. DNR approval needed. 4. Consultation and cooperation with the town board . 5. Zoning Administrator to inspect road upon completion. Seconded by Supervisor Sweitzer . Motion carried. Vote to approve: Meinke, yes; Kinney, yes; Sweitzer , yes. 6. DNR, Lundy Pond, and Cylon Wildlife Area. Motion by Supervisor Kinney to table this request until complete engineering data has been submitted to the Board of Adjustment for review and evaluation. Seconded by Supervisor Sweitzer . Motion carried. Vote to table: Meinke, yes� Kinney, yes, Sweitz or- , yes. � 7. Wally Laumeyer : Motion by Supervisor Kinney to approve � with the following conditions: 1 . Setback from centerline 42 NN 2 � ^ feet with the building extending an additional 18 feet . 2. � Building grade shall be raised no more than 2. 5 feet above � present . 3. Holding tanks shall have state approval and not � installed in the right of way. 4. Old structure shall be � removed prior to new construction. 5. By accepting this special exception, Mr . Laumeyer or any future owner shall not hold the i township or county liable for any future damage. E. Consultation and cooperation with the town board is requested. 7. Zoning Administrator shall follow up on this to ensure all the above have been followed. Seconded by Supervisor Sweitzer . Motion carried. Vote to approve: Kinney, yes; Meinke, yes; Sweitzer , yes. From: Thomas Roberts Subject: Streambank Riprap, Kinnickinnic River, St. Croix County Fish management has submitted a request to place riprap on state owned property on the Kinnickinnic River fishery area. The project sites are located in the NW-1/4, SW-1/4, Sec. 21 and the NE-1/4, SE-1/4, Sec. 21, both in T28N, R18W, Town of Kinnickinnic, St. Croix County. A third site (commonly referred to as the Oscar Lee site) in the NE-1/4, SE- 1/4, Sec. 21 was dropped because erosion is not severe. The project consists of placement of rock riprap at 2 sites, totaling approximately 150 feet. Quarry limestone will be placed, then covered with topsoil and seeded to provide a natural appearance. These sites are presently severely eroded. An environmental assessment is not required. Permits have been obtained by St. Croix County and the U.S. Army Corps of Engineers.
