The St. Croix County Board of Adjustment conducted a public hearing on
November 27, 1984 to consider the request of Timothy Hoopman for a special ex-
ception use, Article 4.5 C(7), Garage in Flood Fringe, ST. CROIX COUNTY ZONING
ORDINANCE.
The St. Croix County Board of Adjustment conducted an on-site inspection
of the site in question.
After inspection, the St. Croix County Board of Adjustment entered an
Executive Session to discuss the request.
After returning to open session, the following decision was rendered:
Motion by Supervisor Stephens to grant approval as it does not cause any harm

to the flood fringe. The structure shall be built two (2) feet above flood stage
(high water mark). Seconded by Supervisor Kelly. Motion carried.
Vote to approve:
Meinke, yes;
Kelly, yes;
Stephens.

All variances approved must be acted on or constructed within one (1) year
from date of approval or they shall be null and void.

BOARD OF ADJUSTMENT MEETING AND HEARINGS
November 27, 1984
9:00 - 3:05 p. m.
Meeting called to order by Chairman Stephens at 9:00 a.m. in the County Board Room,
Courthouse, Hudson. All members present.
Minutes of the October hearings and meeting approved as read.
Gerald Garrity alked to the Board on his
y property. Mr. Garrity will contact D. N. R.
and return to the Board. The Garrity case will be held open until January 23, 1985.
Hearing called to order at 10:00 a.m. Zoning Administrator read notice of hearings as
printed in the county and local newspapers.

Mr. Clayton Juelfs presented his request to construct a greenhouse on a six (6) acre
parcel he owns. He explained the reasons he would like to have a greenhouse on his
property. The structure will be 20 feet X 90 feet, and will meet all the setbacks
from the highway.
Mr. Don Dahlstrom presented his request to have a holding tank on his property located
in the Village of Roberts, explaining that the Village would maintain the holding tank.
Mr. Vernon Dull, Village Trustee, presented a letter from the Village Board stating
that they will maintain the hold tank.
Mr. Ronald Stewart, adjoining landowner, has no objections.
Dr. A. Hamid Khan presented his request to construct a greenhouse that would be attached
to his present house. The greenhouse will be used for solar heat. The greenhouse will
be on the rear of the building.

Mr. Kirk Hexum presented his request for a personal airstrip for an ultalight aircraft.
This airstrip will be for his personal aircraft. A letter from Chuck Munson was read
into the record as having no objections. Mr. Hexum requested that the Board of Adjust-
ment approve the request contingent on approval from the state and F.A.A.
Mr. Richard Connors objected to the airstrip, stating that he moved into the country
for the peace and quiet, and the airstrip would be noisy with several aircraft landing
and taking off. He feels that it will lower the value of his property.
Mr Timothy Laux, attorney for Mr. Hexum, rebutted the statements of Mr. Connors. Mr.
Hexum stated that there werethree (3) aircraft on his property at one time, but now
there is only one. Mr. Connors would like to have the decision held in abeyance until
permits from F.A.A. and the state have been approved. Zoning Administrator informed
the Board that the Township has no objections as long as it is for a personal airstrip
for Mr. Hexum's use only.
Mr.Brian Hurtgen presented his request to have a holding tank for a mobile home on his
property. He explained that there is no alternate site on the property for another
type system.
Mr. Timothy Hoopman presented his request to construct a garage on his property that
would be in the flood fringe of the Kinnickinnic River, showing his construction
plans. He will have to flood proof the structure.
District Attory Eric Lundell presented the request of St. Croix County to install a
gravel pit on the Ralph Olson property in the Town of Stanton, explaining the need for
the gravel in the construction of county roads. There is no gravel pit in the northern
part of the county. Mr. Allen Bentley, Maintenance Supervisor of the St Croix County
Highway Department, explained the need for gravel pits in St. Croix County. The need
for one in the area is for economic reasons. The pit will be 950 feet from the Cook
property. In 20 years the pit would be 350 feet from the Cook property line. James
Harer, Crusher Foreman, stated that the crusher would be in the center of the pit for
several years. There would be very little noise from the crusher at the Cook residence.
Thomas O'Keefe, County Highway Commissioner, is responsible for all roads and maintenance
in St. Croix County. Mr. O'Keefe stated that Mr. Ralph Olson asked the county about
the need for a gravel pit in the area. Mr. O'Keefe and employees investigated the
site and found it was good gravel.
Mr. Nole Cook, adjoining landowner to proposed gravel pit, objected for the following
reasons:
1. Traffic hazard
2. Raising Arabian Horses
3. Health problems from the dust
4. Quality of life
He also spoke for Mr. Johnson, who could not attend the hearing. . Mr. Harer informed
the Board that there has never been a traffic accident exiting from a gravel pit.
Mr. Cook feels that the blind hill is a traffic hazard, and could cause health problems
in the area. Miss M. Cook objected to the gravel pit as Arabian horses are bothered
by the noise and dust.
Hearings recessed in order to inspect all sites in question.
Board returned to open session to render decisions.
1. Clayton Juelfs: Motion by Supervisor Kelly to approve the request to construct
a greenhouse 20 X 90 feet on his property. It does not present any problems to the
surrounding area. Seconded by Supervisor Stephens. Motion carried. Vote to approve:
Meinke, yes; Kelly, yes; Stephens, yes.
2. A. Hamid Khan: Motion by Supervisor Meinke to approve the request to construct
a greenhouse on his property as it will not cause problems in the area. The greenhouse
will be behind the house. Seconded by Supervisor Kelly. Motion carried. Vote to
approve: Kelly, yes; Meinke, Stephens, yes.
3. Kirk Hexum: Motion by Supervisor Kelly to approve the request for a personal
airstrip contingent on all state and federal regulations and permits are approved, and
presented to the St. Croix County Zoning Administrator. This airstrip will be used only
by Mr. Hexum. Seconded by Supervisor Meinke. Motion carried. Vote to approve with
the above conditions: Meinke, yes; Stephens, yes; Kelly, yes.

4. Brian Hurtgen: Motion by Supervisor Meinke to deny the request for a holding
tank. An alternate area on the farm should be investigated for a conventional or
alternate type of sanitary system. Seconded by Supervisor Kelly. Motion carried.
Vote to deny: Meinke, yes; Kelly, yes; Stephens, yes.
5. Timothy Hoopman: Motion by Supervisor Stephens to grant approval as it
does not cause any harm to the flood fringe. He shall build the structure two (2)
feet above flood stage (high water mark). Seconded by Supervisor Kelly. Motion carried.
Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes.
6. St. Croix County: Motion by Supervisor Kelly to approve the gravel pit as
it does not present a hazard to the environment and is no closer than 450 feet from
the Nole Cook property. District Attorney shall furnish all proper easements, and
shall have them recorded with the Register of Deeds. Upon conclusion of the gravel
pit, the area shall be restored to its original state as much as possible. Seconded
by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes;
Stephens, yes.
7. Gail & Don Dahlstrom: Motion by Supervisor Kelly to approve the holding tank
with the stipulation that the pumping of the tank to be done by contract with the
Village of Roberts, and copies of the contract and a letter from the Village approving
the holding tank be supplied. Seconded by Supervisor Stephens. Motion carried.
Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes.
Due to Christmas falling on the fourth Tuesday of December, the Board of Adjustment will
be meeting on December 18, 1984.
Motion by Supervisor Meinke to adjourn. Seconded by Superpisor Kelly. Motion carried.
Meeting and hearing adjourned at 3:05 p.m. This is a full day meeting.
