Herlihy Selective Site Consultants, Inc. 8500 W 110th Street, Suite 300 Overland Park, KS 66210 Re: Land Use Permit for Co-location,Parcel#s 31.28.18.P485 and P486A,Town of Kinnickinnic Dear Mr. Herlihy: This letter confirms zoning approval according to the plans you have submitted to the Planning and Zoning Department to co-locate Verizon telecommunications facilities on the property listed above, owned by Randy Cudd in the Town of Kinnickinnic. Staff finds that the project meets the tower provisions of the St. Croix County Zoning Ordinance, Section 17.87(2)based on the following findings of fact: 1. Approval of this land use permit includes the removal of existing Qwest facilities — including a shelter, generator, propane tank, antennae, and other equipment - and replacement with a new Verizon antennae, equipment shelter, ice bridge, and generator on an existing cement pad; 2. All proposed new equipment meets the required setbacks and height requirements of the Ordinance; 3. The existing tower, owned by Sprint, can support the proposed Verizon facilities as supported in the engineering report submitted by Sprint titled 180 ft Sabre S3 TL Tower Structural Analysis, Site MS54XCO62 dated May 11,2005; 4. The proposed Verizon facilities will not interfere with existing facilities as supported in the engineering report submitted by Spring titled Co-location Interference Analysis Report, Site MS54XCO62 dated May 4, 2005; 5. The proposed and existing facilities on site will not pose a threat to public health and safety as supported in the engineering report submitted by Sprint titled Radio Frequency Emissions Analysis Report—Evaluation of Human Exposure Potential to Non-Ionizing Radiation, Site MS54XCO62 dated May 4, 2005; 6. The proposed Verizon facilities will use PCS wireless technology and will send and receive over their licensed frequencies in the 1850-1990 MHz range, which is far removed from those frequencies used by public service agencies; 7. Co-location is an accepted use in the Ag Residential district and is encouraged by the Ordinance; and 8. The application was found to be complete. This permit has been issued with the following conditions: 1. The applicant shall contact the Planning and Zoning Department at least five days prior to commencing construction of the proposed facilities. 2. The applicant shall inform the Planning and Zoning Department when construction is complete and submit photos of the completed facilities and antennae. 4. The applicant shall have one(1)year from the issuance of this land use permit to commence construction. If the permit expires,the applicant will be required to secure a new land use permit. 5. Any minor change (or addition) in the project shall require review and approval by the Zoning Administrator. Any major change and/or addition to the originally approved plans will require the submittal of a new land use permit application. 6. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. This approval does not allow for any structures or development beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. Please contact the Town of Kinnickinnic to obtain the necessary building permits for the proposed construction.
